[redacted] We are in receipt of the complaint filedAlthough I understand her frustration in the time it is taking to resolve her problem, I am disappointed in her need to file this complaint when we are actively working on the jobShe is well aware of the extenuating circumstances involved in her repair and is also aware that we have a date of 03/23/for the vendor to be in town to finalize the repair. This pool was sold in We have had minimal issues with the pool since and those issues were all minor equipment related and repairs were made at no cost to the customer under her warranty. When complainant notified us of the crack in her pool she was advised that we would have the manufacturer repair the crack but would have to coordinate with them on the repairAlso complainant is also aware that where her home sites she is in a very high water table zone so repairing the pool is at the mercy of the water tableBecause of the high water table, caution has to be taken so that the entire pool does not float out of the groundThe repair also is dependent on the pool being completely dry so that the fiberglass work can be doneWe have had the manufacturer here once before to begin the processAt that time we were not able to control the water flowing back into the pool(This was the first time the pool was drained) They sent a crew a second time and because the water was still seeping they were unable to workThis second trip cost me $because they were unable to work and their travel is not covered under the warranty (this was the second time the pool was drained and was only filled% this time). They are, as I stated earlier, scheduled for 3/23/to finalize the repair( and this will be the third time the pool has had to be drained)The repair certainly can't be made unless the pool is drainedWe have no control over the water coming back in if the water table is highThe pool was refilled after the crew left to keep it from floating and could have been used at this pointComplainant was advised that we would drain the pool again once the manufacturer would put us back on their scheduleAgain, once it was drained we would be at the mercy of the water tableThis has not by any means been an easy repair or one that we could anticipate completion onSo yes, the pool was drained three times in attempts to repair and as a matter of fact the repair was made yesterday 3/23/and the pool is now filing with waterPer the warranty on the pool we are not contractually obligated to reimburse for water however we have agreed to work with complainant and reimburse her for two draining'sWe are contacting the city for an approximate on what those water charges would be for her size of pool. The six foot holes (holes are actually, one 4' and the others are less than inches) that she refers to are the well points that are necessary to try and keep the water out of the pool so that the patch can be madeIf these were not there we would never be able to get the pool to the point of repairThese well points pull water from deep in the ground to try and dry the area under the poolWhen the water table is high they pull as much water as they can and they have to drain out into the street otherwise the water would just seep back into the ground around the poolIf the water table is too high even though they are pulling water they can not keep up with the ground water which is the problem we are having nowThe white calcium patches that she referrers to are from chemical imbalanceThis is strictly homeowner or pool maintenance company related and has nothing to do with the repair on the poolWe advised complainant that this was a water chemistry problem, but as a courtesy we would clean the patches but in the future she, or whoever she has taking care of her pool will have to keep the chemicals in balance or she will have the same problem againThese spots will be dealt with once the crack is patchedThe deck (coping) issue has been dealt with Per her contract this type of work had a one year warranty, however we took care of the issue as a courtesyOn 11/15/we fixed a leak at the pump and cleaned the filterThe filter cartridge was dirty, which is a maintenance issueHowever we cleaned the filter and put it back togetherThe cartridge does need to be replaced, but this is a maintenance item and is not covered under warrantyThe body is covered but not the actual element.Complainant questions the ability to install a different type of poolAnything other than what she has is basically a start overWe can not build on top of what she has, so the existing shell would have to be removed and a complete new pool would have to be installedThis is why she was told that we could certainly quote a new structure.Complainant states that she wanted to use the pool for spring breakHad she of told us that she wanted to use the pool we would have made sure it was usableThis was the time we only filled it 1/z full to keep it from floating and not use as much waterShe states that her pool has not been usable since June of There is no reason why she could not use her pool, it was not drained this entire time and it certainly could have been usedI have also questioned my employees as to the manufacturer not wanting to make the repair since there was no money in it for themApparently one of my employees took it upon herself to make this speculationThis did not come from the owners of this company or the manufacturerThat employee has been reprimanded as to her voicing her opinion in this situation. Our intentions are to get this repair finalizedIt is certainly no more pleasant for us to have an ongoing repair than it is for herWe have addressed all of complainant's issues and expectations prior to this Revdex.com complaintHer yard is sand and will be leveled once finished, and clean up has already begunWhen the repair was started there was not grass so we should not be responsible for replacing grass that was not there to begin withAnd we will replace her garden hose and sprayerHowever, we will not in any way consider a refund on the poolI feel she is really reaching in even requesting thisAs I've said before, this is not an ideal situation and I do understand her frustrations, however we are diligently working to make this repair as quickly as possibleAt the time of this response the manufactures employees are at her house making the repairOnce completed we will then resume with the other issues she is concerned with, however at this point the actual crack repair is our priority.Complainant is stating that she wants a refund of the purchase price of the poolThe warranty does not work that way and is through the manufacturerWe will in no way consider a refundShould she wish to pursue this we will remove ourselves from this job altogether at this point and she can then deal with our lawyers, and also deal directly with the manufacturer***As of this date, 3/24/(this response was started on the 22ndThe pool has been repaired and is fillingThe issues she has requested within reason have been finished and we will consider the water bills once we have an answer from the city on the cost
