I am responding to the complaint filed by [redacted] in regards to the sale of her home located at [redacted], IN 46158. After careful review of...

the transaction, I am confident that our company and our agent [redacted] acted ethically and professionally; put [redacted]'s interest as priority; never provided false information to [redacted]; did not disclose confidential information and all offers were presented to [redacted]. Below is an outline of the pertinent facts in the transaction. We would be willing to provide supporting documentation if requested. October 4th, 2014 [redacted] entered into a listing contract with CENTURY 21 Scheetz. Our agent, [redacted], provided a comparative market analysis on the property showing what homes in the neighborhood were selling for and recommended a list price of $215,000 based upon the comparable sales data. [redacted] felt that her home was of greater value and wanted to list the home for $220,000. [redacted] also provided her with an estimated net proceeds sheet, which [redacted] signed. October 10th, 2014 We received an offer on the home from [redacted], who was a licensed real estate agent in Indiana and was personally buying the home. Negotiations occurred and after 2 counter offers, [redacted] rejected the agreement. October 11th, 2014 [redacted] submitted another offer for herself in the amount of $216,000. After counter #1, the offer was accepted by all parties for $216,000. October 16th, 2014 Buyers completed their home inspection. October 23rd, 2014 Buyers sent the Independent Inspection response and didn't ask for any repairs. However, the inspection did reveal that there was no battery back up to the sump pump which had been noted on the Seller's Disclosure form. Buyer stated that if seller didn't want to provide battery back-up to the sump pump that seller had disclosed, would they be willing to leave the two fans in the garage? This infuriated [redacted]. However, it is was our agent's duty to share this information with her. October 29th, 2014 The appraisal was completed. [redacted] requested that [redacted] solicit additional offers. Per [redacted]'s request, our agent left a message for another agent that had showed the property requesting that he show the home again and encourage a backup offer, if his clients had interest. This showing agent NEVER submitted an offer.October 3152, 2014 [redacted] contacted the office wanting to speak with the manager. I spoke with [redacted]. She said she was not happy with the price she was getting and wanted us to waive our commission. She made the decision to list her home for $220,000 and accepted a purchase price for $216,000. I told her we achieved getting her 98% of her list price, she accepted the terms in writing and we were not going to waive our commission. She told me, If we didn't comply, she said she would file a complaint.
November 10th, 2014 [redacted] wanted the closing moved to 6:30pm and the final walk through to be 4pm or 6am the day of closing. [redacted], who took over the transaction at [redacted]'s request for another agent, explained that title companies only work normal business hours. [redacted] then agreed to the scheduled closing time of 4:30pm.
November 12th, 2014 Closing occurred on the home at the time that was scheduled and agreed to by all parties.
