[redacted] did purchase a home from Parkview Custom homes of Ohio LLC Within the contract and warranty there is an arbitration clause that states all disputes must use the American Arbitration Association We have sent MrDoblin certified letters to this fact We disagree the floor is defective and needs to be replaced We wish to resolve this matter in Arbitration

company responses received VIA e-mail as follows: 5/23/17Hi [redacted] ,I just want to update you to the action that took place last week with the roof at the [redacted] ’s roof As previous stated we would call Mr [redacted] the day before to confirm we were coming to inspect the roof Which we did on June 16th Mr [redacted] called back that evening to cancelled the appointment for the following day We are in the process of trying to reschedule the roofing contractor for another day If MrFishbach wants to be present he will need to be flexible with his schedule He does not need to be present for us to do our inspection of the roofRoger 5/25/[redacted] ,With the rain yesterday and today we have not been able to schedule the roofer to look at the [redacted] ’s roof It looks like the weather forecast is going to be good next week We should be able to get on the roof with safe conditionsThanksRoger

e-mail response received from company on 5/10/(was in spam box) as follows: [redacted] ,I am writing you in regards to the letter you sent our company dated 5/6/17, regarding [redacted] .We have been made aware that shingles have blown off the home we built for the [redacted] after their warranty period ended with usEach time he contacted us we made him aware that shingle blow off is not covered under his warranty, which he received with this home We informed him that he would need to hire a roofing contractor to repair any of the small areas that had come loose due to wind damage We also sent the shingle manufacturer’s rep out to the house to meet [redacted] .Until last week we have not been given any reports and still do not have any pictures showing any improper installationIf there is any high nailing on any loose shingles the manufacturer states that individual sealing can take place and is a exceptable repair Last week when [redacted] informed us that he had a report and there were larger areas of concern than previously indicated, we informed him that we would have a roofing contractor out to his house with days to assess the claim of larger areas needing repaired If there is any loose shingle we will address them at that timeCurrently we are trying to schedule an appointment for next week We will call the day before to confirm the appointment.Roger P [redacted] Parkview Homes

Consumer response received VIA e-mail as follows: [redacted] I have read through parkview's responseIt is very innacurateWe originally told them about the shingles several years back when this first occuredWe paid a couple cintratractors on different occasions (which I have the receipts for) to repair the shingles that blew off.The very first contractor told us then that more shingles would continue to blow off because they were nailed incorrectlyThis occurred several more times in different areasI have had other roofers from other Companies( who I paid) repaired shingles in different spotsThe rep they sent to my house was a sales rep and not only wouldn't go up on the roof, he admitted he wasnt qualified to accessAll three Contractors said this would continue to keep happening because there is no seal due to incorrect nailingAgainst mfg install guidelines I provided the report from one of the roofers to Parkview Parkview told me I had to contact the mfg and complete a warranty claims packet because they only carry a year warranty unless they were I stalled incorrectlyI did so and provided the mfg with several shingle samples, pictures and all information they requestedAfter completing there analysis, they concluded that it was very "evident " that the Installer did not follow the install Instructions privided by the mfg on every single bundle of shinglesI even followed up with the mfg by telephone to verify what I was readingThe rep I spoke with said there was no doubt these were installed incorrectlyBoth photos and shingle samples scientifically verify thatI provided Parkview those findings over weeks ago

The report that *** *** is referring to does not state the floor is defective. As good, will the manufacturer offered to pay for boards to be replaced not 50% or a 100%. Again this is a matter that needs to follow the arbitration clause that is spelled out in our contract with him. This is the only way this matter will ever be settled

The shingle manufacturer rep has reached out to Mr*** to resolve his complaint. since the warranty for the shingles is with *** and not Parkview Homes any reimbursements should be go through *** not Parkview homes. the *** rep will be reaching out to Mr *** to handle the details for hand sealing of the shingles next week. I suggest that Mr*** resolve his other issues at that time

We originally told them about the shingles several years back when this first occured. 6/26/17 Hi [redacted], I did see an email from [redacted] the shingle Manufacturer sent to Mr [redacted].   [redacted] agreed to pay for and repair any shingles needing hand sealing.  I have not seen any answer back from Mr. [redacted] to [redacted] authorizing them to do this work. ThanksRoger

The flooring was determined to be defective by an independent flooring inspector hired by the builder and the installer.  Thehey are required and agreed to replace the flooring.  Now they have changed their minds and want me to pay over $2,000 for arbitration.  The claim is not a dispute since the flooring was determined to be defective.

The issue that I am having is not an issue that needs to be addressed by arbitration.  The home was a new home that was purchased and the builder performed a walk through prior to closing.  Another walk through was performed at 90 days and then I was required to provide a list of times that have been identified during the first year of living.  This is what the builder has done on this home and every other new construction home.  By the builder doing this, they have implied that the home is under warranty.  At the 1 year walk through I provided the builder a list of items.  The builder addressed some but was told to contact the subcontractor directly.  The builder and the subcontractor hired an independent hardwood inspector to inspect the flooring issue.  The independent inspector found the floor to be defective.  The subcontractor sent the report to the manufacturer who deemed the floor to be defective.  The floor installed by the subcontractor on behalf of the builder is defective.  This is not an issue that needs to be handled by arbitration.  It is very clear that the floor is a defective floor per the independent inspector hired by the builder and subcontractor and that the manufacturer agreed with the report.  The builder needs to stand by the product that they sold and replace it!

E-mail response received from the consumer as follows:  I still haven't got a call to schedule, and haven't received the check yet. As soon as I get the call and they actually  repair the roof I will let you know.
