The customer came in and asked for an estimate to replace his transmission because it was shifting hard and slipping, after he was given a quote he left the shop and came back a couple minutes later stating he was happy with the labor price and he was willing to let us repair his vehicleHe then requested that we buy and install a rebuilt transmission that he found on ebay himself for 1,375.We explained to him that in our company policy we do not cover labor warranty if the customer brings in his own parts and if the parts were to ever be defective.We also explained to him that we do not recommend him to buy parts online or ebay specifically because we dO not have positive feedback in the past.So the customer asked for a quote on a rebuilt transmission from one of our main vendors, we quoted the customer with a rebuilt transmission from our vendors at 3,400, the customer declined that transmission because he said it was out of his budget.He then again specifically stated he wanted the 1,transmission he found on ebay because it was more affordable to him.So both the shop and the customer came to agreement that the shop would not cover labor warranty if the part were to be defective and the part warranty would be through the third party company only.The shop then explained to the customer that he would have to buy the transmission himself and bring in the transmission once he received it, the customer disagreed and told the shop to buy the transmission through the shop so that the transmission would come straight there because it would be less hassle for the customer and if the transmission were to break down in the future they would have proof that the customer didn't install the transmission at home and had it professionally installed at the shop if that case were to ever happen so the third party shop would warranty them the transmission.I agreed with the customer at that point to order the transmission through the shop to make it easier for the customer, knowing that we're family they would not be able to lie or cheat us.So the shop did as they say and ordered the rebuilt transmission through ebay.Once it arrived the customer took the vehicle to the shop.From there the new transmission was installed and the core was sent to the third party shop to avoid core charges.The vehicle was completed as stated on the invoice.The customer picked up the vehicle on 3/10/and paid the full amount of for all the parts and labor.The customer then called several weeks later stating that the vehicle was having transmission problems again, the customer towed in the vehicle into the shop on 4/20/16.There was a check engine light code for the transmission.The shop contacted the customer and explained that the transmission was defective, there will be no labor warranty and the transmission would have to be warrantied through the third party shop because they did offer a one year warranty, or atleast thats what they stated on ebay.The customer told the shop to get the transmission warrantied and they will take care of the labor.From there on the shop contacted the third party company and was told that they would warranty the transmission.Weeks after weeks the third party company kept lieing to the shop that the transmission was already on the way.The customer were informed after every time the shop contacted the third party shop, and the customer cooperated.After months of contacting the third party shop they finally gave the shop a tracking number of 218-377357, the shop tracked down the number and it was a whole different transaction going to Ohio.The shop then contacted the customer again and explained to them what was going on.The customer wasn't happy and told the shop that they were going to personally take the third party shop to court if the third party shop did not answer within the next weeks.So weeks came, the shop again contacted the customer and told them that the third party shop still did not pick up any calls, the shop was no longer able to contact the third party shop at all.From there the customer came to the shop on 7/14/and stated they no longer wanted the shop to do the repair on their vehicle.The shop offered to buy another transmission in place of the one they requested and they declined, the shop was also willing to pay the core charge to the customer and they still declined, the shop then offered to give them the full refund of the transmission and explained to them that when a customer approves a repair and backs out or decline the full job they have to pay for at least half of the job even if the job was not fully completed, because it was not the shop that declined the work it was the customer.The shop and the customer came to agreement of for putting the subframe, steering knuckles and wheels back on (which calls for hours )so the vehicle can be towed out of the shop without the transmission and also a full refund of the transmission which is a total of 1,and the labor will be deducted from the refund check to make it easier since the customer would have to pay the anyways(which total out to 1,175).The shop also explained to the customer that their vehicle will be going out of the shop without a transmission because the third party shop has their core and we would need the new faulty rebuilt transmission on hand so when we take the third party shop to court the shop will have proof.The vehicle was put together and ready to be towed two days later, once the customer arrived at the shop they were in a very angry mood.They demanded for the check, and the check was given to them way before the shop called the cops, we have a video of him holding the check before the cops even arrived.The customers then demanded for the invoice for the transaction of the new transmission between the shop and the third party shop.The shop explained to them that we have the right not to show them the invoice because we hold a valid seller's permit.The customers were still furious and angry and started yelling at the employees from the shop door, the manager warned the customers to leave and go home because they already received the refund check and come at a different time when they were more calm so they can both come to an agreement.The customer refused and still did not calm down, they were still harassing the workers at the shop even when the employees went back to work.Finally when the mom threatened the shop, her exact words "are you scared to die"? and repeated it several times the shop felt threatened and had no choice but to call the cops.The workers locked up the shop and hid inside the shop to protect themselves from the customers outside of the shop.Moments later when the cops arrived and was explained to about what was going on, the shop told the cops that they both had a agreement already that the vehicle was to be towed before 5:because that was the shop closing time and he didn't cooperate to sign the last invoice.Moments later the cops finally explained to the customers that they had to sign the invoice or we wouldn't release the vehicle to them.The customers agreed and signed the papers, the shop informed the cops that it was closing time and the shop were going to push the vehicle outside of the shop so the customers can tow their vehicle and the shop was no longer liable for what happens after the invoice was signed.The check was given to the customer way before the cops arrived, the vehicle was pushed out because it was past the shop closing time, and the vehicle was not fully back together because the customer declined any further repair and had already agreed on towing the vehicle out without the transmission on the vehicle except parts that were necessary to push the vehicle out of the shop and get towed BUSINESS RESOLUTION TO CUSTOMER: WILLING TO FINISH THE JOB IF CUSTOMER IS WILLING TO WAIT ON WARRANTY TRANSMISSION THROUGH THIRD PARTY, TRANSMISSION WAS REFUND ALREADY IN FULL, WILLING TO REFUND THE REST OF THE PARTS, AND WILLING TO GIVE CUSTOMER FAULTY TRANSMISSION IN PLACE OF THEIR CORE,VEHICLE WAS NEVER DAMAGED

