Review: Failure to complete renovations(adding shower enclosure). Failure to do work in a timely manner. Contractor has already been paid in full per contract.Desired Settlement: Complete work immediately per contract OR $5000 refund

I'm sorry that you haven't received anything yet. I sent an email with stuff attacked to it a few weeks to a month ago. I checked my sent messages and it doesn't show it sent so I will send it when I get to my home computer.

I entered a contract with Charles Salyer on or about February 18, 2013. The contract was for home renovations at [redacted], Tn. The contract at the time was for a total of $17,000.00. This was for remodeling attic area, bathroom and kitchen. Mr. Salyer did not have copy machine and promised to leave me copy of contract which had both signatures. I do not have copy of contract. I have attached copies of payments to Mr. Salyer (2/18/13, 2/25/13, and 3/4/13) in amount of $15000.00. Additional payments were made to Mr. Salyer on or about 5/23/13 in the amounts of $4000.00 ([redacted] check # [redacted]) and $1000.00 ([redacted] check # 4550) to satisfy $2000.00 remaining per initial contract and $3000.00 to cover cost of renovation completion. On 5/24/13, Mr. Salyer and I agreed that payments totaling $20,000.00 would satisfy final cost with the understanding that several items had to be completed. One of which was glass shower enclosure. Per Mr. Salyer, company that installs must come to residence to do their own measurements before installing. He stated that company would contact him and he would be there for measuring and installing. Mr. Salyer, at this time, still has key to residence and shower enclosure has not been installed. Other items needed for completion include hand rail for stairs going to attic, plaster and baseboard on wall going downstairs, baseboard next to rail upstairs (right side), covers for recessed lights (bathroom and upstairs) and check valve. Mr. Salyer never completed work as agreed. I have tried without success to contact Mr. Salyer even though messages have been left on answering machine. Please note that at time of contract, Mr. Salyer gave me an estimated time of completion of 3 weeks. I informed Mr. Salyer that I had time frame to get this project completed because of insurance claim that would expire in April 2013. I was not able to benefit from claim because work was not completed in a timely fashion. Mr. Salyer was not consistent with following through on promise to complete job despite fact that payments were made in a timely fashion. In summary, Mr. Salyer had been given $15000.00 by March 4, 2013. Facts show that majority of work was not started until week of 5/20. This was after continuous calls were made to Mr. Salyer asking whereabouts and completion date as well as letting him know that I did not want to have to take legal matters to get work completed. I am requesting that Mr. Salyer return to me $5000.00 to cover completion of renovation and reimbursement for insurance claim loss. Thanks for your help in this matter. [redacted]

I met Ron at the house and went over what work he wanted done. We made him an estimate of $25,000.00 and Ron said that he could not afford that. So we decided what work he wanted done for around $20,000.00. The work decided upon in old bathroom was gut bathroom, put in new tile floor, sheetrock walls, frame in and tile 3’x5’ shower with three walls, shower door, new lights, new sink and cabinet. Then fix a bedroom upstairs including have to wire, insulate, sheetrock and paint. Down stair agreed upon reworking the window and door trim, but painting and finishing was home owner’s reasonability. Back room discussed was to make a mud room/ laundry room with sink, washer and dryer hookups.

Extras done at Mr. [redacted] request saying that he had to have them and would reimburse us for are:

Take out all interiors doors, had to sand, paint, build new jams, and reinstall.

Move bathroom wall twice after agreed upon location, with both times having sheetrock hung and electrical done.

Take out two walls in living room/kitchen hung sheetrock, patch holes in ceiling, hang light fixtures and patch floors with new wood.

After wall finished in living room/kitchen asked to install electrical outlet in wall.

Take out old kitchen cabinets fix sheetrock, fix electrical, fix plumbing, install new cabinets, sink and fixture.

Paint all walls and ceiling in the house expect first floor bedroom, besides where else not agreed on in contract.

Paint all trim in the house, besides where else not agreed on in contract.

Install new baseboard in house, besides where else not agreed on in contract.

Rework plumbing in whole house because it was rotting and would not work.

Dig up yard and fix broken sewer line.

Rewire and install light switch for basement light. Worked before by twisting and untwisting bulb.

I told Mr. [redacted] before starting extras that there would have to be change orders made and he said that change orders wasn’t necessary to do the work and he would pay whatever it cost. I thought he was a pretty trust worthy person is why I took him at his word and no change orders were made. When building the shower Mr. [redacted] said that he would like for it to only have two walls and two walls of glasses. I explained to him that was not in his budget and that the new shower door would be his reasonability, which he agreed upon. In the contract I had about $300-$400 shower door figured in and the glass door that he wanted would have to be custom made costing $1,800.00 from the lowest estimate I received on it.

I received your e-mail with Mr. Salyer 's response today and found his response to be quite insulting and not true at all.

The initial agreement for renovation cost was $17,000. The total payment to Mr. Salyer was $20,000. Bathroom: 3x5 shower stall was never an option because we discussed the fact that it would not accommodate my mother who is handicapped. On the day of final payment, when asked about glass shower enclosure, Mr. Salyer stated that the shower installers would come out, measure for correct size and then install. My friend who was with me at the time, asked Mr. Salyer if he would be doing it and he stated they would not accept his measurements because their policy is to do own measuring and installing. The bathroom window was not changed to glass blocks. Completed bathroom walls were not moved twice. Change was made at framing stage because commode area was too small to accommodate anyone handicapped. The stall was so small you could not turn around. I purchased bathroom vanity and countertop.

Kitchen/Living Room Area - There were no holes in ceiling to be patched. Patching in floor was minimal (see attached) . I am not sure what outlet he had to change, however attached breakdown from Mr. Salyer list this change at no added cost. I purchased kitchen cabinets, countertops and sink.

Upstairs Bedroom: Did not put handrail going upstairs to bedroom. Mr. Salyer was reminded of this in presence of my friend and also carpenter working with Mr. Salyer. Also, I was summons to the house by my brother who happened to stop by and notice that no insulation was being put upstairs. When I called Mr. Salyer regarding this issue, he stated that his workers should have done it and he would correct.

I have had no contact with Mr. Salyer since the date of last payment. Mr. Salyer still has key to the house. I fulfilled my obligation with payment to Mr. Salyer. I am only asking that Mr. Salyer fulfill his.

It is very obvious that Mr. Salyer failed to meet his commitment. The fact that Mr. Salyer is claiming to be sick does not excuse him from completing job. His sickness now should not play a part in what should have been completed between February 18 and May 24, 2013. Initially, Mr. Salyer stated he could complete job in 3 weeks. There is a total of 14 weeks from initial start of job until I last saw him in May. As of today, he still has key to house and has failed to return to finish anything or even call me. Mr. Salyer was made aware at beginning that house was being remodeled to accommodate my 89 year old mother. So needless to say, she has not been able to move because work is incomplete.
