Construction was delayed due to a rainy springDigging started on a day that called for “showers”Digging only started on that day because of constant calling from customer, because of the constant delays and moving the start date because of the rainThe test hole revealed serious underground waterUnfortunately, this happens and all the rain from previous weeks did not help but was not the primary cause of the waterThe customer did not want to pay the cost of dealing with the water as per the contractThe problem is that the test hole showed that the elevation of the clay underground is a few inches below the level of the pool wall and shallow endWater sits on the clay layer and because it does, it creates a constant mud situation above the clayTherefore the mud must be removed and stone put in its placeThis means the entire pool needs a stone layerTrenches must also be dug throughout the pool to channel the water to the very bottom where a drywell or well point can pump it outThere are indeed other construction projects going on at the time in locations where soil conditions allow work to proceed in wet weatherTwo weeks have passed and weather is starting to improveThe customer has decided to cancel the projectWe fully understand the customer’s frustration, but weather and what’s underground in someone’s backyard is out of our controlWe only seek to cover costs, in this case, it was controlling severe underground waterAccording to the contract, if you cancel it you are responsible for the following charges$penalty for cancelling after the layout$for the cost of the liner that is made for your pool(This is yours to keep)$189, $491, & $cost of permits paid on your behalf to Old BridgeThey may issue a partial refund if you don’t install a poolThat would leave a refund amount of $from the $you paid usWe will issue you a refund of $and agree to cancel the contract in full

Construction was delayed due to a rainy spring. Digging started on a day that called for “showers”. Digging only started on that day because of constant calling from customer, because of the constant delays and moving the start date because of the rain. water. Unfortunately, this happens and all the rain from previous weeks did not help but was not the primary cause of the water. The customer did not want to pay the cost of dealing with the water as per the contract. The problem is that the test hole showed that the elevation of the clay underground is a few inches below the level of the pool wall and shallow end. Water sits on the clay layer and because it does, it creates a constant mud situation above the clay. Therefore the mud must be removed and stone put in its place. This means the entire pool needs a stone layer. Trenches must also be dug throughout the pool to channel the water to the very bottom where a drywell or well point can pump it out. There are indeed other construction projects going on at the time in locations where soil conditions allow work to proceed in wet weather. Two weeks have passed and weather is starting to improve. The customer has decided to cancel the project. We fully understand the customer’s frustration, but weather and what’s underground in someone’s backyard is out of our control. We only seek to cover costs, in this case, it was controlling severe underground water. According to the contract, if you cancel it you are responsible for the following charges. $1000 penalty for cancelling after the layout. $2000 for the cost of the liner that is made for your pool. (This is yours to keep). $189, $491, & $350 cost of permits paid on your behalf to Old Bridge. They may issue a partial refund if you don’t install a pool. That would leave a refund amount of $970 from the $5000 you paid us. We will issue you a refund of $970 and agree to cancel the contract in full.

We met in person on June 24th and agreed to move forward with the project. At this point we have resolved the concerns to their satisfaction. The customer has agreed to withdraw their complaint.
