Mr*** continues to lie I have attached emails to show he lied/lies....In one of the emails he writes saying he "never" finished the glass of wine, but now on his response he admits he did He says he only tasted the beer, but the truth is per my mom and brother that saw him, he had the entire beer He says he drank while he finished the inspection, another lie, he drank while he was in process of the asbestos inspectionHe has stated to Park Newport's attorney that he was not aware the unit had asbestos, another lie, if you see the emails from him to me right after he did the asbestos inspection, he states he is fully aware the unit having asbestos because of the age of the unitHe says and uses the word "bulk sample" I never used that wording, that is wording used by people in his business What I asked for was to have the air sampled for possible asbestos, since the lady next door had her unit repaired where removal of the popcorn ceiling took place, and workers on her unit mentioned the asbestos/mold problems in the unit and many unitsMy mom told him too the reason to why I wanted the asbestos inspections done He says that if he would have known about the forms Park Newport gives to their tenants that he would have never cut off pieces, another lie, because he stated to my mom and in his several emails that he was aware of asbestos being present because of the age of the buildingI hired who I thought was an expert and paid for a full report to see if asbestos was present in the air, and he chose to cut off pieces that now Park Newport is saying that I have vandalized their unit charging me over $18, Mr*** states that he felt just scraping the ceiling to get the samples would have not been enough from the apartment unit, but he was able to get samples by just scraping off from the ceiling of the outside of the apartment from the Halls of the first floor and 2nd floorPictures attached Also, a few days ago I was referred by Wonda at AIHA.Org to Advanced Environmental Group, who are Asbestos experts, and Lev Machellian stated that air samples for Asbestos can be done without cutting off pieces, and when dealing with popcorn ceiling that the area that is going to get scraped off needs to get wet in order to not release asbestos fibers, and that as small as one inch is enough to find out if it has asbestos or not Lev also said that in order for someone to call themselves Asbestos Experts, thee person must be certified as a Certified Asbestos Consultant or as an On Site Certified Surveilliance Technitian and that normally those who hold these certifications are registered with Cal/Osha as being certified as Asbestos Certified InspectorsI checked with Cal/Osha and Check for Mold.com nor Mr*** *** are not registered Makes me wonder if he is Asbestos Certified If he is not Asbestos Certified, could be the primary reason he did not know how to do a simple Asbestos Air test but chose to cut pieces off the ceiling inside the unit, but chose to only scrape pieces off the outside the common area of the Building Halls Mr*** says that I only want to collect my deposit back, That is incorrect, I have been asking for the $deposit that has been withheld from Park Newport from him, because his actions are the reason to why my deposit is being withheld, but I am not saying that is all I want, I was under the impression, that he was trying to work out on when to fix/repair the holes me made on the ceiling and thought it was just a matter of when he had a chance to talk to Park Newport's Attorney as he clearly states it in one of his emails that he had not heard back from their attorney Which is another lie, he had been talking to the attorney, and his insurance had to, but he never let me knowHe made me believe he was waiting to hear back from the attorney But I found out he has been trying to put the blame on me after I told him I would file a lawsuit against him, only until then didi I find out he was trying to work it out with Park Newport's attorney, with his insurance and his attorneyI kept asking what was the reason Park Newport was not allowing to have him make the repairs since Mr*** has stated he can make the repairs for or dollar, as I have asked his attorney, but I was not provided the reason I found out the reason by reading Mr***'s reply to my Revdex.com Complaint. I want Mr*** to pay me the full amount Park Newport is charging me for the cuts he made *** ***

I hired and paid for an asbestos inspection and report and *** the Inspector of Check For Mold.com,Inccut in two different areas the ceiling to do the testI was not present when he did the test and I had my mom do be there while he was doing the asbestos testingAfter I moved out, Park Newport the apartment management is charging me $18,for the holes in the ceiling the Inspector did My mom says that the Inspector was drinking with her wine as well he was also drinking beerBecause of him cutting the pieces off the ceiling my deposit of $is being withheld by Park Newport I should not be held liable for anythingThe inspector is now making lies that he asked my mom for certain forms, and that my mom told him that Park Newport was aware of the testing being done That is a lieThe inspector was never told that Park Newport knew I wanted an asbestos testing doneThe reason I did not let Park Newport know is because Park Newport did not want to address the mold issu

Mr*** *** did retain our services to perform sample collection for asbestos analysis in his apartmentI did make two cuts in his ceiling, which were analyzed for asbestos, and did come back positive for asbestosBecause Park Newport, the management company leasing the Subject Property to
Mr***, needed to repair the cuts made, they are claiming $18,in damages because they needed to perform full-scale asbestos abatement. When I spoke with Park Newport's lawyer, they asked why I cut into a ceiling which had asbestosI told them that I was unaware of the presence of asbestos, and they said that the tenant (my client/ Mr***) would have received paperwork from Park Newport, which stated that the property did contain building materials, which contained asbestosThis would be known as an asbestos addendumThe property manager's attorney informed me that all tenants receive this paperwork as part of their lease agreement. As such, they are wondering why asbestos testing was done if the paperwork was receivedMr*** is saying that he did not receive said paperwork/ addendum with his lease agreementThat may be true, I don't know what was given to him or not given to himI was told by the property managers attorney that Mr*** should have the asbestos addendum in hand. As it is right now, I have contacted my insurance company, and they are investigating the situation, and will be making a determination as to wether or not they are going to pay out any monies for the repair work within Mr***'s