Initial Business Response /* (1000, 12, 2015/10/01) */
AW Leil has been in business in Atlantic Canada for nearly 60 Years and have sold dozens of crane to many parts of the world over the course of our years in business and have not received any complaints that I am aware of other than the...

complaint associated with this letter. AWL sold this crane in [redacted] of [redacted] and made numerous attempts to have the crane shipped as per Mr [redacted] request -- or his freight broker -- Ms. [redacted].
This crane was advertised on the internet and Mr [redacted] purchased the crane sight unseen and wire transferred the money 2-3 business days after the invoice of sale was provided. This crane was in good working condition when we sold it and subsequently when we dismantled it and delivered it to the [redacted] of [redacted]. Our terms of sale were FOB [redacted] of [redacted] -- which we honored 100% and then some. It had taken over 1 year for Mr [redacted] to have the crane removed from the [redacted] of [redacted].
It is important to understand that this crane consists of approximately 20-22 tractor trailer loads of crane
components over and above the actual crane carrier. This is not a small piece of equipment -- please
reference the technical data sheet associated with the crane and a picture for your reference. Mr [redacted] had a broker hired to ship this crane -- [redacted]. AW Leil spent tens of thousands of dollars over and above what was required to deliver components to the [redacted] of [redacted] only to have to return these crane parts to our yard in [redacted] and re handle to unload / reload same parts. It became obvious that both [redacted] and Mr. [redacted] did not realize or understand what they had purchased. At one point -- they asked that I assemble the crane 100% complete and drive it on the boat. This is technically impossible as the crane has in excess of 400' boom and jib combined. It was at this point that I stressed the importance of both of them making a visit to my office so I could show them the crane and its components so they could understand what was required to ship the crane. They were both shocked when they seen the amount of loads that were required to be shipped. I spent a couple of days taking these folks around town -- answering their questions and suggesting carriers to get competitive pricing to ship the crane to [redacted].
It became evident that Mr. [redacted] had underestimated (or did not consider) the costs to ship this crane to [redacted].
At some point during the 12 months of this circus, I received a call from Mr. [redacted] explaining that [redacted] had disappeared with his money and that he could not ship the crane and wanted me to purchase the crane back from him. I politely explained that we were not interested in purchasing the crane back from him and also put him in touch with some other people that expressed interest in the crane after Mr. [redacted] had purchased it from AWL. I do not know if he followed up with any of these folks.
I have printed the entire series of emails that pertain to this crane as I stopped taking phone calls and asked that all correspondence be via email so I could track the conversations.
It is important to understand the terms of the sale -- FOB [redacted] of [redacted] means the crane will be delivered Freight on Board ( truck ) to the [redacted] of [redacted]. As you can see on the invoice -- there is no warranty applicable -- implied or otherwise. This crane served us well for decades and was in good working order when it left the [redacted]. This crane is nearly 40 years old and is highly specialized and heavy. According to Mr [redacted] -- the crane is in the [redacted] of [redacted] broken down. What happened between [redacted] and [redacted] is not my concern- Mr. [redacted] does not seem to understand the terms of the sale.
In Summary, Mr. [redacted] made a purchase without doing his homework on what he was buying. AWL honored its commitment over and above our obligations. We have been storing boom sections for this crane in our small yard in [redacted] for well over a year now -- I will be sending Mr. [redacted] a Letter notifying him of storage charges moving forward effective [redacted]th at a cost of $[redacted] / month until such time he can make arrangements to have the boom removed. We will load the boom sections on trucks supplied by Mr. [redacted] in our yard (address below) at no charge as per our initial agreement.

Initial Consumer Rebuttal /* (3000, 14, 2015/10/01) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I honestly never underestimate the size of the crane because I hired a carrier and in the storage we talked that we would take a few months to get it out of your yard but charge more knowing that the crane although it was not your fault failure and it can not stand by but it is reasonable to help me not charging the storage as well there is a contract stipulating that. ask your help to tease out the boom of your yard but you know that the crane never left the port was always there, I hope access and sell the crane I never asked them that though I received a letter in which a person me He says that you told him that I sold the boom and have printed
