I have reviewed the offer made by the business in reference to complaint ID***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
Hi, ***, *** *** *** claims he sent me checks. I have not received $650. He said to me yesterday he mailed them by certified mail. If that is true he should ask postal authority why they did not deliver me. Secondly, he is in the habit of fabricating the evens.
Of course, *** *** called me as usual started blaming me as he did in his previous emails. Now he told us that we are unethical and unreasonable people. WE do not want to deal with this unreasonable and un professional person anymoreHe should return our money $in seven days on receipt of this msg to him. Moreover, he should give us in writing that he would not put lien. If I did not receive my money and in writing from him about not putting the lien on our property, I shall send the complaint against him and his company for his nefarious business practices to the Customer Protection Service to investigate him
Regards,
*** ***

After thoughtful consideration we are in agreement reimburse you the remaining amount for the service call and the $650 that was in addition to our signed contract for the extended labor plan. We will absorb the cost for...

the repair that [redacted] caused so that we can all move on.
We are a very professional company and expect to continue to maintain an honest and reputable business that we spend a lot of time and money to do so. We take our reputation extremley serious. So please understand that before you start slandering us on the internet and Revdex.com. Which I have never had a complaint in 13 years working for myself.
Our company has went above and beyond for you as we do for all of our customers, For example we replaced the return duct plenum box on the new air handler's at no additional cost to you. Once we removed the old box and the condition of it we could not reuse them. They were beyond repair as both  agreed. We replaced them at our expense and mastic sealed them. Both [redacted] were grateful then. This was at our expense of $375 each for a total of $750 at no additional charge.
We pride ourselves in our service and installation and forth right way of doing business. So please understand that the [redacted] have been treated just like every other customer we have dealt with the utmost respect and dignity.
Our company and it's employee's are very friendly and and not allowed to use vulger language. So let it be clear that we have not been disrespectful to either [redacted] [redacted] in any shape or form. Even while we have been yelled at, argued with, cursed out, and accused of being crooks which is highly offensive. Again we spend a lot of time and money to run a very clean and honest business and take these accusations very serious.
We have always stated that we will honor our original warranty but we felt we should be paid for the repair that we did not cause. That is all we felt was fair. And only after numerous times of being yelled at and cursed at and disrespected did we decide to not work with you over the extended labor plan that was in addition to our original contract.

Your wife kept blaming me and my company for the repair only on the premises of us advise you guys to clean out the old auto parts, rotten boards, and household trash and put down plastic for a vapor barrier. She told me it was my fault they broke the switch again because I advised you guys to hire someone to do the work. Which you offered to me and my company and we declined the offer. You then do the work yourself weeks after the installation and did not hire the guy you told me you were hiring to do the work. She repeatadly told me we were crooks and we had been paid for the work and we were responsible for the repairs while yelling all of this at us over the phone as well as cursing us and threatening to call 911 on me somehow??? And then hung up on us.
I called her back to advise her that the they owed us for the service call  still and if left unpaid then we will apply a mechanics lien on property. She then went ballistic again cursing and yelling and calling us names and accusations.
I advised her that we would not continue this abuse and to not call us again if that is the way they talk to people. I hung up the phone. Well that is when I get a call last Sunday from the [redacted] demanding me to call them.
I sent an email out last Sunday explaining to them that we are not entering a 10 year labor contract and refunded then the original amount minus the service call repair. Which we are refunding today.

So this situation to me is like buying a car and someone telling you need to drive the car. You then drive the car into a ditch a wreck the front tire. You then expect the seller to fix the car even though you drove the car yourself and wrecked it your self.

[redacted] first contacted us on July 8 2014, We met with both [redacted] on site to do the evaluation 7/9/14. Both were very kind and asked alot of questions which we walked them around and answered very clearly visualy and audibly. I explained to them that we would be replacing the system only and reusing all existing ductwork. We would mastic seal the ductwork at our connections and reuse the electrical connections which is normal. The system size was only for what was exisiting as the exisitng ductwork was not sized for a larger system and that it is in poor condition. I offered to replace both duct systems for $3500 each which they declined immediatley.

I then advised them of our extended labor for $325 which we pay $296 from York. Once they got my 1/2 off price to do both systems at the same time for $3000 each. Both [redacted] started to try and work my price down which I was firm in the explanation of the warranty and services. They actually started arguing amunst themselves as she was trying to work me down and [redacted] was telling her to stop. [redacted] then looked over my contract and started arguing with our policy of 1/2 down. And that we were crooks for asking for that upfront. I explained to him that we are a cash based business and cant afford to be a bank and that secures the equipment for the job. He then asks for a referral. Which I called a customer right then and there for him to speak to which he declined at the moment. We had just completed his job right before we were pricing the [redacted]. I then advised both Khanna's that if we did the work that we were busy for 6-8  weeks and to call me if we could be of assitance. We couldn't put them in the schedule until the downpayment was in hand.

[redacted] call us 4 week's later to tell us to do the job per the contract. [redacted] gave me his word to order equipment and he would pay. He would not do 1/2 down payment. I told him we were 3-4 weeks from replacing the system in our schedule. He advised me no problem that to call him 3 days in advance to schedule with the tenant. I call him on 8/23 to schedule the install for 9/3/14. That is when he sends out email trying to get me to install a bigger unit, new ductwork resizing the system, etc,

This is days before the installation. And so that [redacted] can be reminded I did refuse to do the work based on how he was trying to confuse us and get use to do things we did not agree to. It is very disrespectful and offensive. Mr. they then begged us to move forward at that price. I reluctantly agreed because we had already bought and paid for his equipment which is non refundable.

