And then on March 25, "You will get everything you paid for..." In a phone conversation in mid-April says the order should be ready the following week And ultimately on June states "So by the end of June, I should have everything you ordered and if not, you will take what I have or get nothing."On March and 29, a refund was requested due to no information provided on the order status, now I am supposed to take what he has If the birds are worth $or more on the open market, it would make more sense to refund the original $to me and go and sell the birds (those varieties I DID NOT request) on the open market for a sizeable profit Mr*** has my blessing to do that - refund my original $and sell the birds I did not order for profit.I have attached a few pages of our email conversations for referenceThank You

This response is nothing short of expected.  This is how I have been met each time I have tried to move forward. Constant passive aggression and really no respect to the work we do to actually fill this order.In the first place, we are NOT a hatchery! We are a small farm with very high quality stock and Ms [redacted] is very mistaken if she still considers us a "hatchery".  Also, the fact that she would try to "take me to court"  for shipping her her birds at MY COST in next to insanity.  We have shipped to over 30 US states, Russia and Canada without incident.  It is the way "Hatcheries" get their chicks out to their customers so it would seen perfectly feasible to understand that smaller farms can use the same method of getting live birds safely to their clients.There were many times that we thought we had the correct hatch to finish this order.  I let Ms [redacted] know several times when we were close only to finally sex the chicks and find out we had more males than females.  It happens.  We are not in control of that unfortunately. I currently have birds now to finish this.  NOT all colors will be represented but the birds are already 3 months old or older and ready to go.  And again, the value of these twelve pullets would be near $1,000 on the open market.  There are Gold Laced, Blue, Black, Splash, Buff and Silver Partridge.  These colors we have NOW! If this is not acceptable, I will continue to hatch other colors and Ms [redacted] will simply have to wait until I have her order complete.This offer is MORE THAN FAIR and if she continues down this path of public-bashing then I am done working in this fashion.  Also, due to poor hatch of certain colors we have downsizing as well and three colors that we used to raise are no longer going to be part of our farm.  No sense keeping birds or colors that are either no longer in demand here or birds that are difficult for us to hatch due to fertility or other issues that color may have.  I thank you for the opportunity to work inside this format to resolve this but we are reaching our limit as to satisfying this purchase.  There are simply two options.  Take the birds we have available now, or we will continue and will contact Mr. [redacted] by phone the day we have the order ready to go.  This is her choice.   Again thanks for your assistance and I remain, Sincerely,[redacted]

[redacted] contacted us after seeing a CRAIGSLIST post we had up over late last Fall and Winter. Ms. [redacted] had contacted us AFTER all of the birds we had available had been sold.  She asked me if I would consider selling her more birds at the same discounted price ($20 per bird to close...

our our season when normal price for many of these colors of English Orpingtons can be $75 to $150 each and I did agree but I did tell her that I would have to hatch her entire order and I would try to get them to her at our earliest.I also told Mr [redacted] that all of our sales are set in motion at the time of purchase and that there are NO REFUNDS, however we will continue to work on filling the entire order until we had success.  I referred her to our FaceBook page (Chapel View English Orpingtons) that has a pinned post there explaining that we offer NO REFUNDS but will continue to work on fill any and all orders.At several points through this Spring and early Summer I have had many of the birds in the order and still do.  We have been feeding and growing them up but other colors have not hatched as well for us.  The total amount of rain here all year has been devastating and as of the end of June our entire poultry barn has flooded and ALL breeding has been halted until we get the barns back in operation by having everything dry out, cleaned up and reset for proper breeding and hatching. As of last Friday's 4.9 " rain fall here we are still under water (Photos available if necessary)  There have been phone calls and messages back and forth and the actual demand to fill this order has not gone without frustration.  The questions posed to me from Ms [redacted] have been pointed, rude and very passive aggressive.  The fact that she has a hearing disorder has not helped as I do 99% of all of my client interaction on the phone. I have talked to her Husband twice and give time frames that I felt would be doable for finishing the order but as the eggs were hatching I did not have the proper colors OR sexes to fill her order. Also frustrating for us is that she refused to have any of the birds we had available from her order shipped to her, which I had offered to do at my own expense at one point, and I was told that "If you ship I will refuse them and have them sent back".  That is a direct quote and speaks volumes to the care and well being of the birds themselves from her end.When I take an order then I am "working" for that client.  I have been working on this order for many months.  This has stopped me from selling my hatching eggs in these colors to other buyers,  having to set and hatch 60% more eggs of these colors to insure ONLY FEMALES that Ms [redacted] requested.  So I am already out much time, more money than the actual order was to begin with as each male hatched in this process could have been sold as "Fertile hatching eggs" and I would not be saddled with having extra boys as this time. And it bears repeating, at only $20 per bird when this time of the year they are selling for $75 to $150! So you see the frustration does go both ways. We simply do not give refunds and as I stated the amount of time and money we already have out on this order has exceeded the actual order itself.  I also asked Ms [redacted] and her Husband to consider taking other colors at the time I had many extra females and I was told point blank NO! If that had been done, she would have had her order many months ago but she was insistent to stick to her original order, that she only paid a fraction of the price to begin with. The only remedy to this a this time is one; wait for me to hatch the order in it's entirety all the while knowing I am having to grow and feed at my time and expense the birds ready NOW while other are still to be hatched, or two; take the birds I have available when they are ready as I continue to build this order. I understand she is hours away from here but at this point these issues are no longer valid to someone like me feeding and caring for birds at my expense and quite honestly my "Self insurance" meaning if I loose a bird here prior to her getting it, I would then have to replace it! Again, live animals.I am sorry that is has come to this method of communication but if it helps then all the better for it.  But know this.  I will not be subject to any more demands, veiled threats (Like calling the Revdex.com and "Smearing your name all throughout Social media") or inability to be flexible on a order that was pennies on the dollar to begin with, AFTER the items on Craigslist had already sold! I did Mr [redacted] a favor and I have been working through these two seasons to produce that order and after 45+ inches of rain here on this farm we are still doing well and other birds will be made available to finish this order shortly or she can simply wait as all of my other good clients do.  We are working with LIVE ANIMALS here and Mother Nature does have the final say.Let me know how else I can help you work through this and as always I can be reached at 262.389.9642 for any further questions.  I am at my computer once or twice a week during the Summer and will respond to all messages sent to me in that timely manor.Sincerely,Larry [redacted], Chapel View Farm and Stable.

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]I do not accept his response at all; we have been left in the dark about the order for so long; I am left wondering if he even knows what my order consists of; I never said if he ships me birds that I would send them back; what I said is that if he sent me chicks in the mail I would take him to court because I never agreed to have chicks sent through mail; I think that is way too risky; and I explained to him that that was why I ordered through him being he is in Wisconsin; and that I wanted to drive there to pick them up to ensure their safety.  again many times I would ask how my order was coming; what he had already for me; how many; what colors; how many he had left to hatch yet for me; and he would never answer any of those questions; as a customer; I would think that is only reasonable to ask those things; which leaves me only left to think and believe that he has not one chick for me???  as for the discounted cheap price of $20 per chick; he offered that price to me; after he told me the birds on craigslist were sold; he promised me that my exact order would be filled at that price.  as for taking care of and feeding the birds he has hatched already for me; that is all news to me being again; he would never tell me what he has hatched for my order.  as for losing money on fertilized eggs; in order to fill an exact order that was promised and paid for on my end; that is how it works for any hatchery; I was never told or offered to come get what is already completed of my order; I want to care for my own birds; but I have no idea which birds he has for me; anyway I am not satisfied with his response at all; and I have all of the emails to prove everything if you need them.
