I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint
The second mortgage company and the third were working on the loanThe third one, more aggressive, kept reassuring my *** and I that it would go through, as well and the sale personIt was not until days before closing did they deny the loan, but I had asked for the refund PRIOR to that via text and email, both of which I was reassured would occur WHEN the loan was approved, they'd move the money to the third contractUnderwriting had sent the third mortgage company an approval/eligible findings on *** for $***I had $*** for down payment, PLUS the $*** alreadyThis is crap! I jumped through EVERY hoop, provided ALL information, kept getting smoke blown up our ***, and then to be denied days prior to closingI requested the refunds at that time, still being told to try "*** ***" and talk to the second mortgage company againTHEY did not want to refund monies, NOR did they want me to have that house, because they raised the price once the denial came inI told them I would sign contract for the same price I had it in the original contract when I had approval in handThe sales person NEVER returned my call, never asked for a contract on a different house, as another was going up, same modelRequested refunds several time after that, and was told "too late!" They never honored my FIRST request way back in the beginning, nor did any time after thatThat is illegalI still have emails and texts on my phoneLawyer will be nextThey CANNOT refuse arbitration My ***'s business is with the Revdex.com, and is well aware of the responsibilities of the Revdex.com and the business in question.I will NOT let this go, their answers are not going to be accepted at any time by meI worked hard for that money, one month's salary to be exactIt will not, and does not belong to Brighton, as they did NOT fulfill my expectations, and denied any and ALL requests for refunds

Brighton Homes is not a mortgage broker/ lender and is not
involved with consumer finances regarding loan approval. It is the sole responsibility of the consumer
to work with a lender, submit the proper paperwork and secure a loan. Brighton Homes is not responsible for the
consumer’s loan approval.
In contrast to the consumer’s belief, Brighton Homes had
every intention of selling the home to the consumer at the agreed price of the
original contract. Unfortunately, the
consumer could not a secure a loan, therefore the home was placed back on the
market and sold at market price
The consumer was aware of the risks of losing the earnest
and upgrade/option deposits if a loan was not secured until after the day period had expired

The Consumer was not approved for a
loan within 30 days of the signed contract as required in the contract.  The contract was signed
on [redacted], and after 2 mortgage companies denied the loan, she was
reminded by the sales manager that she would lose her earnest money and...

upgrades deposits if a loan was not approved within
the 30 days.  Past the 30 day deadline, the Consumer decided to move
forward with a new lender (of her choice) which denied her loan 9 days prior to
closing on the home.  Therefore, her earnest money and upgrade deposits were nonrefundable.  Brighton Homes provided the Consumer with a credit for the deposits if she were to sign a new contract for another home within 6 months, so she would not lose them.  At all times, Brighton Homes
complied with its obligations under the contract.

I jumped through every hoop they threw at me, faxed documents they requested, gave them every piece of info they wanted, contacted my [redacted] to be sure I could use some for the down payment, gave my [redacted]'s info, and got 9 days away from closing, when I was told it was a no-go! That is when I contacted my OWN lender, got pre-approval immediately and a written approval in 3 days. I informed the sales person and she never even gave me a courtesy of a return call. With the 1st lender rejection, I had asked for my refund, on more than one occasion, and was continuously told that it "would be moved to the new contract!" I believe they purposefully avoided the return of the monies with every intention of keeping it. I could always hang on to my monies UNTIL approved, BUT I was denied any refund at every request! They are totally lying! My [redacted] was told the same! I will call my  lawyer, and I WILL get my refund, as well as tell anyone I know NOT to build with them since they seem shady to me with all the communications being ignored regarding refunds. How convenient that the contract expired, as they shuffled lenders. Ridiculous!Regards,

The sales person jerked us around, and constantly told from the first that all monies would be transferred to a new contract when I asked for refunds, ([redacted] as well).  When I DID call with a loan approval, I asked to resign a contract on that particular home that very same day, for the same price. She stated she would get back to me, which she never did. I will be talking to my lawyer next, as well as pass on the negative experiences with this company all over the social media! I do not take kindly to being ripped off for $[redacted], when they clearly never intended for us to NOT have that home!  I firmly believe that once the home was complete, someone came and offered to pay for the home cash if the deal fell through.  I do NOT accept this as reasonable. I was not handled well by the first 2 mortagage companies, being told one thing and another happened. None of them used my [redacted]'s information, with his credit scores being much higher, and the third tried some shady business by passing me off as a [redacted], and through [redacted] Choice, again not utilizing my [redacted]'s information!  At that time, I started working with my own mortgage company, using BOTH of us, and was approved via phone the FIRST day for a loan, had the formal approval in hand 3 days later (Memorial day weekend), BUT the salesperson NEVER got back to me regarding the pricing for the new contract. They already had that home listed for $[redacted] when I had a contract originally for $[redacted], and went on to sell it for $[redacted]!!!. They lied and connived their way in preventing me to write a contract, kept my monies and sold that house for way over the appraised price of $[redacted]0.  To me, this is dirty pool, and they were wrong on how this whole thing went down! I talked to [redacted] (mortgage) and [redacted] (sales) almost daily, led to believe that [redacted] would get this done.  Lawyer is going to be all over this!

The Consumer was unable to secure financing for the purchase under the terms of our written agreement.  At all time the Company fully complied with its obligations under all of the terms of the agreement with the Consumer.

Deposits were transferred to a new contract after the first
loan was denied.   
A new contract was signed and a (second) loan was not approved
within 30 day period.
