In response to this complaint, I asked the sales associate involved directly with complainant to respondI also asked the office closing coordinator to look into the file as wellBelow are their responsesI also have attached the documentation whereby the complainant signed a Waiver for a home warrantyAdditionally, the home was advertised by the listing agent/company, and not our company, so the buyer and our agent relied on the representation by the the listing agent Complainant also waived a home inspectionPlease let me know f there is anything else you needSincerely, [redacted] See below: From our agent Shane Lathrop:To whom it may concern, This email is regarding the property located at Maple Grove Dr Neenah WIDue to the age of the home the Buyer Barbara Tews (Buyer) had decided not to take out the Home WarrantyThe home is a newer within the 11-15yrs of age so the Buyer (Barb Tews) had felt as though it was safe to not take out a Home WarrantyThe Home Inspection had been waived for the same reason as the Home WarrantyDue to the age of the home as well as the overall visual condition of the home the Buyer felt as though it was safe to not due a home inspectionBoth of the above items Home Warranty/Home Inspection had been discussed in both costs and coverage between Agent & BuyerBuyer had elected to waive these itemsAfter the Buyer had moved into the property it was found that the central air had not workedIf the Buyer would have had home Inspection I not sure this would have been detected due to the time of year and the Inspector not able to run the central air unit due to the lower temperatures outdoorsAfter further inspection from a HVAC professional it sounds to have been non functioning for some timeThe Buyer had agreed to let the Seller occupy the property for about 4hrs after closing just to help out the Sellers with the time restrains of the moveAfter the Buyer moved in she had found that the carpets in the lower level had been removed which this was an agreement that the Sellers would keep these in the home as part of the saleAfter further conversation with the Listing Agent I had found that the Sellers cats had urinated on the carpet and in the basement The Buyer had also discovered that the Seller had taken a light fixture as well as some holes in the wallsThe garage was advertised as a car and that is a minimum of a 24' wide and after further review the garage is not as advertised Shane M Lathrop Century Affiliated First Realty South Nicolet Road Appleton WI 54914(920) [email protected] From our Closing Coordinator, Denise Botz: The buyer did not have a home inspection, it was not written into the offer The buyer waived a home warranty Line of the offer states “Real Estate Condition Report to be provided within 24hrs of acceptance of this Offer To Purchase and must be acceptable to Buyer” RECR in file shows the seller marking “No” to all items, they have lived on the property for years, they signed the RECR on March 14th and the buyer signed on March 26th Shane’s Agent Visual Inspection/Disclosure is marked “No observable adverse facts”, dated March 23rd No below grade square feet is listed on the MLS data sheet above grade onlyProperty is listed as car
