We built our home with Century West in 2009. We are currently replacing our flooring and have found mold in the living room flooring, drywall, insulation and right through to the outside plywood. We believe water has been coming in through the window due to poor installation. It has seeped all the way down into our basement as well.

Desired Outcome

We would like to be compensated for materials and labour to fix the issue and also for living allowance as we will have to move our family elsewhere until the black mold issue has been resolved.

Based on discussions we had with the home owners near the end of November of 2017 it was our understanding that they had just recently found mold under a section of their rug located directly under a portion of the front window in their house. Mold was also found on a portion of the wall under the front window as well. We asked for pictures of the affected areas which were subsequently sent to us. We discussed the photos with them and asked for additional photos of the outside of the windows where the frame meets the stone cladding as this would be a potential point of entry for water.

The photos showed that the moisture (and resulting mold) had come in fair distance (i.e. 2 to 3 feet) from the outside wall. This would indicate that a large quantity of water likely entered the wall system recently and quite suddenly. After reviewing the exterior pictures, it appears that a grout joint under a portion of the window has deteriorated and come out over the 8 ½ years since we built the house and the resulting gap may have let water migrate to the inside of the house. The ability for water to penetrate through this gap can be significantly increased with a driving rain which we do get from time to time in Saskatchewan. This is just one-way water may have gotten into the walls of their house, there are many others. Further to this as a home ages regular maintenance, such as re-tooling joints & gaps must be completed on a regular basis by the home owner.

Without being at the house when they first found the mold and started pulling apart the walls it is difficult to ascertain the exact cause of moisture infiltration. To find the cause you would have to know the conditions when first found and then follow up with the removal of the interior and exterior wall finishes as required. It is our understanding that water leakage in this area was not a problem from the time they moved into the house in 2009 until now, 8 ½ years later. Therefore, we do not agree that the water coming into the house is due to poor installation. We would assume that their insurance would cover the cost of the repairs.

We do not accept this response. Insurance is not covering this work. They will only replace the flooring and drywall that was wrecked but they will not cover the problem. Following is a letter from our contractor.

To whom it may concern

My name is ***. I am the contractor who repaired the water damage at ***. in Moose Jaw. The home owned by *** had extensive damage. When the carpet was removed to install new flooring, mold was found in a 2' x 12' area on the floor in front of the window. Further investigation revealed extreme water damage up the wall to the window. In fact, the water issues were so bad the OSB sheathing behind the water repelling house wrap was completely dissolved.
To fix this issue, the 6' x 12' area of concrete stone on the exterior will have to be removed. The window will have to be cut out of the stucco. . The area re-sheeted, house wrapped and sealed. A new retro fit window will be installed, caulked and spray foamed. Finally the rock will be re-installed.
The cost of the new window is approximately $2670.00. The materials to install, new sheathing, house wrap, expanded metal and mortar will be about $575.00. The labor to complete this including disposal will be approximately $3500.00. For a total after tax of $7486.95
I have installed thousands of windows in my career, and in my opinion this water damage was caused by poor install. The center mullions were shimmed too high and the corners too low. This caused all the water hitting the window to run to the outside corners and pool on the sill. I would also suspect there is no caulking under the nail fin, for this would have not allowed water to pass thru the opening. Finally there was never any caulking applied between the window and the stone, or between the stucco and the window. These areas need to be sealed by the home builder from the beginning to prevent water penetration.

We believe the window was installed correctly and is not the cause of the water damage. If it was due to poor installation the damage would have shown up years ago. The original owners have been living in the house since it was completed 8 ½ years ago and to our knowledge have not had any water issues until recently. Which leads me to believe that something has changed recently to cause water to get into the wall and cause the damage. Therefore, we are not prepared to pay for the suggested repairs because we do not believe the workmanship was the cause of the water infiltration and subsequent damage.
