Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear belowDear [redacted] :Thank you for forwarding me the response from Real Mex Restaurant regarding the damage I received to our cell phone while dining at Chevy's restaurat in Rocklin CA on January 17, I purchased the phone brand new from AT&T for my son to use on my shared family plan on October 18, 2014, we received it from AT&T the first week in November After the salsa was spilled on our phone by a Chevy's server on January 17, 2015, and the restaurant manager refused to provide us with an incident report or any document indicating the damage occurred, I placed more than phone calls to [redacted] at the Real Mex Restaurant corporate office in Cypress, CAFinally on February 24, 2015, she answered her phone and I explained the incident to her, at which time she indicated that she would send me a check for the cost to replace my phone as soon as I faxed her the following documents from AT&T: Proof that the phone was currently assigned to my shared family plan; proof that I purchased the phone from AT&T including the date of purchase; and proof showing the amount it would cost to purchase an exact replacement phone from AT&T ($plus $tax)I faxed her all those documents that evening and she advised me that she received the documentsOn, February 26, 2015, I received a call from, [redacted] , Risk Managemnt for Real Mex restaurants and she advised me that she would replace the phone only if I mailed her the phone to her office in Cypress, CA, which is miles from the restaurant where the damage occurred and miled from my homeShe followed up with a letter that reads: "We would like to extend the offer of a compensation amount of the value of the phone at the time of the incident in the amount of $In order to fulfill this offer, we are requesting that you please send us the damaged phone; Samsung Galaxy Note 4-Frost White through FED EX to insure delivery trackingUpun receipt of the phone, we will have a check generated in your son's name, [redacted] and sent back to him through FED EX to ensure speedy deliveryWe ask that you send us the phone in the condition stated during our phone conversation; stll functioning with damaged interior sporadically shutting off" When I received the letter, I advised Ms [redacted] that my son could not be without the cell phone during the time it takes for this mailing transaction and to receive the replacement check and that the $does not cover the amout to replace the phoneIt will cost us a total of $to replace the phone plus a $activation fee that we will be charged for by AT&T to activate the new phoneMy main objection is that we cannot be without a cell phone for any amount of time as my son uses the phone for work, school and safety purposes dailyConsumer laws are very clear in CA as it relates to property damaged by an establishment while conducting business in that establishmentI can send you a copy of the letter sent to me by Real Mex RestaurantsI have tried to get Ms [redacted] and others in their office to allow me to do an exchange of the damaged phone for a check to purchase an exact new phone at $or they can purchase the exact brand new phone exactly like the one we have from AT&T and the exchange can take place at the Chevys in Rocklin where the damage occurred or at an AT&T store in my areaReal Mex restaurants refuses to resolve the matter in this fair and equitable manner I was forced to involve a state Senator's office in the Cypress area and they so far have refused to agree to the exchange of the damaged phone for another exact phone or the check at the same timeI will not agree to send them the phone and hope to receive the check or another brand new phone because there are no assurances for me in that type of transactionThe main objection is my son cannot be without a phone during the time it takes to receive the check and take it to a bank and wait for it to clear and purchase a new phone We suffered the injury to our property while dining in their restaurant and we have been treated unprofessionally and outside the provisions of consumer protection lawsIf RealMex refuses to resolve this matter in this fair and equitable fashion by allowing the excahnge to take place at the same time, I will be forced to seek a legal remedyThank youRegards, [redacted] -***

