The A- rating for this dealership is entirely WRONG!!! BUYER BEWARE!! This dealership is very shady and very unprofessional! The Owner Carlos wrote my information incorrect while doing our business to the Loan. Which made the whole process slower. He even contacted a third party on how to fill out the bank loan application. I had to personally speak to the Bank loan to rectify his mistakes. Also the vehicle kept breaking down the first month of ownership, to where my wife and I had to spend our own money to get it fixed because the 30 day of sale elapsed on return. DO NOT do any business with this place!!!

Dealer refused to honor the 30 day Limited Use Vehicle Warranty for a car I purchased.I purchased a used vehicle in full from CHC Auto Sales on 6/20/15. Within a few days, it started to break down - it started to brake strangely and made very loud banging noises. The axle brackets sheered off, which is a known manufacturer's defect. We qualify for the Limited Use Vehicle Warranty under item C. We turned the car in for repairs to the dealer on July 20th (that was the date they scheduled us for, we'd called the week prior), and after inspecting the car, the dealer refused to perform the repair saying that we caused the damage through abuse / negligence. However, the issue is due to a known manufacturer's defect and not through abuse - we barely drove it after we purchased it for a number of reasons. I'm not sure exactly what kind of abuse we would have to do to cause the damage of that extent, either, but I do know that we were very gentle with the vehicle.We paid in full on 6/20/15, $5075 in debit card and a trade in worth $1113.Desired SettlementWe would like a full refund because the dealer has refused to perform repairs.Business Response Contact Name and Title: [redacted] /MANAGERContact Phone: XXX-XXX-XXXXContact Email: [redacted]@outlook.comThe customer is wrong. It is truth that the car is/was under warranty when it broke down. We brought the car to our mechanic, the same one that worked on the REGULAR FIRST TIME MAINTENANCE once the car is bought at the auction. He knows perfectly the way the car was working and how it looked before it was sold to the customer [redacted]. The mechanic called us at CHC AUTO SALES and showed how the car has been used/abused to a point where He took pictures and showed us how the car was not like that. Even so this happened; we are accepting responsibilities for other minor reported problems that are been fixed under the warranty.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)When I asked to see photos as proof (photos even the manager says they have in the response) the owner of CHC said he did not have any to show me. In addition, I asked for proof that the damage was caused by abuse/neglect, and he was unable to provide proof. Mechanic hearsay is not proof. Neither is an accusation. The burden of proof, per Massachusetts law, is on the dealer and not the customer. The dealer can say "the customer is wrong" all they want, but that does not make it so. I have done extensive research - including calling dealerships and other mechanics - to find out if the axle brackets sheering off could possibly have been caused by neglect and the responses were a resounding "no."CHC failed to provide me with any receipts or documentation regarding the car and repairs made to it. I was not given a receipt upon delivery of the car to them for repairs, nor was I ever given a breakdown of repairs or changes made to the car. There was also no documentation provided to me about the miles added to the car during the time we had surrendered the car for repairs. The only reason I have a receipt for the $100 deductible I paid is because I gained it through the mechanic, not the dealer.CHC claimed that this car was CPO - certified pre-owned - but never provided documentation on that when I requested it.Additionally, after reviewing the sale paperwork, CHC neglected to document the trade-in value of the car I traded into them.The vehicle was out of service for 14 business days - well over the 10 business day limit stated within the law. During repairs, the mechanic found at least one other safety / use issue - 3 out of 4 of the brake lines had rotted.Because the car was out of service for 14 business days, over the 10 days allowed by state law, we qualify for and officially request that the dealer buy back the vehicle. Please see http://www.mass.gov/ocabr/docs/dealer-guide-brochure.pdf page 8.Final Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)My complaint is this:1) You are unable to show proof that the issues/damage were caused by neglect or abuse. You need to provide proof, not just "the mechanic said so." As the Mass.gov handbook for dealers states:"You should be prepared to prove that negligence, vandalism, accident, unauthorized repair or modification caused the problem, if you allege that this is the case. Simply stating that one of the above reasons caused the problem will not be enough for arbitration or a court challenge."2) Part of the issues with the car that needed to be fixed by you, the dealer, were rotted brake lines. The brake line issue was NOT caught by either the CPO inspection (which I still have no documentation of) nor by your first mechanic. Rotted brake lines are a use and safety issue and NOT POSSIBLY caused by abuse or neglect.3) The vehicle was out of service for over 14 days - PER MASS LAW, the maximum is 10 days and so I am entitled to a full buy-back from you, the dealer. I requested the buyback twice, now. If I have to request it again, I will have to pursue mediation or arbitration.Final Business Response We, at CHC AUTO SALES, do not understand the reason for this complaint. It is truth that the car had certain issues/problems, it is also truth that our mechanic said most of the problems were caused by negligence driving and abused of the vehicle by the customer. However, we at CHC AUTO SALES took responsibility for fixing this vehicle. The vehicle has been repaired and returned to the customer way over a week now. Vehicle is fixed, customer has it. So, what is the complaint about ? We at CHC AUTO SALES paid for the vehicle to be repaired.
