It is our continued assertion that [redacted] was left with a copy of the landscaping service agreement for his home, however he is correct that it was not signed When he paid the first installment of $plus tax and continued to pay the same amount every month it was our understanding that he was in fact in agreement with the terms Monthly customers like [redacted] do not get a list of services completed detailed on their monthly invoices This is because they have a service agreement that lays out the lawn care program for the year These services include: Spring (or Initial Clean-up), property maintenance program which includes the weekly cuts and edging and states November cuts "as needed", trimming and pruning usually done twice a year, lawn renovation in September/October, leaf cleaning and removal from property throughout October/November as needed, Fall (or Final) clewhich includes pelletized lime and our lawn care program which includes applications of lawn treatments made during the appropriate months April-October If [redacted] never had a service agreement from us I do not know how else he would have known what services we provide and what services we completed Again, I mention this all because it is another example of why it was our understanding [redacted] had a copy of the agreement and knew his bill would be payable through December

Review: I was invoiced the full monthly amount ($150 plus tax) for December. However, there was only 1 time that month [redacted] serviced my property. I have asked [redacted] why would I be charged for a full month for only 1 service in a month? I also pointed out that [redacted] skipped Thanksgiving week service but yet we were also charged for the full month of November service. I have asked [redacted] why he skipped the last week in November to service my property one week later and then charge for the full month of December. I have stated I don't feel I should pay for any of December (monthly charge is $150) considering his crew skipping my property that last week of November - and I have told him I find that ethically wrong. He states that is what the contract terms are, but I never signed a contract, nor recall receiving a copy of it to review as I interviewed 4 or 5 landscapers while I was also residing my house & repaving my driveway. On top of that, I was home that last service day, Saturday 12/*, and and [redacted] did not cut back the Montauk Daisies. Considering he trimmed back all other plants/bushes, I would assume that is within the scope of their work. He never answered my question why he didn't trim them, and they still remain untrimmed.Finally, I've pointed this out to [redacted] at least 2 times over the year, but the strip of grass from the sidewalk up to the path on the non-driveway side of my house was never properly done by his crew. There is a noticeable height difference in the base of the grass/dirt level on both sides of the strip. This used to be concrete which I had removed and [redacted] charged me $50 to fill it in with topsoil & seed. I've asked [redacted] to fix this but it is yet to happen. He stated he would work on it in the Spring, but with the billing issue I've had and how unimpressed my wife and I are with his quality of work, we don't want him back. I will hire another landscaper, and pay again for it to be done properly - at the height of the rest of the front lawn.Desired Settlement: Charles Landscaping says I have a contract; I never signed anything & only had verbal dialogues around service with [redacted]. It is my recollection and impression that it was $150/month but prorated based on the # of times the property was service. I began with [redacted] in mid-May and he prorated me that month.To resolve this matter I have proposed to them twice recently that I would pay them $100 of the $300 they say I owe. Less $150 for the month of December; less $50 for the strip of grass.
