Dear Sir or Madam: This letter is in response to the above-referenced Revdex.com complaint (the "Complaint") filed by the Customer with the Central California and Inland Empire Counties' Revdex.com (the "Revdex.com") against Chicago Title Insurance Company (the "Company")The
Company has: reviewed theComplaint and the supporting documentation include herewith and can now provide a response.. The facts and circumstances giving, rise to the Complaint, as the Company understands themare as follows; On December 23, 1976, previous owners (the "Prior Owners") acquired property commonly known as *** *** *** *** *** *** (the "Property"), Subsequentlyon October 2007, the PriorOwners executed a revolving line of credit short form deed of trust (the "Prior DOT") in favor of Bank of America_ NA("BOA"), encumbering the Property. Later, on October 29, 2012, the Property was conveyed to the Customer via grant deed, In connection with this transactionthe Customer was issued the above-referenced Owner's Policy of Title Insurance (the "Poi icy-). Subsequently, in a letter dated June 2016, BOA sent the Customer correspondence stating that the Prior DO-encumbered the PropertyAccordingly, on June 15, the Customer contacted a Company employee whereby a formal title claim was submitted to the Company's Claims Department on June 19, 2016. Pursuant to its investigation, the Company accepted coverage for the Prior DOT via correspondence dated July 26, 2016. Pursuant to accepting coverage in its July 26th letter, the undersigned sought to obtain a point of contact with BOA in order to obtain an updatedpayoffUltimately_ a payoff was unobtainable without authorization from the Prior OwnersNotablyhowever, the Prior Owners were both deceased. Accordingly, on September 2, 2016, the undersigned contacted various individuals to obtain the contact information for the Prior Owners' daughter in order to determine whether she would he able to facilitate obtaining a payoff from BOA due to the undersigned's inability to obtain authorizationUpon receiving contact information for the Prior Owners' daughterattempts were made to contact her. Subsequently, on September a notice of default (the -Notice of Default") was recorded in connection with the Prior DOTWhile awaiting response from the Prior Owners' daughterthe undersigned contacted BOA's foreclosure firm (the "Foreclosure Firm-). Though the undersigned received a response from the Prior Owners' daughter on October 19, 2016, she too was unable to obtain a payoff from BOAOn the same day, the undersigned received a response from the Foreclosure Firm regarding inquiries about the payoff and Notice of DefaultConsequently, repeatedly through October and April 2017„ the undersigned repeatedly corresponded with the Foreclosure Firm for the purposes of resolving the claim (including obtaining a payoff, discussing potential issues arising from statutes of limitation, and ensuring that no sale date would be set pursuant to the Notice of Default). Though a payoff was obtained by the Customerthe Foreclosure Firm advised the undersigned that said payoff was incorrect. Recently, howeveron May 1, the Customer provided an updated payoff for the month of MayAccordinglyon May 9, 2017, the Company sent BOA a cheek in the amount of $15,the alleged amount due, for the purpose of obtaining a release of the Prior DOTThe Company has notified the Customer of the same via correspondence sent the same dayThe Company will continue its persistent attempts to effectuate a resolution of the claim for the Customer. Based on the foregoing, it is the Company's position that the Company's efforts to resolve the Customer's title insurance claim have been both diligent and in good faithSpecificallythe Company has been in repeated contact with the Foreclosure Firm via phone and email for the purposes of resolving the subject title claim 'while also ensuring that no action is taken against the Customer or the Property as a result of the Prior DOT.