When we showed up they did give me a downpayment and tried to get me to sign a piece of paper hand written with us doing things that we did not agree to. I explained to her we do not sign anything that is not on our letterhead and that our contract is what we adhere to. She got very rude and offensive and called [redacted] right then making me feel like I did something wrong. She claimed I was dishonest. Once we proved to them our work and what extras we did and not charge them they both were very happy and told us we did very professional work and they would refer their friends and associates to us for future work since he was a real estate agent.

Everything was fine until the time the they installed the plastic and broke the ez- trap switch that shuts the whole system down and not operate. I am still being accused of a scam and of faulty work when the system was left operating and was operating for weeks after the installation until we found our switch hit by something and broken???
We naturally do not expect to pay for such repair as neither I nor my company broke the switch or cause the system to not operate as it was installed. We still feel that we should not absorb the repair but after seeing that the [redacted] dont see it that way and they continue to slander me and my companies reputation because of the [redacted] faulty work. We have tried being nice, firm, respectful, we still get accused of being crooks and degraded as if we have done something wrong here. Upon being yelled at and false accusations against me and my company for just trying to do what is right we have again always maintained a professional attitude.

So we again feel that you feel you are intitled to more than we have given you and that we just cant continue this verbal and argumentative abuse. I tried contacting you yesterday again when I was verbally abused and hung up on. We were trying to work out the issues and be fair so that we can move on like professionals but you then again started with the abuse.

[redacted]

These are the facts no matter how you wish to see them We have done nothing wrong and we are very dissappointed that we cannot service you fo 10 years. You are the first in my 13 years working for my self that has made these kind of accusations and complaints. But I have tried everything to make it work. But I beg of you to stop slandering me and my company as we performed a great service for you and your family at a great price that is un-matched. We again spend alot of time and money to maintain this and we are starting to go somewhere neither party wants.
All we asked for was a little respect and dignity in how you treat people and be fair and honest. We don't believe in dishonest business no more than you believe in being ripped off.
Everything stated above is the absolute truth no matter how you turn it, spin it, or justify it. And our gods will be looking down on us both. I will fully refund the remaining amount left owed that was deducted for the service call. We will continue to honor our 1- year labor warranty as we have stated as long as we are treated with respect and honesty. We will not warranty any future service calls that are do to acts of nature, break downs due to someone else servicing, or breaking the unit, nor will be warranty a system that does not have proper maintenance done to it every 6 months as this is the insdustry standard and requirement. Warranties do not cover failures due to lack of maintanance like dirty coils and drains.
Life is to short for this.

Thanks

Revdex.com:
I have reviewed the offer made by the business in reference to complaint ID[redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
Dear [redacted]:  It was nice to talk to you.  [redacted] is not a trustworthy person. His yelling and cursing to my wife who is scared of him compels us not to deal with him any  more. He is the one who breached the contract for not performing it. I shall propose him our following demands:
1. Refund of $650 with in seven days . He would send cashier check at my office address [redacted].
2. He would give us in writing that we do not owe him anything.
3. He would give us in writing that he would not place any  Mechanic Lien against our properties [redacted].
4. We want that a reputable third party (air condition company) would serve our units on behalf of [redacted] during one year warranty period. [redacted] will pay that third party during one year warranty which he agreed to honor.   We shall call the third party.  We are insisting on this because of [redacted] behavior and attitude towards us.  It makes us very uncomfortable and makes us unsafe also. He would not go on our properties.  Thanks, [redacted]

Review: Charlottesville Heating & Air LLC installed two complete air condition units at my rental property on Sept.2 & 3, 2014 Charged $6650 for two units with ten year labor and parts warranty as per receipt. No written warranty from the installer except invoice/ receipt. Requested him to give us in writing about his responsibility about labor warranty. He referred us to read receipt. Installer gave two booklets in respect of products' manufacture warranty. One of the unit stopped working on 09/20/2014.My wife called him to fix it because it was installed 20 days ago. Installer went to fix the unit. Called my wife that unit was down due to breaker problem. He said he fixed it and wanted $39 as service charge. My wife told him that he had told my husband and me that units were covered for labor and parts for ten years. He then started using foul language. My wife objected to it.Now he wrote us a nasty email that we were rude, belligerent and disrespectful to him. He would not deal and honor the ten years contractual obligation. He also said he would charge $177 for the service and return our balance $423 from the $650 which was collected by him for ten years for labor warranty. He is threatening us if we did not pay his service charges he would put lien on the property. Our question is that we as a customer gave him business and we expect professional and courteous service. We do not want to be intimidated and insulted and accused by the vendor. He has set mind that we are untrustworthy. When I interviewed him for the job he was reluctant to answer my questions and was very upset. Customer has right to ask question and understand what he/she is getting into. He had a choice whether to do my work or not. If he did work he should stand behind it. Now my wife is scared of him. I do not know how we should deal with him when he does not want to deal with us.Desired Settlement: Installer should apologize to my wife for cursing her and for tarnishing our image by writing nasty email accusing us we are the problem. If he cannot perform the obligation of the contract he should refund us $6650 and pick up his units. He should give us assurance in writing that he would not harass us, curse us and would provide professional service without tarnishing our image in front of our tenants. He has no business to talk to our tenants.
