This complaint covers commercial loan (Reference B) you willingly entered into with CHB. This loan enabled you to acquire equipment needed to start-up and operate your for-profit business, *** LLC. As I understand Reference A, you have requested one item to meet your Desired Settlement of the complaint: "To be contacted and the amount figured out to settle". From your Statement of the Problem, CHB has inferred "settle" to mean a pay-off amount sufficient to close the account and consider the loan 'Paid in Full'. CHB is ready and willing to do just that. 1). Account Data and Status. The interest rate offered in March 2019 was based-on numerous factors which included: credit scores of the guarantors, net worth, age of the equipment, pay history with CHB, number of units in the business (this was *** LLC's first truck), and whether or not the business was a 'Start-up' company, which it was. Since funding on 4/5/2019, your account has had zero delinquencies, zero extensions, zero modifications, and zero times with any amount Past Due. An overview of your loan account effective 8/7/2020 follows immediately below. A current Loan Activity Statement is provided at Addendum A. Amount Paid to Vendor: $24,239.00 Original Loan Amount: $26,226.00Current/Principal Balance: $20,605.34 Pay-off Amount: $20,629.95Amount Paid to Date: $12,645.00 Payments Made: 15 of 482). Resolution Proposal. Taking the above info into consideration, as well as your excellent payment history, CHB will close the account and send a written 'Paid in Full' statement upon receipt of a $17,105.34 pay-off amount. This proposal is good for nearly one month and must be received via wire or cashier's check by 9/4/2020. This amount is $3,500.00 below the Current Balance owed and is the equivalent of an 11.16% interest rate on your original loan, nearly 50% below your actual rate and well below CHB's 2019 average. Naturally, as when any account is paid-off, CHB will send you the negotiable, lien-free *** title for the 2006 *** truck-tractor. Please inform CHB if you accept the proposed resolution described in Section 2) above. I understand you have rejected CHB's generous 'Settlement' proposal for a $17,105.34 pay-off amount with an equivalent 11.16% interest rate. I also understand your stated reasoning regarding a desired 4% - 5% interest rate from ***. 1). Resolution Proposal. In an attempt to reach an acceptable and equitable resolution for both parties while taking into account the realities of the situation, CHB will consider the account 'Paid in Full' upon receipt of a $16,605.34 pay-off amount. Again, the amount must be received via wire or cashier's check by close-of-business on 9/4/2020. Further, this amount is $4,000.00 below the Current Balance owed and is the equivalent of a 9.78% interest rate on your original loan. Companies which were offered this rate in March 2019 for commercial term loans possessed high credit scores, significant net worth, were not a start-up business, and the equipment would generally be new or newer and not 13 years old. ***'s best commercial term loan rate as of 8/7/2020 (Addendum B) was 5.75%, offered during a time when the Federal Discount Rate of 0.75% is at an all-time low. Please inform CHB if you accept the proposed resolution described above.
