I purchased my home December wherein sellers disclosures stated the fireplaces were marked as "working condition"
On January 20th, I had the fireplaces inspected by a local fireplace inspector for safety, so I could use them as planned
The technician/inspector however, stated that a couple months before my appointment their company was also at this property during an appointment conducted by the female Seller Marcia *** and the Realtor Daniel ***, who basically ran the inspector off of the property, after he reported to them that the fireplaces would not pass inspection and they were extremely unsafe and unusable in their current condition
This is attested to by the Fireplace Service Company's technician/inspector and also the owner in charge of dispatching the calls that day
The official inspection report also notes that the technician/inspector informed the Realtor and Seller of the fireplace safety issues and they were "dismissed" accordingly

The Seller is making numerous untrue statements and presenting claims taken wildly out of contextHe claims that *** never produced any showingsThis is perfectly untrue as there were numerous showings that the Seller refused to allow as
he has an odd schedule and would only allow showings at sharply restricted times that did not match the times various Brokers and Buyers wanted to show the propertyEven when he went on vacation for four days, he refused to allow the property to be shownHe said his year old non-handicapped, non-disabled or impaired in any way daughter would be home alone and he could not have showings while his year old daughter was in the home*** even produced an offer that the Seller rejectedHe then changed his mind too late and wanted to accept the Buyer's offer,- however, the Buyer of that offer had moved on to another propertyThe Seller then got angry at *** because she had explained the offer carefully and professionally, counseled him in all aspects of his response, timely carried out all communications and transfer of documents but had the nerve to inform the seller that the Buyer had already found another propertyThis is when the Seller lost control and fired ***Not because she did anything wrong, unprofessional or improper, but because he regretted his rejection of the offer and it was too late nowWhen the Seller fired *** she gave no argument and told him she would mark the listing as expired, allowing him to list with another Broker if he wishedShe did so without delayThe Seller claims that *** listed the property as 'Sold'This is untrue*** never listed the property as 'Sold', the website that automatically pulls the listing from
MLS with the Seller's permission listed the property as 'Sold' by mistake and without ***'s knowledge*** never said the Seller '...wasn't supposed to see that' instead telling the Seller that most Buyers get their information from the MLS and not this one website*** took action to correct this 3rd party error as soon as she was made aware of itThe Seller claims that *** would not release the listing in MLSThis is untrueThe property was re-listed with the other Broker the Seller had been negotiating with behind ***'s back one day prior to the seller making this complaint*** had released the listing in MLS well prior to thatThis Seller claims at one point *** told him that him following through with the threat of an attorney would do him no good in relation to the untrue assertion that she wouldn't release the listingThis is also untrue as *** actually told the Seller no attorney was necessary,- she was happy to release the listing, and, as previously stated, she did without delay, argument or issueThe property has never been 'Held Hostage', *** never threatened to enforce the listing contract even though she had every right to do soIn summary, from time to time we, as real estate brokers have to deal with unreasonable and bombastic people who do cooperate and do not listen to the advice of the professional they've hiredIt is regrettable that this Seller had chosen to sharply restrict showings, not listen to professional advise, make informed but poor decisions and then blame their BrokerThe Seller had everything they demanded prior to writing their complaint to the Revdex.com*** and Cherry Creek Properties apologize for nothing

I have written communication from ***The home had finally been released; however, the claims have been untrueAt this point no further action is necessary but the fact that *** refused open houses and the only outside customers that came were from outside agents just proves how lazy she was in attempting to sellAnd the fact that I did not want to leave my young daughter in charge of the home is none of her business...and the remarks about her medical situation...is outrageous! They have no right at all to assumeThis just shows the lack of professionalismAnd yes...I have emails and text messages to prove my earlier statementsThose people are do not belong in a customer environment!
