There is more, but these are the issues that presses my wife and I to seek legal relief. We have been paying a mortgage on a house over one year that we still cannot live in. We want our house, the one with 10 inch logs, and the one where the roof doesn't leak. We have been more than lenient with [redacted], and have conceded much for quality work. Now we see we do not have quality work, and we don't think [redacted] has intentions of giving us quality work, or what our contract states in writing. Our one hope in contacting the Revdex.com is hoping we can steer others away from contractors like [redacted], and away from the anguish we have felt over the last couple of months.Business Response Contact Name and Title: PresidentContact Phone: [redacted]Contact Email: [redacted]The contract was written with the dates stated, however the clients agreed verbally to wait until the winter months passed and we had delays from the Log Distributor that the clients agreed to as well. The start date of this house was July 2015, impossible to complete in March 2015.The wife verbally agreed to the 8"logs in order to receive them quicker, I personally discussed this with her.There was a roof leak that I have attempted to repair % times and completed the repair successfully June 2016, I have been at the house on three occasions when it was raining and no apparent leaks, have video and pics to provide. A final inspection was preformed by the County inspector in the state this home is located in and today (7-22-2016)and No damage to logs were present, only some water stains.I have always responded promptly to their concerns and still have an active permit on this project. The homeowners delayed construction for 5 weeks installing cabinets and counter tops they subcontracted themselves, another 6-8 weeks on their septic system that they sub contracted in delays,stating they could not pay for it. I then stepped in and had the septic system installed and paid for it. They also requested from the county that the final inspection not be done, which has prevented them from occupying the home for well over a month. I have sent the clients documented notices that I was ready for the final inspection and ask that they contact the county and they refused. This home is ready for occupancy and they refuse. The home is in no way water damaged. The clients elected to move forward with securing the mortgage as to lock in the interest rate knowing we were going to incur months of delays ( we didn't even have a start date determined at that point). I am guilty of not having signed Change Orders on everything (dates and verbal changes),(all of which has cost me money that I have not asked for from the clients) lesson learned!! They are aware that I am losing money on this project, but have written documentation to them that states I would never leave them with a leaking roof regardless of money made or lost. I have in no way turned my back on this project or NOT tried to resolve any issue they have with construction. Consumer Response The initial commitment to build our dream home was signed in April of 2014 with the belief that it would take 2 weeks to get the plans and 6-8 months once construction got started. At that point, we expected to be in the house by the winter of 2014. The plans took 4 months to get back, and then they were not accepted by the inspections department. We then had 3 more months waiting for engineered plans. With CHI construction the delays are always someone else's fault. We had financing ready in April but had to wait on plans before the bank would close, we obtained our loan in Sept, not to lock in an interest rate, but because we had already been delayed 5 months and the day I received the plans that were needed to finalize the mortgage was the day I took them to the bank. In November, when [redacted] was finally able to obtain a satisfactory set of plans he informed us that the log company had closed for the winter and we would have to wait until spring, but he promised we would be is sole focus as soon as spring arrived and that we would be in our house long before my daughters October wedding. I now know that was a lie and that [redacted] cedar mill (where he obtained the log kit from) does not close for the winter. Well, spring came and went, and we were told that our house was too small for the log company to make it priority. In June 2015, when I realized we would never be in our house in time for my daughters wedding, I explored what it would take to fire CHI and start all over with a new construction contractor. Suddenly things started happening, permits were obtained, ground was broken in July 2015 with a promise we would be in it by Christmas. The reality was we were not even roughed in by Christmas. My father did serve as my subcontractor for the kitchen which had an allowance built into the mortgage and CHI has yet to reimburse him for his work/labor or materials. We had the cabinets installed in 1 weekend and we had to push [redacted] to get the floor in place (which he did 1 day prior to our installation). He did pay the septic subcontractor that we had hired from a portion of the money that he owed (and still owes) us for our kitchen (He gets the checks from the bank mortgage). We are 13 months since ground breaking, 15 months from expected completion, 7 months past promised completion and the