Review: On December **, 2013, I had a family portrait taken by the [redacted] of Charles David NYC at his vendor booth at an indoor festival. As a security measure, I sent an email to the company later that night stating my privacy concerns because the photos included my 7 year old daughter as well as my pregnant belly. I expressed that I did not want my photo to be used for marketing purposes and requested that I receive some kind of reassurance in writing. The response I received was that I had signed a model release form when I ordered the photos and that I would need to pay $150 to make the photo private. I would have been fine with paying the fee if I had actually signed a model release form. I then sent an email response stating that I did not sign a model release form and asked if I could see a copy of the order form from my purchase. After a couple more email exchanges, I received a call from the [redacted], and expressed my concerns to him directly. To my surprise, he admitted to using my family photo on his personal [redacted] page. This concerned me because I am not friends with him nor am I connected to him in any way. He said that he would take it off of his personal page, but I have no way of knowing that he actually did, as it was not his public business page. In an effort to meet him halfway, I agreed to allow him to use the portrait on flyers if he wished, but absolutely no social networking sites due to privacy concerns. He agreed and I followed up with him via email requesting that information in writing. I also requested that he send me a copy of the order form that supposedly included the model release form, as well as information for picking up my photos. I have not heard anything from him or his staff since then, despite 2 more follow-up emails that I've sent to resolve this matter. Ultimately, I believe my family's privacy was violated. Furthermore, I have still not received the photos that I paid $20 for. I am asking for assurance in writing that my portrait will not be used for marketing purposes, and I would like to receive the portraits that I paid for as soon as possible.Desired Settlement: I am asking for assurance in writing that my portrait will not be used for marketing purposes, and I would like to receive the portraits that I paid for as soon as possible. If I must pay the $150 fee to make the photos private, I would need to see a copy of the model release form that the company claims that I signed.

Review: [redacted] and an associate photographed my wedding on November [redacted], 2013. We paid them in full 30 days before the wedding and they came and took pictures for 8 hours. When the night was over, he told me our pictures would be ready in 4 - 6 weeks. It is now September [redacted], 2014, almost 9 months after the wedding, and all I have received is half of his associate's unedited pictures. We have been messaging him at least once a month for the last 9 months to get updates and at first he told us he was having computer problems because he lost his mac, then he told us the hard drive with all the pictures got damages, then he told us he found someone to recover the pictures but they were not getting back to him, then the story was he has them all and that "they were looking great" which gave us false hope. Now he is not responding to messages.

I have told [redacted] that if I do not receive my pictures or my money back by October [redacted], I will be taking him to small claims court. He has not responded.Desired Settlement: I want my pictures. My wife is devastated that we still do not have our pictures of our special day. We have some, but they are not enough. They are only from his associate's camera and are not very good.

We want all of our pictures right now or our $1500 back in full and not a penny less since all we have now is garbage.
