Please excuse us for the inconvenience to make valid the Warranty under the existing circumstances the house is shifting because water is getting under the house. There was a foundation job done before us. They built a tunnel, but never filled it. *** *** was aware of that. We gave him an Estimate to fill it, but he rejected the job. We also recommended that flow fill be taken care of after we did the leveling. Which was also rejected by *** *** French drain is needed in back house area and till now they still don’t have the correct French drain. We gave *** *** an Estimate for the French Drain. To this day, *** *** has yet to respond to our Estimate or any of our calls. Cerda Foundation Repair is more than willing and able to make the Warranty transferrable once the job stated above has been done properly.Again *** *** is aware of this. Respectfully Yours,*** ***

size***, in a meeting with ***, ***, *** and myself, declined the Estimate we gave him to install the correct size*** *** then had a different company go out and install one for themWe then sent them another Estimate (attached to response) to readjust and test the Piers on left side of houseThis would have brought the Warranty up to date and coveredBut we have not heard back from *** ***, by email nor by phoneWe, as well, have been hoping to get this resolved with *** ***

I am rejecting this response because:the response from Cerda Foundation fails to address the main conflict stated in the original complaint made to the Revdex.com. The main complaint has to do with Cerda Foundation refusing to honor the transferable warranty for work that was originally done for the previous owner by transferring the warranty to the new home owner due to claims that Cerda Foundation told the previous home owner that a drain was required to make the warranty valid. There continues to be no written documentation provided that was signed by both parties addressing this change or addendum to the warranty. According to Cerda Foundation Repair Warranty states "No oral representation made by anyone can change or modify this agreement.". In the provided paperwork it states that "if French drain was done properly, warranty will be but to date and valid.", again there is no initial paperwork to prove that both parties were in agreement that a French drain would be required to maintain warranty.Additionally there continues to be no documentation of measurements made by Cerda Foundation after claimed work was done in June of 2016 which after having another company come and do measurements shows significant issues with height variations throughout the home. There continues to be significant cosmetic and structural concerns that seem to change rapidly from significantly uneven floors, cracks in walls, tile, ceilings, garage floor, as well as the exterior of the home. If the home looked as it does now when purchased back in February then there would have been no way I would have purchased this home.If there is paperwork that shows communication between Cerda Foundation and the previous Home Owner showing understanding that a specific drain would need to be installed and required for the warranty to be valid then the pervious home owner provided misleading and false documentation during the sale of the home. The longer this process takes the more damage will be done to the home that was not "settling" of the foundation as had been claimed. There is more than a 2 in difference if height between the front of the house than to the back of the house with significant differences throughout the home.