general contractor still blames everyone else - us, the log company, the subs, the engineer. We still have a leaking roof with shingles that are trimmed to < 1/2" even though the minimum is >3/4" and general practice in the roofing community is 1-2 inches. We do not have a CO as he failed the 1st inspection with 29 violations and the second with 4 violations. We do refuse to move into the house because it is illegal as we do not have a CO. I will add that my friend built her house with the same contractor in 2013, had a wonderful experience and was in her house in 6 months, loves it and has no quality issues. Our experience however has been completely different. Final Business Response The Contract was signed in August 2014, The clients came to me with a picture of what they wanted. I hired a draftsman to do the Blueprints, he produced 2-3 versions of the home(which took the amount of time already stated. Once the [redacted] reviewed and approved them, the blueprints had to go to an Engineer ( required by the County inspections. This took time due to turning the plans into inspections,waiting for them to review, and getting them back to the engineer)the engineer plans had to be done twice as the engineer did them the first time with a"Framed Front Wall, and we needed it to be Log.Time lines as [redacted] states reference the plans and engineering are mostly accurate. However Mr. [redacted] states to me that he is an engineer and has told me MANY TIMES throughout this project, " I do not care how long it takes as long as it's done right".As for a "Satisfactory" set of plans, this sounds like the plans were done by incompetent entities over this period and they were Not Acceptable, which is not the case! All were professional design companies that I have used for years. As for [redacted] Log Homes, I never told the [redacted] that the company shuts down for the winter! The log that they desired is a White Cedar log, which is only offered by a very few distributors in this area! What I did tell them was, the shipment of White Cedar was delayed because of winter from one of the MANY Log distributors that I contacted, trying to get the materials as quick as I could!! Mr. [redacted] and I discussed and AGREED to delay the project through the winter due to the high probability that the White Cedar would get stained by the Red dirt / mud if we tried to start at that time. The small log order fell way down the list (distributors shipment list) for shipment due to the back log from the winter. ( This was told to me by my sales rep from [redacted], and relayed to the [redacted]).Once [redacted] gave me shipment date I then put everything into motion to get started, and was ready when the logs arrived! At no time was there mention to me that the [redacted] were considering hiring another contractor, and this had no bearing on my timing of moving forward with the project. This house has a basement,( pre-fab ) and the timing of it being installed was in accordance to when the logs would be on site, as to not have the basement sitting without support on it,and other factors that could have damaged the basement. As for the Kitchen Cabinets, merely siting in place with out completion so that other trades can proceed does not constitute "installing in 1 weekend" The cabinets were not completely installed, and some additional cabinets had to be re ordered after the initial placement. The Granite Company, the electrician,and plumbers were all delayed for weeks while the additional cabinet work was done. The reimbursement of the cabinet sub was to be done on the final draw,as per Instructed by [redacted], At this point the final changes, monies owed or due to both parties would be stated on the final invoices.The final invoice had not been done as of yet due to the Ordered delay with County inspections, of the final inspection process by the [redacted], I had to pay for the Septic system installation (which was their obligation) in order to be able to get it installed and inspected for the final inspection.I have not been reimbursed for this as well ! The [redacted] also delayed the septic from being installed for 5-6 weeks, as they would not return the Installers calls (as per the septic contractor).As for the inspection "violations" that were noted and made to seem like they were a significant, all were minor, and were completed in a timely manor. Again the occupancy of this home is delayed on my part and by the clients themselves for a documented 3 months +/-. At this time I have still not received any evidence of the roof leak existing. As for the clients refusal to move in, well its a little late to say "you want occupy the home" when there is picture proof that the home has been occupied for weeks and weeks, ( sleeping, cooking, and showering in a home, constitutes occupancy) of the home that does not have a C/O as of this date! As Mrs. [redacted] states in her before mentioned statement; She has a friend whose house we built with out incident, and we have hundreds of other projects that we have completed without incident since I have been in this industry since 1983. It is unfortunate and regrettable that some circumstances I control and some I did not causes this issue with the [redacted]. This home is constructed as per plans, and revisions(verbal and documented), the home is beautiful and has no structural issues !!
