I am rejecting this response because: Upon further inspection, there were still many faults with the exterior paint job: One of the exterior lamps is still crooked, the flower box is still crooked, there are black marks and a hand print above the one car garage, there are black marks between the collection boxes of the downspouts (which has been pointed out several times and not fixed), exterior wall color paint on an interior garage wall, paint spray in two places on the front gutters, a place missing paint on the rear balcony door jamb, and a chip around the rear balcony door knob.As to the broken shower glass, there is no doubt that it was an intentional actThe men installing the new glass confirmed the point of impactDespite sweeping and vacuuming several times, we are still finding glass as often happens when glass breaksMy husband has twice stepped on a pieceOne of the points I made to the Colleyville PD detective was that the paint crew had access to our house via the garage code They could have given that code to anyone.I feel that the 70% is not arbitrary, it is a generous assessment of the level of workmanship on this jobHad it been completed to our satisfaction, with a high quality of work, in a timely manner and without creating more problems when trying to correct others, we wouldn't be having this conversation.The issue of the state of our bathroom sinks and toilets was not addressed Our wet bar sink was also full of paint, caulk and/or texture residueA feeble effort was made to sweep up a small amount of floors by the crew, but no one has attempted to clean their other messes.

First of all, *** has a right to be upset with the way this project unfoldedShe is absolutely correct that this project took much longer than it should haveWe should have finished the interior work in less than a week, and the exterior work in to daysThere were some delays on the project
due to weather, and I know she understands thatBut under no reasonable circumstances should it have taken this long to do the work.That said, we have stuck with this project to make sure that it does get completed to the satisfaction of the customerThere have been two challenges: the crew assigned to do the work has had attention to detail issuesAnd, *** and her husband do have a high standard, which she has told me many times since the project startedThis is something we understand and want to meet, and sometimes that requires a little additional work to get it rightOur contract does specify that "texturing is an art, not a science Each person that does texturing in your home will have a slightly different technique, and therefore it is not uncommon for new texture to be visible if closely scrutinizedOur crews are very good at texturing, but there is no such thing as a "perfect" match." *** really was looking for a "perfect match", and part of the rework we did on the interior was to try and accomplish that for herI'm sure we did not achieve perfection, but we kept trying to get there, and some of the interior rework was due to thatI know there were other issues that just weren't done correctly and we did redo until it was up to our own standards, and satisfactory to her.On the exterior work, we also had issues that should not have occurredBut we have kept working at them until they were doneAs of the last day we were working on the punch list, we believe we have completed the work to her satisfactionBut we are allowing time for her husband also to check the end result, and have not heard from them if he is satisfied or notSo we have not asked for final payment to date.I do want to speak to the impact of rainYes, there was one day when there was a forecast for a high percentage chance of rain, and it didn't happenThere was another day when it wasn't forecast to rain, and I sat in front of her home and watched the rain coming down, and called her to tell her we were being rained out and wouldn't try to work that dayWe live in Texas, where the forecast is not always correctBut our overriding concern is to not get caught by rain that would cause issues for the paintThat is much worse if it happens than loosing a day on the scheduleWe want the work to be lasting, so if the forecast is for greater than 50% chance of rain, we don't workThat's what happened on the day she mentionedI would hope she would appreciate that we were more concerned about the durability of the paint job she is paying for, than getting it done.Regarding the broken shower glass, I have spoken to the crew and every member of the crew has denied breaking the glassI can understand why she thinks it was done by a crew memberShe expressed to our supervisor that she believed a painter did it intentionally because she was requiring them to come back and redo thingsThat's just not a realistic explanationeven an upset painter is going to know that doing something like that would have repercussions on us as a group, and they are not that stupidThe guys that worked on this project have more self-respect than thatI have also spoken to the detective, and explained to him that, while we don't KNOW if our crew is responsible or not, I am sure she feels that we are, and that I plan to pay for the replacement glass in an attempt to bring the overall project to a resolutionWhile the detective may not be telling me his full thoughts, he did not express to me that he felt our willingness to pay for the glass was "an unspoken admission of guilt"To the contrary, he said to me that he "is not a business owner, but if he were, he would probably also choose to pay for the glass simply as a customer satisfaction gesture." Finally, there is no "metric" that can be applied here to finding a proper completion to the projectThe next step we are waiting on now is confirmation from her that her husband has approved the workUntil that is done, there is no way to wrap this upTypically in our industry, when projects are completedespecially if the painting crew comes back as long as it takes to get it rightit is expected that payment will be made in full upon completionI can assure you that many painters would have stopped returning her phone calls long before now, and abandoned the projectBut we don't do thatI have promised to pay for the shower glass replacementeven tried to get a second company out to look at it and provide a second opinion on what it would cost, but she declined thatBut it is my hope that once they have signed off on the work, we can come to an equitable agreement on payment70% is an arbitrary number, and I don't believe that is an acceptable "formula" for concluding the project

I propose to reduce the amount of the project by 20%. That would bring the total project down to $6,796.12. That is a reduction in the overall cost by $1,699.03. Then, in addition, I would offer to pay $300.97 toward the shower glass, purely as a gesture of reconciliation, and not because I believe that our crew broke the glass. That brings the total reduction to $2,000, and the balance due would then be only $6,495.15. This would settle the matter, hopefully in a satisfactory way.I await your response. [redacted]
