I signed 3 contracts with them. One was for a roof for my house, shop and garage. The second contract was for an awning. The third contract was for a deck on back of my house. The wanted a down payment for the 3 contracts. The down payment was $12000. They were suppose to start the job the next day. That never happened. In the contract, they had starting clause of no longer than 14 days. The contract was signed on January 10, 2020. Work was to commence no later than January 24th. I called them several times. After 4 weeks, they came out and dug 4 post holes for the the awning posts. Then after several calls, they came back out a week later and filled the holes with 4 bags of concrete. Then I kept contacting them after that, and wanted to know when they will come back to finish the work. I spoke with him on February 26th, and he told me that he will be out in a bit to do the work. He never showed. He gave me several excuses. Then when I had to go to the Post Office, he showed and went into my shed and took his tools, the materials for the job and his trailer. He contacted me last week and said he was going to refund my money, but it will not be until this Monday. He never reached out to me. I have not heard from him since.
Contracts were signed on Jan. 10th 2020, I was suppose to start work on 1-24-2020, on 1-22-2020 my wife and daughter were in a terrible car accident, when I reached out to homeowner, I told him what happened, and he responded with " that's a bad excuse" not a good reason to not be at his house working. The homeowner was trying to get myself to commit insurance fraud. When I told him I would not do that. On 2-26-2020 the same day, hours later, he posted on social media that I was a thief and has cost me jobs. That I have proof of. All 3 contracts are good until end of April. Homeowner breached contracts by firing my company, there was nothing that belonged to homeowner that was removed from his property. Never told homeowner he wasn't going to be refunded, he turned to social media to ruin my business, posting on several different web pages. Costing my company potential jobs. Ruining my company name.

I am rejecting this response because: On 1 -14-2020 *** texted me stating he was having the Lumber for shop addition delivered the following morning. No lumber for the shop addition was ever delivered. *** was informed of this on 1-15-2020 and claimed he cancelled the order because Meeks did not have enough post to complete the job and he did not want to have to pay a 2nd delivery charge. We later discovered this was false and no order was evar placed.On numerous occasions we inquired abour ***s wife. On On Wed 1-29-2020 we actually have text messages from *** aka *** stating "his wife had been moved to another hospital and he will have his Dad *** /partner bring the guys out and get them lined out on what needs to be done". He also said Thanks for your patience". This was already 5 days past the starting date of 1-24-2014 and 19 days after the signing of the contract. I might add his father never showed up with the Guys and no materials were ever delivered. These excuses and stall tactics continued until Weds. 2-26-2020. On that morning at 7:19 *** told us he was "getting the kids of to school then would be over to work" Aprox 3 hours later at 10 am. he still did not sho up but texted that he was ".still coming but trying to get a tire fixed for his trailer." At 10:44 *** texted sauing he was on his way out but he never arrived. I finally gave up and had to go to the post office at 12:44 pm. I passed *** and another white pick op truck I assumed was his help ready to work. Finally. Instead This was the day *** AKA *** came while I was gone and took all his tools, some of my tools and both trailers. One trailer was stocked with material he claimed we for our job. It toook me about 10 minutes at the post office. They went inside my shop, loaded all Cherokee's tools and some of mine and I passed them leaving with 2 trucks and trailers on my way back from the post ofice. This was on 2-26-2020 aprox 1 1/2 months after the contract was signed and over 1 month past when work was to begin.
On another note Cherokee construction was never fired, *** and his father were never fired. They led me to believe they were coming to work and snuck into my shop while I was gone and took their tool and some of mine and left the job. I have phone records and text message that will prove it.
*** and his father stated they were fimiliar with insurance claims and would be happy to assist in recouping as mach of our recoverable deprecation as possible. This is a normal aspect of home owners insurance claims.
I posted ecactly what the contractor did to us. If that resulted in their loss of jobs then they should not cheat and lie to clients.
To date they have not refunded even 1 penny. Although there have been many promises by them that they would issue a refund nothing has been received. At one time they claimed they would issue a refund after they calculated what they owed us after deducting materials, custom cut metal for the roof ect. This turned out be be false. We contacted the Metal supplier Superior Metal and Meeks Lumber company and both companies told us no orders were ever placed. So far Cherokee Cunstruction, *** and *** have failed to issue any refunds.
