had a 1998 Volvo he wanted to trade in. Weworked out a deal, got financing arranged, and sat down to complete the required paperwork. Herepresented the car he was trading in as his, and I asked if there were any other names on the title. Hesaid he wasn't sure, so we checked the online title registry for the state of MT. There in fact was adifferent name on the car, and he said that it was his mother, who he lived with, and that she hadalready given her approval to trade in the vehicle. We told him we would need to the title to the car,and gave him the necessary forms for his mother to sign off on (there were two forms we needed hersignature on), and we told him we needed a copy of her driver's license as well. He said he would returnthe forms with the required signatures as soon as his mom returned from an out of state trip. Wecompleted the rest of the paperwork and the customer left in his new car.About a week later, I called the customer to see if his mom had signed the forms, and to ask when hecould bring them by. He said his mom would bring them by that day. That afternoon, she arrived andasked if there was any way we could undo the deal. She explained that she had not given her permissionfor her son to trade in the car, that she didn't feel he was responsible enough for a car loan, that he wasknown to steal money from her to support his drug habit, and that she wasn't going to pay for his newcar. I informed her that since her son wasn't a minor, he was legally able to enter into a contract, andthat he appeared sober and not under the influence of any drugs whatsoever when he was in our store;therefore we had no reason to suspect anything amiss with him wanting to buy a car. I also assured herthat her name in no way appeared on the new contract, and there was no legal way that she would beconsidered liable for his new purchase. I also informed her that the loan had already funded at thebank; that we were unable to just "undo" the deal. She may not have approved of the way her son wentabout trading in the car, but as far as we were concerned, that was between them. She then agreed tosign over the forms that we needed, which she did, and gave me a copy of her driver's license, and alsoagreed to bring the title to the Volvo to the dealership the next morning (she didn't have it with her).The next day, she showed up, and I asked her if she had the title. She said no, and that she wasn't goingto be giving it to us. She had changed her mind, and wanted the forms back that she had signed, orwanted her car back. I repeated that this was between her and her son. She claimed, it was a case oftheft, and again, I repeated that this was between her and her son. I also gave her two options if shereally wanted the car. I would sell her the car for what we gave her son as a trade-in value, or she coulddrop the matter and turn over the title. She got angry and left saying she was going to call the copsbecause her car had been stolen.She returned one other time and talked to another manager when I wasn't present and accused us of"strong-arming" her into a contract (impossible, because she still isn't in a contract with us, nor were weattempting to initiate a contract with her), of being dishonest, and continued to complain that her drugaddictson wasn't capable of making such a decision.

Review: I have a 19 year old son who lives with me, has a car, a 1998 Volvo titled in my name only, no liens. I also hold the insurance policy for which he is supposed to pay for his portion with the wages he makes at his job. Sadly, my son has never paid his part and recently had a rent a center purchase repossessed. That being said, I was out of town January 6th- the 13th. During this time my son took the Volvo the Lithia Chevrolet dealership in Helena, traded it in for a 2008 Dodge Avenger, then obtained a loan all without so much as a phone call from the dealership to me, the legal owner of the 1998 Volvo. I contacted the dealership and explained about my son's inability to finance anything on his own, that he was living with me, not responsible about paying for anything and he underhandedly tried to make this deal while I was out of town. I told them I didn't think it was right for them to go through with the deal without contacting me, the titled owner of the trade. They said I have 2 choices, I can give them $1300 for what they gave for the trade, or I can just sign the title over and let it be done. I refused to give them the title. I feel that I was strong armed by the Finance manager at the dealership. I feel it was unethical and bad business practice to not notify a legal owner. I also feel that since I am a woman, I was treated unlike a man would have been treated in the same situation. Now, I feel like the only thing I can do is file a stolen vehicle report against my son and try to recover my vehicle from a deal that I had no knowledge of.Desired Settlement: I want my 1998 Volvo back.
