[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed as Answered] Complaint: [redacted] I am rejecting this response because:The business repeatedly twists the truth or outright liesOne of the days that they chose not to show up was due to the first day of hunting season, it was a perfectly acceptable day to workOne day, it was well more than degrees and sunnyIt had not recently rained, and no asphalt work was being completed at that timeWhen I called to find out where the company was (my wife was home that day and notified me no one had arrived), we were told they were "packing up to head over" this was at approximately amTwo employees from the company showed up around noonThey were putting the railroad ties in the cutout (which was mostly excavated before this company took on the contract)My wife had a doctor's appointment and left the house with our son at approximately 1:30pmWhen she returned at 3pm, the employees and their truck were both goneThey had put in place exactly four (4) railroad tiesNo back fill was ever put in place as you can see from the attached pictureWe admit that we were having Thanksgiving dinner and we did ask that the equipment that was being stored in our driveway be moved for the holidayWe did not think this would be a major issue as their equipment, which they own outright and is not rented as they stated, is housed five (5) minutes away at a facility on [redacted] ***As noted in my original complaint, the 2" topcoat had to be laid down, because we could not have a driveway of wet sand get us through the winter (shown in the picture attached), no additional rock was added, the parking portion of our driveway was pure gravel when we purchased itOnce Spring arrived, we waited several weeks from the time that it was public knowledge that the asphalt plants had opened (early this year due to the mild winter) to allow the company to call us with regards to completing the jobWe never heard from themI called multiple times, as you can see from the phone records and text messages attached to ask what resolution they proposed with regards to finishing the drivewayWhen we received no response whatsoever, THEN we demanded a cancellation of the contract and a refund Regards, [redacted] ***

to confirm that we are able to response to the below compliant past the deadline.  As explained the customer filed the compliant with our warehouse address as opposed to our office address and we just received it yesterday.  Below is the information regarding the compliant and our response.  I have also attached a PDF copy if that is easier.  Please let us know if we can provide any additional information. Thank you,Tina C[redacted]Joanne C[redacted]Chester County Milling & Paving, Inc.Compliant Number: [redacted]Company: Chester County Milling & PavingAddress: [redacted]                 Downingtown, Pa [redacted] In response to customer complaint from: [redacted] & [redacted] It is customary in our line of work to require a deposit upfront due to the cost of materials associated with the asphalt and other materials.  When signing a contract with any customer we are able to provide an estimated timeline for completion of a project, however we cannot commit to a definitive completion date because the nature of the business is impacted by elements that are out of our control.  For example, the weather and we are at the mercy of the blacktop plants as to when they decide to close for the season.  Asphalt cannot be laid in low temperatures, following certain rain events and during certain types of precipitation or expected precipitation.  Also asphalt must be laid while the material is still hot so you cannot purchase the material and store it for another date or time. When agreeing to do this work, understanding that we are at the mercy of the plant (for materials) and the weather and with our 37 years of experience in the industry we would not commit to a December deadline when a contract is not signed until November.  At the time, we were experiencing a mild fall/winter so far and had intentions of completing the work as soon as possible weather and plant permitting.  The customer was extremely demanding without being understanding of our companies right to make a decision on which days work could be completed in order to ensure it could be done safely and correctly.  The contract was canceled by the customer after a significant amount of the work had been completed and the cost of the work completed exceeded the amount of the deposit.  The work completed included but was not limited to: excavation, installation of a retaining wall, including anchored and backfilling; and two areas were prepped and paved with a 2” top coat.  Additionally, the customer was hosting Thanksgiving dinner at their home, mid-project, in which they demanded that we clean up the site and put the driveway back together in order accommodate their guests.  At which time we added additional stone and material, provided labor and equipment that was above the proposed cost to get the driveway in a more aesthetic condition for their guests.  The labor, equipment and materials required to complete this request additionally exceeded the contracted scope or work and cost. When the spring came again the customer was again irrationally demanding the work be completed immediately without allowing us as the company to schedule according to weather, materials and equipment availability.  The customer then rashly canceled the contract at which time it was communicated to them the deposit would not be refunded as the cost incurred and contracted work completed did not entitle them to any money back.  In response to the phone numbers being disconnected, we had changed our office number over the last year due to changing phone providers however we were not able to successfully bring our old numbers with us.  Our business cards our not currently updated so we provide the customer with the correct contact number (of the owner or foreman doing their job) in person, handwritten and/or on their proposal.  As you can see from their compliant that this course of action was taken for this specific customer and they were provided a direct phone number to the owner of our company who was completing their job.  As a local family owned company in business for 37 years we pride ourselves on our experience with the trade(s) of milling, paving and general contract work.  We live and work in the Chester County community and are honest and hardworking for every job we complete.  We went above and beyond the terms of the proposal to try to accommodate this customer. At the customers request to cancel the contract we agreed to go our separate ways and explained that there would be no refund on the deposit because the work completed justified the amount of the deposit.

When I called to find out where the company was (my wife was home that day and notified me no one had arrived), we were told they were "packing up to head over" this was at approximately 10 am. Two employees from the company showed up around noon. They were putting the railroad ties in the cutout (which was mostly excavated before this company took on the contract).