On 7/10/2016, I went to shop to request shop to provide refund from transmission company as shop had made the original purchase from eBayI was informed shop bought directly from transmission company and not able to request refundShop repeated offer to have shop purchase new transmission and gave quote where shop would pay for half of the cost of the original transmission cost that had failed of $and me paying again for $in labor ($1375/+ $250)I requested shop to look for transmission first and present me with options of what transmission were available
On 7/12/shop called me that they had found two transmissionsI went to shop on 7/12/Shop offered first option of a rebuilt unit with a one year warranty with price of $Shop offered second option of a used transmission of 145,miles with price of $with a six month warrantyShop gave third option to refund full price of replacement transmission of $without labor refund and shop would keep the replacement transmission without installing the original transmission as it had been sent to the transmission company for core chargeFor third option, my car would have to be towed out of shop and since wheels were not on the car, shop would charge $to have wheels, subframe and knuckles installed on car to have car towed out of shopI felt that I was limited with my options and chose third option as they are refusing to complete original warranty of faulty transmissionI requested for shop to refund the $today and would pay shop the $on the day I pick up carShop responded that they would write a check for me for $I agreed on the check and wanted to cash it and will return with the $when picking up carShop then changed their decision and stated would have the $labor fee deducted out of the full refund for a check total of $($1375-$200) on day of picking up carI then asked shop if possible for me to cash check first when wheels, subframe, knuckles are installed and then will tow the car allowing me at least two days to tow vehicleShop and I agreedBefore I went home, I requested for shop to leave all parts on car in correct place as I had intention to take car to dealership for repairShop agreed
On 7/14/2016, Shop called me at 1:pm to pick up car at shop and threatened to charge $per day if I didn't pick up car todayI arrived at 3:pmShop asked if I was here to pick up car, I responded that I would cash check first as agreed on 7/12/and would return to tow carShop insulted me that I didn't have any moneyI responded that I do have money but don't trust shop as I have had a horrible experience with shop and wanted to make sure the check didn't bounceShop stated for me to waitI waited minutes with no response from shopMy wife went in shop and asked about why the check has not been written yet and if they didn't want to write the check, can shop show copy of transmission receipt from transmission companyShop denied copy of transmission receipt stating again that I had no right to see shop's receipt with transmission company and insulted me with sexist insult stating why am I hiding under my wife's legs and won't come outI informed shop I have been waiting in office for minutes with no response of writing the check as agreedI never showed any signs of threats towards shop and felt that shop was avoiding having to write the checkI asked for shop to write check of $as agreed on 7/12/Shop then wrote check for me and at the same time another employee went to the back of shop and was calling the PoliceMy wife asked why they were hiding and calling the police and if they were afraid of dying or what because they already called the police so they can come out and discuss the situationShop had already called the police before my wife made this statementMultiple employees starting calling the police at this pointAn employee stated for me to leave while another stated for me to stayI stated that if police are coming, I am staying and will wait for police to arrive
When police arrived, police informed me to sign release form or shop will charge me additional $per day for having vehicle on shop lotShop had originally agreed to allow me two days to tow vehicle out of shop and now have changed the condition to charging dailyWith the new condition, I agreed to sign release form to take car off the lot to avoid further penalties and fines from shopThe car was missing parts including the battery, starter, and torque converterFront license plate was removed, power steering lines disconnected, Catalytic converter disconnected, Oxygen sensors disconnected, axles removed, plastic valve cover removed, hood damaged and not able to close, trip computer screen damaged, intake filter damaged, battery tray disconnected, engine coolant drained, MAP sensor disconnected, PCV valve disconnected, engine ground cable disconnected, intake tubing disconnected, transfer case disconnected, transmission lines and bolts missing, front under panel and tray disconnected, radio and stereo not working, half shaft disconnected, lower frame brace disconnected, steering rack plastic cover disconnectedShop and I agreed on 7/12/that shop would only keep the transmission and would not take any other parts off car and will only call me when this is completedWhen I arrived, shop had not met these conditions as parts were still off the car but shop expected me to still pick up vehicleShop didn't keep their pre-approved warranty to replace faulty transmission and had called me to pick up a vehicle that was not completed to what was agreed to on 7/12/

because the third party shop has their core and we would need the new faulty rebuilt transmission on hand so when we take the third party shop to court the shop will have proof.The vehicle was put I can no longer resolve this issue with this customer. He is putting a lot of strain and stress to my business and myself. He offered resolutions in his first response, I agreed to all his resolutions and tried my best to resolve this issue in good faith.He then disagreed to all his own resolutions in his second response.He also stated clearly in his second response that the they did threaten the shop.The vehicle was never damaged.All paper work are in file, every time the shop worked on the customers vehicle he signed the invoices stating he willingly approved all the repairs.Including the final repair that was done to his vehicle, which he declined the transmission replacement and agreed to tow the vehicle out without anything installed except what was necessary to tow the vehicle out of the shop.All the the parts that could not be installed unless the transmission was installed were put in his trunk of the vehicle.The customer verified that all the parts were there, made sure the vehicle was not damaged, and made sure the vehicle was able to be towed out of the shop himself before the cops arrived.That is why he signed the invoice to to release his vehicle.I'm sure that if any parts were missing or damaged he would have never signed the invoice.We clearly stated to the police to clarify to him that after he signs the invoice, we were no longer liable for his vehicle after the vehicle was towed out of the shop.
