I am in receipt of your letter and complaint dated August $D, 2016. This complaint is...

confusing and comes unexpected I personally spoke with Mr. [redacted] regarding his contract and the disposition thereof. Based on my last conversation with Mr. [redacted] I believed that we had this matter resolved to his satisfaction.
On April XX XXXX Mr. [redacted] signed and executed a Room Rental Contract for a wedding reception to be held on May 13, 2017 at Ceruti's Summit Park. It was to be believed that Mr. [redacted] signed this document in good faith and that Ceruti's also in good faith would not cancel or terminate his Contract, [redacted]'s did not cancel or terminate Mr, [redacted]'s Contract.
On April 26, 2016 Mr, [redacted] also signed the Terms of Agreement document in which he agreed to the definition% Guarantees, Pricing, Reservations, Payments and CancelatIon Policies which are also Included in the Room Rental Contract that he signed. Both documents (Room Rental Contract and Terms of Agreement) very clearly state that all payments are NON-REFUNDABLE in addition to the payment scheduled that is required to keep the reservation date.
Mr. [redacted] appears to be misrepresenting the facts and the total amount of his Room Rental Contract. At no time was It over represented to Mr. [redacted] that his Room Rental would cost [redacted] In fact Mr. [redacted] signed six (6) credit card authorization forms for "all future payments" which would be applied to the total cost of the reception including but not limited to Room Rental, Food, Beverage and other services. It is confusing at beat to come to the conclusion that Mr. [redacted] was not aware of his obligations under the Contract and in the Terms of Agreement in which the payment schedule with dates due and amounts were dearly defined in writing and was verbalized as well.
I have attached the Room Rental Contract, Terms of Agreement, Payment Schedule and Credit Card Authorization Forms to support the facts presented above.

After Mr. [redacted] was informed that his original payment was not refundable, he claimed that he desired to keep the room reservation notwithstanding that the wedding was apparently called off. Mr. [redacted] was notified both verbally and in writing of the requirements to keep his reservation. I have attached the letter that Mr. [redacted] received which he refers to as a "bill" for [redacted] It Is Important to note that Mr. [redacted] did not cancel (at the time of July 1") his reservation and Cerutes was obligated to keep his date and had no ability to rent to another prospective client
I personally spoke to Mr. [redacted] and thoroughly reviewed his Contract, Terms of Agreement and his options. After this conversation Mr. [redacted] elected to cancel his reservation for May 13, 2017 and signed a letter dated July 5, 2016. I have attached this letter which confirms the cancelation and termination of his Contract. I informed Mr. [redacted] that if he canceled his reservation that I would do my best to rent his date and work with him on a partial refund. My offer was solely based on re-renting the room.
It is unfortunate that Me. [redacted] filed a complaint without merit while Ceruti's vvas trying to negotiate with him In good faith. Although Ceruti's believes we are under no legal obligation or ethical obligation to refund any of Mr. [redacted]'s payment, our offer of a partial refund still stands contingent upOn the room being re-rented on May 13, 2017 and a signed full release by Mr. [redacted].

I will accept this offer of a refund if the date is booked. I still feel with the amount of time we contacted Ceruti's, the decent option would have been to refund the original payment. I did not dispute the contract, just the amount of time left to book the room should have been the reason for a refund now. Even though we have no proof in writing, we were told for an extra [redacted] dollars (total [redacted] we could have kept the room and not had a catered party. It just disappoints me a business operates this way. We will have to wait and see if we are sent a refund. We have learned a very expensive lesson.
