On 2/23/we cancelled and refunded the incorrect billing.John Hinds, General Manager

The cancellation process here is nearly criminalThey make it as difficult as possible to cancel without additional chargesNo one is willing to assistI moved over an hour away and have to drive back to the club I signed up for to cancel or send a certified letter

I am the new General Manager at this facilityI had spoken with Mr*** regarding this matter, and had passed ** upward to Corporate, who contacted him the day of talking with himIt was explained to him by myself and my superior, that
there was no letter on file for any cancellationIt was also explained that unless he had already moved out of this area, there was no reason to send a letter, and he would have a recieved a cancellation report upon request when he initally tried to cancel here at the gymThere were no copies of the letter, it was not sent priority, therefore there is no receipt showing a letter being delivered or receivedAfter trying to explain to Mr*** that there was no recipt of the letter, there was no copy of the original letter, and that EVERY member that comes in to cancel recieves a cancellation report for their records, which was not shown to me from his endThat I followed 100% company policyI did apologise to him, on behalf of myself and the company, however, with no proof or documentation of him coming in to cancel, the cancelation was put in immediatly upon his request to me, where he did recieve a copy

As I explained to the new manager when I attemted to close my account for the third time, I am not responsible for the prior manager's and staff's inadequate training and record keepingI was told by the staff the first time I tried to close my account that I needed a letter stating my intent to close my accountIf all I needed to do to close my account was sign a piece of paper I would have done it then or when I came in to turn in the letterI came in twice to close the account and was never asked to fill out paperworkThe new manager was the first person to actually have me fill out paperwork to close the accountIt is not my fault that their staff was either poorly trained or actively trying to deceive meIt is also not my fault that they lost the letter and have poor filing practicesI understand the new manager is dealing with the old managers messThe new manager conceded that there were numerous other customers that had similar problems with the prior manager and his business practicesIf they are aware that the prior managers was incompetent then why do they not believe that I legitimately have been trying to close my account for three months?

Please see attached documents. This individual came into Hoffman Lumber Co. and ordered a 6-0x 6-8 door and a 3-0x 6-8 side panel before he had a rough opening to install it in. He did not consult with his contractor about the size of the opening required to install these items. He later asked his...

contractor, an individual Hoffman Lumber Co. has worked with many years, to remove a section of his wall and install the items. His contractor informed him that because of structural requirements he could not remove a section of the wall large enough to install both items. He was only able to install  the 6-0x6-8 door. The windows delivered to  the individual  were exactly what he ordered. These windows meet or exceed the requirements of the Texas Department of Insurance for the gulf coast of Texas. When Mr. [redacted] placed his order for the door and windows he was informed that Hoffman Lumber Co. does not stock doors and windows and that all orders for same are special order and not returnable. When he brought the side panel back to  Hoffman Lumber Co  and asked for a refund he was reminded  again of this policy.I informed Mr. [redacted] that I would keep this item in my warehouse and if possible try to sell it to someone else. However at this time my offer to do this has been withdrawn.Robert L. [redacted]

As stated before, my first encounter with Mr[redacted]
was to inquire if Hoffman Lumber had a source for Simonton Storm Breaker
Windows
Specifically:
- 108" x 80"
3-Panel Patio Sliding Door (not the 6-0x
6-door and a 3-0x 6-as stated by Mr [redacted])
- 3'x 5'0" Double Hung Window
- 3'0" x 3'0" Double Hung Window
All were to be:
Simonton Storm Breaker Plus 300VL,
Meet Texas Windstorm Requirements
Be for New Construction (with
nailing fins)
Qualified for Energy Star Regions
- Southern
M[redacted] was given a list of items required and the specifications for each
item as per my engineering printsTo be clear, my house was already framed to accommodate
a 108"x 80" doorHe called several days later and said he had a source for
Simonton products but that the 3-panel door no longer met Texas Windstorm requirements
I later found out this was totally untrueAs stated in my first post, he suggested
that I buy a 72'x80" panel door and a third panel the same size as the panels in the
panel doorThe extra panel could be
framed alongside the door to give the appearance of the panel doorThe panels
in the panel door are 36" x ½" overall with the glass dimensions being 28"
x 1/2". I was expecting a third panel the same size, What was received was a
picture window with the overall dimension of 35½" x 79½" and a glass service of ½" x 73½"The contractor Mr[redacted]
refers to, who was involved in the building of my house for the original
owner and whom I've known over years, came to me to inform me that the framing
needed to accommodate the original 3-panel door was plenty large enough in width,
but because of the large size (height) of the extra window, there was no way
the window could be installed as suggested by Mr[redacted]The first time Mr
[redacted] informed me of his company's
return policy for special order items was when I contacted Mr[redacted] to the
fact that his suggestion about framing this extra panel could not be
accomplished, and also let him know my order was a window short
As for all items purchased from Mr[redacted] not being Certified for the Southern
Region, this does not refer to the Texas Windstorm rating but refers to their Energy Star
ratingThe windows and doors sold to me by Mr[redacted] were all certified North
West and North CentralThe difference between what Mr[redacted] delivered to me
and those windows and doors any other supplier in this area would have made sure I received is that windows and
doors certified for the North West and North Central are constructed to capture
and hold radiant heat inside a house where as windows and doors certified for the
South region are designed to reflect and prevent radiant heat from entering a

I'm not a contractor, but a homeowner who went to a business owner for
advice and help in ordering products that met regional, state, and best construction practices, but because of Mr [redacted]'s lack of; what ever his problem is, I'm now stuck with windows and doors that exempt me from any
Energy Star rebates and with nothing to look forward to but the enormous cost
to replace everything purchased from Mr [redacted] or years of outrages energy
bills

Review proper cancellation procedures with the consumer numerous times. Currently the consumer has an outstanding balance due to not correctly canceling his membership. All this policies concerning cancellation are in the consumers contract. The consumer is refusing to pay his final balance so his...

membership can be cancelled.