unitI have also retained legal counsel, and was instructed to not pay for Mr***'s security deposit ($2,700) because my insurance might pay for itI am simply waiting to hear from my insurance and legal counsel to move forward. I have explained all of this to Mr***, and told him to be patient and simply let the process play out, but he seems unwilling to do so. As far as his allegations of me lying, I can only say that there has been much miscommunication, and much lost in translationWhen Mr*** asked me to collect bulk samples for asbestos analysis I collected a total of four samples at $per sampleThe amount was simply for the analysis of the samples by a qualified laboratory, and a lab report stating the presence or absence of asbestos in the sampled materials. I have attached a copy of the receipt, which is from two-copy NCR paper, Mr***, should have the other copyI have also attached a copy of the lab report for the asbestos analysisI am certain that Mr*** was thinking that there would be a full written report for the asbestos sample collectionThis was a misunderstanding on his part, and possible lack of explanation on my part.When we collect samples, and that is all we do, we are simply submitting said samples to the lab, and providing the client with a lab reportThis would be true with asbestos sample collection or mold sample collectionOnly when we conduct a full inspection of a property, will we provide a full inspection reportWhen I visited the property to conduct the asbestos sample collection I collected four samples, and did no formal inspection. Mr*** mentions that I drank with his mother who was presentAfter I conducted the sample collection and was finishing up paperwork with his mother, she offered me a glass of wineI did accept, and I did finish said glassThis was after the sample collection was conducted, and not duringNot that it is an excuse, but it was a Sunday, and I had no other inspections or jobs to get toHindsight is 20/20, and I regret accepting his mother's invitation for a drinkMr*** also mentions that I had a beerI had a few sips of a beer, but did not finish because I was done with my work there, and I had to drive out to Westwood (UCLA) as my father was in the hospital at Ronald Reagan Hospital for much of the month of July. In summary, I have taken the necessary legal/ liability steps to rectify the issue with Mr***'s property management company, and am just waiting on the processI in no way, have tried to shirk my responsibility, or harm Mr***, again, I believe he simply wants his deposit back from his property managerI have asked Mr*** for his patience, but he seems unwilling to obligePlease let me know if you have any further questions. Good Morning,   After reading the additional complaint I don't even know where to begin. As stated yesterday over the phone I was hired by Mr. [redacted] to conduct a mold inspection, and testing, and to collect samples for asbestos from the popcorn ceiling in his unit, and the hallway outside his unit. Mr. [redacted] is of the understanding that I am lying, and that I was withholding information from him, or not being honest about my interaction with Park Newport's attorney, and Park Newport itself....This is not the case, I made several phone calls to them, and was only contacted by their attorney and spoke with their attorney one time over the phone.   I was never asked to collect air samples for asbestos, this is new info to me. They were specifically concerned about the potential for asbestos in the ceiling. I think he may be misunderstanding or things are getting lost in translation. I probably said that based on the age of the building, asbestos content in the popcorn acoustic was likely, but I never said that I knew for certain that it was present, I thought that was why he wanted the samples collected?   At the end of the day, I charged him $50 per sample for the four samples I collected. I submitted those samples to an independent lab for analysis, and gave him the lab's report detailing the analysis of the samples collected. Nothing more, nothing less. I do not perform post asbestos abatement clearance testing, I only collect asbestos samples (bulk samples) from time to time as clients ask. I am aware of the proper way to collect said samples by wetting the area to be sampled, and did so in Mr. [redacted]'s unit. I made the cuts that I made, knowing that they would be easy fixes, and offered to have the repairs done after I was made aware that Park Newport was asking Mr. [redacted] for the money to do the repairs.   I filed a claim with my insurance and my insurance said that they were not going to pay for the repairs because the amount of money seemed a bit extreme for the area needing the repair. I contacted an attorney who specializes in insurance claims, and they were trying to work with my insurance to get the money paid. I also contacted another attorney to respond to Park Newport, and after looking up the complaint in the OC superior court I was told that I or my company was not named on the complaint so not to do anything at this point in time.   As things stand today, I am waiting to hear back from Park Newport, or their attorney, and have been advised not to pay Mr. [redacted] any money as the issue is between him and Park Newport. Worst case scenario I was told by my attorney that if I am deemed responsible for any damages I will be counter sued, and at that point in time I will have to pay whatever is required.   I am not a dishonest person, and have been in business for a long time. I have never had a complaint filed against me until this one, and have excellent customer reviews on Yelp. I did not take advantage of Mr. [redacted] or not perform the work that I was hired to perform. If I made a mistake in doing what I did, that is what it was, an honest mistake. I understand Mr. [redacted]'s frustration, however, I did not take advantage of him, and wish no harm to him.   The whole situation is a mess because of miscommunication and misunderstanding. Now that there are attorneys involved, and very little communication between myself and Park Newport...I have not spoken with their attorney in a couple of months, and event then it was only one time on the phone. I left several messages with Park Newport and their attorney only to be given one return phone call in response.   I feel like I have done everything that I can do at this point, and am simply waiting for everything to play out. Until that time I cannot really do anything more. I explained to Mr. [redacted] that I don't have money to pay him what they are asking for. They (Park Newport) is aware that I don't have money to pay for the repairs made. I am an honest small business owner who always tries to do right by his clients, and have honestly never encountered a situation like this.   Let me know if you need any other info.
