Complaint: [redacted] I am rejecting this response because: I can legally provide written correspondence that states my concerns regarding the drainage and erosions issues were of grave concernthose dated emails being 5/12, 6/16, 7/31, 8/I can provide related photos of the failed grade and the subsequent erosion problem and failed repairs, which in fact they created via the construction, which I can also proveI was never informed by the homebuilders during those multiple emails that erosions would/or could potentially occurThey knew that the erosion was a concern because I required day extension from closing to cover such problems and they never fixed those problems efficientlyI can also provide testimony from my lending agent that they even tried to intervene and were told "it is being handled and to stay out of the issue"I can also provide testimony from the neighbor to the residence whom also deals with erosion issues d/t their negligence in improper gradingThey can also attest that the re-grade was never actually redoneIn fact the company in question only laid the sod not as a courtesy but to try an stabilize the erosion they knowingly attempted to cover up

In response to Mr [redacted] complaint regarding his displeasure with the grade and landscaped area around the west sided terrain slope of his acreage, Kaden Homes has provided proper and sufficient documentation, representation, and installation with regards to his home.? We also provided more than what was contractually required, to which I will provide later.? As with all of our new construction builds, a final grade is achieved towards the end of the construction process to promote water runoff around and away from the home structure.? Further, a thin topcoat of sand mix is dressed on the top of this final grade to prepare it for the installation of the sod.? This was the exact case for this property.? However, after this was completed, natural acts outside of our control, a rainstorm, had washed off the thin layer off the sand mix from the sloped hillside on the west of the property.? Upon installation of the sod, our landscapers hand raked the silted in swale line to redistribute the eroded sand upon the already established grade of the land below, and completed laying the sod on top.? A few days prior to the customer closing on this home (10/13/17), the area received another thunderstorm, causing a 5xarea of sand to erode downhill and settle within the swale.? Within two weeks of Mr [redacted] closing on the home, our landscaper redistributed as much of the eroded sand back into the eroded sink hole on the hillside and installed new sod to this area.? At the same time frame, we also installed a shallow French drain from the middle of the swale at the foot of the hillside to the front slope of the culvert near the street to help the swale dissipate moisture.? On 11/8/17, another rain event took place.? As the root growth of the sod repair had two weeks versus two days to establish, the erosion of the underlying soils on this hill side was about 1/the amount as before and the swale did not have any standing water hours after the rain ceased.? The deeper the roots can grow from any newly laid sod, the better the grass will be at aiding the below soils in stability and minimize erosion.? We explained this to Mr [redacted] and also explained that we cannot control acts of nature and do not cover erosion after closing.? He was aware of this from when he closed on the home as he signed several forms that covers the policy on erosion.? To go even further, the sod and sprinklers were to be installed in the front yard, the side yards 20’ from the home, and the rear yard 40’ from the home, as this was the total from our basic landscape package and the additional amount that Mr [redacted] paid for.? This would have ended the sod at the bottom of the west hillside, feet short of the edge of the side property without any vegetation covering the hillside soils.? Because of this, Kaden Homes added additional sprinklers and sod to cover and finish square feet, so that the remaining side area now had sod and sprinkler coverage up to the neighboring property and to the top of the hill to help minimize erosion of the top soils and to preserve the underlying grade below the sand mix.? From experience, had this not been done, the rain events would have caused an exponential amount of erosion in comparison to what actually occurred on this hillside.? Again as I stated at the top, Kaden Homes went beyond our scope of what was required by not only adding additional sod and sprinklers to Mr [redacted] property at no cost to him, but by also repairing the erosion that occurred after closing as a onetime good faith measure on our dime, though not required or covered under warranties.? Should further signed documentation be required, photos of the said areas of concern, or contractual documentation be needed please let me know, as we have already presented this information to Mr [redacted] in a meeting with him, our executive team, and the owner of the landscaping company.? Based on the warranties and warranties that Mr [redacted] signed, and the landscaping precedence set forth by the TRCC, erosion is not a warrantable and coverable item

We spoke with Mr*** in late February, and scheduled *** *** *** *** *** to complete the plumbing and texture repairsNCT completed their appointment with Mr*** on Wednesday 3/4/and S&M Drywall completed their appointment on Monday 3/9/The remaining repairs with
Mr*** were to be scheduled with our painter after the texture repairs were completedOn Tuesday, 3/10/we attempted to contact Mr*** on the cell phone number he provided to us (###-###-####)He did not answer and we left a message on his voicemailWe have yet to hear back from Mr***After receiving this Revdex.com inquiry from Mr***, we again left another message at the same number on Wednesday 4/23/15, and again have yet to hear back from himWe look forward to setting up our painter to complete his warranty concerns, but cannot complete this process until we can confirm an appointment date with Mr***We will await his response to our left messagesHe is welcome to contact me directly at my cell number, ###-###-####, to expedite this process

Not at the rear of our property! The only drainage meeting we had was with Cheldan homes employee,*** ***Cheldan homes and *** *** believed we should trust them that they could get water to drain uphillWe did not agree to thatThus the only option they presented to us was negligible at bestThe next idea presented from Cheldan was cut a ditch 60ft from our back doorThat option was an immiediant no, Cheldan homes tried this option on the street to the east of our homeIt was a disgraceful failureNow they just have a deeper flooded area. Cheldan homes has not discussed anything with any of the homeowners impacted as of 10/26/It has actually been quite the opposite from Cheldan homes*** *** will not answer his phone or return text messages at this pointSo that's zero communicationNothing being discussed. What's so disheartening about Cheldan homes is the fact that if they would have simply said we would very rarely be able to use the majority of our propertyWe would have never built a home with Cheldan.

All the way to the rear property line, and flooding on both sides of the house. Then the water remains stagnat for several weeks further excluding us from our property. I can provide 51 related photos of the failed grade and the subsequent erosion problem and failed repairs, which in fact they created via the construction, which I can also prove. I was never informed by the homebuilders during those multiple emails that erosions would/or could potentially occur. They knew that the erosion was a concern because I required 30 day extension from closing to cover such problems and they never fixed those problems efficiently. I can also provide testimony from my lending agent that they even tried to intervene and were told "it is being handled and to stay out of the issue". I can also provide testimony from the neighbor to the residence whom also deals with erosion issues d/t their negligence in improper grading. They can also attest that the re-grade was never actually redone. Good Morning,   I apologize for the delay in response due to the storms yesterday we just now got power. Please see the response below and the attached documents.     ·         Post-tension cables - On Thursday, 2/11/16, a Cheldan representative met with Mr. [redacted] and ensured all exposed post tension cable ends were fully sealed around the perimeter edge of his exposed foundation.  Photo evidence is attached.   ·         Hole in roof - On 12/18/15 two members of Mid-Cities Construction and a Cheldan representative met with Mr. [redacted] to install a 2x6 brace for added strength underneath a short OSB tongue and groove decking seam that had minor non-load bearing damage.  On 12/24/15, Jimmy Prescher Roofing and a Cheldan representative met with Mr. [redacted] to strengthen the securement of the blocking brace and Prescher Roofing replaced the roofing felt and shingles over this small area of the roof.  Photo evidence is attached.   ·         Cabinets - Cheldan Homes has repaired all necessary warrantable issues and further corrected many more concerns with the cabinets that were deemed as not-warrantable.  In addition to several meetings between a Cheldan representative and Mr. [redacted] involving his cabinets, [redacted] has also met with him and completed work requests on 11/5/14, 11/17/14, 12/1/14, 12/8/14, 12/18/14, 6/3/15, 7/6/15, and 11/10/15.  Evidence of their visits to address the customer’s issues is attached.
