My move-in day on the contract is 1/5/2015. The office pushed the move-in time off until 7PM. And the unit given is wrong.I signed the leasing contract on Sep. 28, 2014 for a unit in a 3-bedroom apartment for $550 a month. The contract is from Jan. 5, 2015 to July, 31, 2015. At the time, the office promised a unit that will be available upon my move-in date, Jan. 5, 2015. I requested a copy of the contract, which they said they will e-mail it to me and never happened. Ms. [redacted] was at the office when I signed the contract.On Jan. 5, 2014, I went to the office at 10AM and payed my rent of the month, $494.10. At the time, I was notified that I will not be able to move-in until 12PM. At 10:46AM, the manager, [redacted], called to notify me that because of their cleaning crew shortage, I will not be able to move in until 3PM and will call me when it is ready. I did not receive the call by 3PM, I called the leasing office at 3:28PM, and [redacted] said the apartment is still not ready. I went to the office around 4:15PM, they said the cleaning crew just left the office and going to clean my unit. I asked them to show me the room before I take the key at 5PM. The room was not the same unit as promised when I signed the contract and was not cleaned, either. There was trash on the floor and the ceiling light was not working properly. I went back to the office to ask them if they can change my move-in date to weekend, Jan. 10, and give me the refund form Jan. 5 to 10, since I do not have time to move after dark and cannot take my weekday off to move. They denied and said I will need to sign a new contract to change the date and I will have to honor the current monthly leasing rate, which will raise my rent from $550 to $619. I did not agree and they insisted the room will be ready soon. When the room was ready, it was already 6PM, 6 hours after their promised time of move-in. At the time, I told [redacted] if there is anyway we can disregard the contract, since I do not wish to live on their property anymore. She said that only the property manager has the authority to make such decision, and he is off at the time, roughly 6:30PM. They do not have a way to contact the property manager because he/she does not take work phone with him/her. She promised they will show me another unit in a 4-bedroom apartment and keep my rate at $550 a month, as well as a compensation for the time lost on Jan. 5, which is a gift card with uncertain value. However, I do not wish to move in to the property after so much trouble was brought in on the first day of my contractDesired SettlementI am seeking to disregard the contract and have my first month rent refunded.Final Consumer Response Ms. [redacted] called 1/21/15 and stated the business has met all her requests and she is satisfied.