Dear [redacted]:Thank you for forwarding me the response from Real Mex Restaurant regarding the damage I received to our cell phone while dining at Chevy's restaurat in Rocklin CA on January 17, 2015. I purchased the phone brand new from AT&T for my son to use on my shared family plan on October 18, 2014, we received it from AT&T the first week in November 2014.
After the salsa was spilled on our phone by a Chevy's server on January 17, 2015, and the restaurant manager refused to provide us with an incident report or any document indicating the damage occurred, I placed more than 10 phone calls to [redacted] at the Real Mex Restaurant corporate office in Cypress, CA. Finally on February 24, 2015, she answered her phone and I explained the incident to her, at which time she indicated that she would send me a check for the cost to replace my phone as soon as I faxed her the following documents from AT&T:  Proof that the phone was currently assigned to my shared family plan; proof that I purchased the phone from AT&T including the date of purchase; and proof showing the amount it would cost to purchase an exact replacement phone from AT&T ($825.99 plus $61.95 tax). I faxed her all those documents that evening and she advised me that she received the documents. On, February 26, 2015, I received a call from, [redacted], Risk Managemnt for Real Mex restaurants and she advised me that she would replace the phone only if I mailed her the phone to her office in Cypress, CA, which is 500 miles from the restaurant where the damage occurred and 500 miled from my home. She followed up with a letter that reads:  "We would like to extend the offer of a compensation amount of the value of the phone at the time of the incident in the amount of $816.00. In order to fulfill this offer, we are requesting that you please send us the damaged phone; Samsung Galaxy Note 4-Frost White through FED EX to insure delivery tracking. Upun receipt of the phone, we will have a check generated in your son's name, [redacted] and sent back to him through FED EX to ensure speedy delivery. We ask that you send us the phone in the condition stated during our phone conversation; stll functioning with damaged interior sporadically shutting off". 
When I received the letter, I advised Ms. [redacted] that my son could not be without the cell phone during the time it takes for this mailing transaction and to receive the replacement check and that the $816.00 does not cover the amout to replace the phone. It will cost us a total of $887.94 to replace the phone plus a $40 activation fee that we will be charged for by AT&T to activate the new phone. My main objection is that we cannot be without a cell phone for any amount of time as my son uses the phone for work, school and safety purposes daily. Consumer laws are very clear in CA as it relates to property damaged by an establishment while conducting business in that establishment. I can send you a copy of the letter sent to me by Real Mex Restaurants. I have tried to get Ms. [redacted] and others in their office to allow me to do an exchange of the damaged phone for a check to purchase an exact new phone at $887.94 or they can purchase the exact brand new phone exactly like the one we have from AT&T and the exchange can take place at the Chevys in Rocklin where the damage occurred or at an AT&T store in my area. Real Mex restaurants refuses to resolve the matter in this fair and equitable manner.

Review: 1-17-2015, we dined at Chevys restaurant, Rocklin, CA. The server spilled a bowl of salsa on our cell phone & it splattered on my white jacket. The salsa seeped into the microphone & speaker of the phone causing damage inside the phone & it works sporadically and turns off on its own. AT&T refuses to fix or exchange due to the liquid damage they found caused by the salsa. I purchased the phone brand new in 10-18-14. When the salsa was spilled the manager refused to provide me an incident report indicating the spill occurred in the event the cell phone had unforseen damage and if I could not get the salsa off my jacket. She argued with me and advised me that she called her boss [redacted], who told her not to provide a written incident report. Immediately the cell phone kept turning off & not sending texts correctly so the next day I left a message and six additional messages for Ms. [redacted] and faxed her a letter with no responses. I spoke to a woman in her office, Trina who promised [redacted] would return my call. Finally on 2-24-15, Ms. [redacted] answered her phone on my 7th attempt. She was unapologetic & antagonistic & argued with me. She finally agreed that if I would fax her documentation from AT&T proving the date we bought the phoen from them and a document showing the price that it would be to replace the phone with the exact brand new phone today, she would send me a check for the replacement, Which I did on 2-24-15. Today [redacted] called to advise that they would not pay for another phone unless I sent her the damaged phone to their Cypress California office & they would have it inspected & if they felt it was damaged by the salsa they would see about replacing it. I told them I cannot be without the phone and this was an unprofessional business standard and I would make a complaint above them. I left messages for a manager in a higher office in their company with no response.Desired Settlement: I indicated to [redacted] of Real Mex Restaurants that I would only except the exact brand new phone replacement or a check in the amount 0f $825.99 which is the cost of the phone to purchase it today . I also offered to meet someone from their company at a local AT&T store in the area of the restaurant which is in Rocklin, CA in order for them to inspect the damage to the phone themselves with me and an AT&T representative and they told me they would not agree to any of these terms.

Review: Went to Chevys in [redacted] on Feb. 2nd. Halfway through dinner a roach ran across the table. Manager said this is a ongoing problem at this location.

I contacted Corporate and was contacted by a lady named "[redacted]" She said she would send me 6 free entree coupons.

On Feb 8th I received a open envelope with just a thank you card. Looks like it may have been opened with a letter opener.

I filed a complaint with the USPS.

USPS said if it was sent priority mail it would have been covered by their insurance, however this was sent first class they cant do anything.

[redacted] said she could not resend because of the value...($120). Also hinted around like I was lying.

I wish because of the value of the items they offered to send me, they send it priority mail with insurance and tracking.

Now I am left with nothing but a bad memory about my favorite restaurant.Desired Settlement: Please resend what you offered.

Also in the future please send all valuable items Priority mail.
