Good afternoon [redacted] ***, I have received your complaint regarding Cevallos Lofts to the Revdex.com complaining on our selling practices When applying at our apartment homes, like so many, we have upfront costs when leasing First, is our application fee Our fees at Cevallos Lofts are $for the first applicant and $for each applicant there after This is the application fee to run the back ground check and verification and such Secondly, we have an administrative fee of $250, which is allowable per the TAA lease agreement This administrative fee is non-refundable at the time of leasing unless you are declined by not meeting our rental criteria This administrative fee is the cost just that, it is the cost for our team to for holding the unit off the market, prep the unit and paper work and so many more small items that go into renting an apartment home We are not required to breakdown what these costs are applied out to, but they are allowed per the Texas Apartment Association to be charged Please know that some but not all apartment companies elect to participate in this charge back to the residents and it is your option to choose where you call home Leasing at Cevallos with the allowable fees is your option and if you choose not to pay these as the other applicants and residents have, then we regret not being able to find you a home at this time Again, I'm sorry that I can't help you find a home at Cevallos but this is what are fees are [redacted] p [redacted] ext [redacted] d [redacted] f [redacted] e [redacted] w [redacted]

Good afternoon Ms***, I have been given a copy of your complaint filed with Revdex.com on 7/regarding advertising issues First thank you for taking time to present this to us, I'm sorry that you feel it has not been resolved and that this was the best way to proceed Based on the complaint letter, you are stating you were told that Cevallos Lofts was paying 100% by a sales agent Unfortunately, Cevallos Lofts has never paid 100% to locators, or at least not in the last year This is something that is not in their budget, do you have something stating the 100%? We do have flyers in the office showing the 50% and if this had changed we would have definitely had something printed up to distribute So again, I apologize and am not sure where the miscommunication came from but we in fact do only pay 50% of the residents rent (excluding our affordable units) I do have the application dated 3/from your client where they did list you as their referring agent and the lease dating the move in on June 3rd I do also show your invoice dated July 29th with the full 100% commission submitted It is our policy to wait until days after the resident's move in to submit for a locator commission So based on the time line of your invoice, should the amount had been correct we would have submitted it immediately for payment and payment would have been received to you with in days This would have taken us to August 29th (ish) I do know that as of today the invoice (no invoice number) has been submitted for 50% of the resident rent, of $for payment At this moment I do not have a check number and date but will follow up with one as soon as it is released Again, I appreciate your business and am sorry that the situation was not a positive and smooth transaction as we would like it to be and I hope that Home Team of American understand our situation and values our business as well Respectfully, [redacted] , [redacted] NRP Management, LLC Concord Plaza Drive, Suite San Antonio, Texas p ###-###-#### d ###-###-#### f ###-###-#### e [redacted] @nrpgroup.com w www.nrpgroup.com

Complaint: [redacted] I am rejecting this response because: You state that the $cost is to "prepare" the unit for rentalThat is absolutely in that when a tenant moves out from the unit the leasing company ALWAYS withholds part of their deposit to restore the unit to its original rentable "condition"I will continue to pursue this issue until I get the proper clarification on what exactly this fee is used for regardless if it is "allowable" by the TAAJust because it is "allowable" by an organization, does not make it "legal" Regards, [redacted] ***

I am rejecting this response because: You state that the $250 cost is to "prepare" the unit for rental. That is absolutely false in that when a tenant moves out from the unit the leasing company ALWAYS withholds part of their deposit to restore the unit to its original rentable "condition". I will continue to pursue this issue until I get the proper clarification on what exactly this fee is used for regardless if it is "allowable" by the TAA. Just because it is "allowable" by an organization, does not make it "legal".

I do have the application dated 3/11 from your client where they did list you as their referring agent and the lease dating the move in on June 3rd.  I do also show your invoice dated July 29th with the full 100% commission submitted.  It is our policy to wait until 30 days after the resident's move in to submit for a locator commission.  So based on the time line of your invoice, should the amount had been correct we would have submitted it immediately for payment and payment would have been received to you with in 30 days.  This would have taken us to August 29th (ish).
 
I do know that as of today the invoice (no invoice number) has been submitted for 50% of the resident rent, of $680.50 for payment.  At this moment I do not have a check number and date but will follow up with one as soon as it is released.
 
Again, I appreciate your business and am sorry that the situation was not a positive and smooth transaction as we would like it to be and I hope that Home Team of American understand our situation and values our business as well.
