Association. We appreciate the opportunity to respond to the
complaint from Brian ***. He signed his son up to play football for
our associationThere was a game that Mr***’s son did not play as well as
some other kidsThe board spoke with the coach about this because as an
association we have a minimum play ruleWe spoke to the parent and advised
them that this would not happen again and we apologized. After the
incident the child missed weeks of practice and a few gamesIn fact we
thought maybe the child had quit because we had no contact from parentsThe
child came back to practice on September 21, The game on October 17th
Mr***’s son also did not play in the game. His wife talked to the
Vice President about her son not playing during the gameShe then talked to
the coach and he said that he would try to get him worked in USA Football
teaches us that we as coaches have to ensure the safety of the children.
Because our coaches are USA football certified they have to balance the safety
of the child versus getting a child in the game. There were several kids
that did not want to play that game because it was a hard fought physical
game. After watching the game and talking to the head coach he determined
that it was a safety issue to put Mr***’s son in that game. We
understand that this was not his son’s first year of playing football but we
had kids that will play in high school next year getting hurt in that game from
both teams. As an association we will always error on the side of caution
when it comes to the safety and health of any child.
Mr *** was not at the game but later on that evening Mr*** texted the
head coach about his son not playing. Mr***’s wife also emailed the
association trying to get someone to give them a callIn the text Mr***
suggested that his son did not play because he was white. We do not
discriminate based on race, color, religion, gender, or national origin.
There were several text messages back and forth and in one case our head coach
asked Mr*** to stop texting him and harassing him also. He told Mr
*** to contact the board with any of his issuesThe Association Athletic
Director called him to talk with him and was threaten with legal action so the
Athletic Director ended the conversation. Also in an email that was sent
to us there was also a threat of legal actionNo one has contacted him since
that day
The fee that Mr***
paid covers League Fees, Personalized Game Jersey, Game Pants, Socks and a
Mouth PieceAll of the items that Mr*** paid for were given to him.
We play a seven game season and he missed weeks of practice and a couple of
games. His son participated in practice as well as played in gamesSo
based on our refund policy he is not entitled to a refund.
I have attached copies of the registration
form, refund policy, copy of text messages Mr*** sent to the head

To whom it may concern,      My name is Kevin D[redacted] and I am the president of the Chalkley Athletic Association.  We appreciate the opportunity to clarify what we think has happened with the complaint from Tara [redacted]. Our policy states that there is no refund...

on registration fees once practice has started. By her own admission she stated that her son had 3 practices and played in a preseason scrimmage therefore she is no longer entitled to a refund.  Ms. [redacted] put in a request online for a refund and on the form it asks you for the reason for requesting the refund. This was her opportunity to explain to the board why she wanted a refund but in the request she put “Personal Choice”.  So based on our refund policy the board agreed to deny her a refund without the need to consult her. A portion of the registration fees that she paid pays for her son a personalized jersey which we already had made prior to this complaint as well as a pair of game pants and socks.  Those things will be delivered to her within the next 3 days.               Ms. [redacted] also makes a statement in her complaint that I would also like to address. She stated that there is constant swearing, foul language and a hostile environment from coaches and leadership. As a board we pride ourselves in creating a great environment for our children to be successful and play sports. We don’t tolerate foul language or swearing at or around our children.  I say our children because when you play at Chalkley we are all a family.  There is no hostility amongst board members, coaches or parents. Ms. [redacted] has been in the Chalkley program for a number of years. The last 2 years with her children participating in 2 different associations.  Prior to her registering her son to play football Ms. [redacted] contacted who would be the head coach of her son’s team. They talked and she notified him that she was signing her son up to play with Chalkley.The coach has coached her son in the past so she is very familiar with his coaching style and expectations  he has of the players. He does not swear or use foul language towards the kids.  If we have the environment she claims then why would she sign up her child to play with us? At no time did we force Ms. [redacted] to stay or leave Chalkley.  She is free to leave and choose what program she wants her children to participate in. Review: I had paid for my son to play football for this team on there web site and what they had said every child has playing time in games well my son didn't play in one game I discussed this with them and they said it will not happen again well the last game my son yet again played my wife had talked to the vp twice and yet my son did not played I called the coach to ask him and to express my concerns then I had gotten into a texting argument with him and he said he feels sorry for my son that he has me to look up to they are not holding by there agreement and when you confront them they get upset I want my money back for false advertisement and misleadingDesired Settlement: Money back for false and misleading advertisements

Review: I paid $150.00 for my son's participation in fall football. My son attending 3 conditioning practices and played in one preseason scrimmage and I am requesting a refund less the $65.00 deposit. According to the denial letter the association has provided the deposit is the only non refundable fee. I was informed after the fact that the Board took a vote (absent my knowledge and absent feedback from me) concerning my refund and decided to deny the refund. I have the right to remove my child from this Association as the environment has become hostile. There is consistent swearing and foul language from the coaching and leadership staff not to mention that I have another child who participates in an alternate sports program and I prefer to have my children in the same program. Consideration of this refund is greatly appreciated as the season has not begun. Regards,[redacted]Desired Settlement: I am requesting a refund of $85.00.
