[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the response. If no reason is received your complaint will be closed Administratively Resolved]
 Complaint: [redacted]
I am rejecting this response because:
1. The response provided by Mr. Pettit is false. We never had any discussion of a business license. We assumed based on the contract and his business card that he held a class A license, was bonded and insured. There was no discussion of judgment against him with UVA until he had to miss a Monday 2 months into the job. He told us we didn’t need any permits because we were removing any load barring walls, and only moving some electrical around. We didn’t learn that we needed permits until his employee responsible for the electrical went “missing” and we brought in an electrician that told us we absolutely needed an electrical permit and was had been done thus far would not pass inspection. I have attached a quote provided to us from an outside contractor that describes the problems left to us by Mr. Pettit in greater detail.
2. We were given the name of the countertop guy from a family member and requested a quote from him (Mr. Wes Cooper). He called on a Saturday with a quote of $4500 and said he could install the following Wednesday. I called Rick and he said it was $800 more than [redacted] but because of the turnaround time to go ahead and do it. It was then that we called Wes and made arrangements for him to come and measure. Rick called me the following Monday and said Lowes had called him and said they were running a special and good do it for $1800. I had already told Wes 2 days earlier to go ahead and order the materials, per Rick. At no point was there a discussion about it being the incorrect color. I have attached copies of our communication via text that proves that Rick agreed to pay Wes for the countertops.
3. I don’t want the microwave cabinet. I want the money spent on the microwave cabinet. Regarding the dishwasher, I came home and discovered a base cabinet had been installed where the dishwasher was supposed to be placed. When asked about it, Rick said that we had never discussed a dishwasher. After discussing that the dishwasher needed to go there, Rick said “well now you have an extra cabinet”. The dishwasher cabinet constructed onsite was constructed from the materials that were to be used around the refrigerator, resulting in missing a left cabinet for the refrigerator.
4. Regarding Rick’s health and wellbeing, we were very understanding of his health issues, his mother’s health issues, his uncle’s health issues, his crew’s health issues, his auto accident and his multiple vehicle issues. Our concerns multiplied when the project took 5 weeks longer than originally discussed and his hours of work on the days he did show up became shorter. At no point did Rick or his crew work longer than 6 hours a day. Most days they arrived between 10:30 and 11am and left by 3:30pm.
Rick agreed to take on the job knowing how far he would have to travel. Gas and auto repairs are his responsibility. Though we have requested proof of Rick’s financials multiple times, we still have not received a copy. We shared with Rick our disappointment with the floor installation, damage to the bottom of the base cabinets, and that his plumber had installed a broken shut-off valve that had been repaired with silicon. It was then that we told Rick that we did not want him to continue. I explained that we still wanted to see the financials and he said that he could bring them on Wednesday. Wednesday, I received a text from Rick (attached) saying that he needed more time and that he could come on Friday. Thursday, evening at 5:33pm, I asked Rick if we should be expecting him the following day. He replied saying he mailed the check to the countertop guy and the address he sent it to. He then went on to explain that his uncle was in the hospital and provided his name and room number. 4/8/16 I sent a text asking if we could schedule a time the following week to meet. I also asked him to verify that he mailed the payment to the countertop guy on 4/1/16. 4/9/16 he replied that he was still at the hospital with his uncle and the check went out on Monday (4/4/16). I asked again if he would meet us Monday 4/11/16 at 2pm. He said that he would be in touch once he knew what was going to happen with his uncle. That was the last contact we had. I sent Rick a text on 4/12/16, 4/25/16, 4/26/16, 4/28/16, 5/2/16, 5/4/16 and 5/5/16. We have not heard back from him at all.
5. It looks like portions of the contract are crossed out. Our version does not have these financial sections crossed out.
Regards,
[redacted]
