In order to reply to your request for a refund of $that you believe is due, please bear with me as I explain how Hosoi Life Plan and Hosoi Garden Mortuary function and the relationship of the two separate companies Hosoi Life Plan is a wholly-owned subsidiary of Hosoi Garden Mortuary Hosoi Life Plan sells price guaranteed prearranged funeral service contracts for future funeral services at prices prevailing at the time the contracts are signed Of the payments received on a Hosoi Life Plan contract, the first 30% is retained by Hosoi Life Plan to cover its operational costs related to the acquisition of new funeral service contracts (for instance, for the sales counselor's commission, printing of payment coupons, maintenance of contract files and payments) and is non-refundable, and the remaining 70% is placed into a trust account to be paid to Hosoi Garden Mortuary when the Hosoi Life Plan contract is serviced (when the purchaser passes away), as required by State law This is explained to the purchaser by the Hosoi Life Plan sales counselor and is documented in two forms (among others) that were completed and signed at the time of purchase of the Hosoi Life Plan: the "Pre-need Funeral Service Contract" and the "Pre-Need Contract Disclosures" The "Pre-need Funeral Service Contract" details the service and merchandise purchased (Part 1), the payment terms of the contract (Part 2) and the terms and conditions of the contract (Part 3) Part of the Hosoi Life Plan Sales Contract states under item "7.Trust" that "The first 30% of the Contract Price will be retained by us (Hosoi Life Plan) for payment of our acquisition costs The balance of seventy percent (70%) of the Contract Price shall be deposited in trust." Specifically, in your friend's case, the Hosoi Life Plan was purchased for $2, The 30% of the Contract Price plus general excise tax and the 70% of the Contract Price was calculated as follows: 30% of $2,(the Contract Price) is $+ $GET on the 30% = $ which is retained by Hosoi Life Plan for acquisition costs 70% of $2,(the Contract Price) = $1,which is placed in trust for future use Total Purchase Price (amount paid) = $2, The "Pre-Need Contract Disclosures" summarizes in plain language the terms of the Hosoi Life Plan and how it affects the purchaser and states under item "3.c." that "The first 30% of the contract price and GET is our (Hosoi Life Plan) acquisition costs and is not refundable." As detailed above, the disputed amount of $which you desire to be refunded is the first 30% of the Contract Price plus GET and is retained by Hosoi Life Plan for payment of the acquisition costs of Hosoi Life Plan and is not an overcharge It is not refundable as stated in Part of the "Pre-need Funeral Service Contract" and in the "Pre-Need Contract Disclosures" which were signed or initialed by the contract buyer as acknowledgement that he was informed at the time of purchase of the Hosoi Life Plan When your friend passed away, the service and merchandise purchased in the Hosoi Life Plan were provided by Hosoi Garden Mortuary for which the mortuary will receive the remaining 70% of the total Contract Price held in trust ($1,487.50) and will collect the remaining general excise tax ($70.09) on the $1, The "Statement of Funeral Goods and Services Selected" prepared by Hosoi Garden Mortuary is the final bill to the customer, and references the amount which Hosoi Garden Mortuary will receive from the Hosoi Life Plan trust ($1,487.50) on the line notated "Hosoi Life Plan" and the amount of general excise tax ($70.09) that Hosoi Garden Mortuary will collect from the customer on the line "General Excise Tax on HLP" If there were a refund due, then the "Statement of Funeral Goods and Services Selected" will show the amount of the refund due and Hosoi Garden Mortuary would then issue a reimbursement check In your friend's case, the final "Statement of Funeral Goods and Services Selected" showed that there was a zero balance and was therefore stamped "Paid", and there is no overpayment to be refunded Although the final "Statement of Goods and Services Selected" from Hosoi Garden Mortuary does not specifically use the words "contract or trust", it does refer to the Hosoi Life Plan in two places notated "Hosoi Life Plan" and "General Excise Tax on HLP" with the corresponding amounts In addition, the service and merchandise purchased in the Hosoi Life Plan and provided by Hosoi Garden Mortuary are indicated by "HLP" If further reference to the Hosoi Life Plan contract or to the trust is needed on the Hosoi Garden Mortuary "Statement of Funeral Goods and Services Selected", then we will certainly evaluate whether revising the format of our final statement is in the interest of better customer undertanding of the final bill
