On April 7, 2015, in a telephone call with one of our sales representatives, the customer agreed to purchase Weed Man's Basic program of
lawn care servicesThe customer has purchased this same program from Weed Man for the past yearsOn April 9, Weed Man sent the customer a confirmation of services orderedIncluded with that confirmation was a copy of Weed Man's Terms and Conditions of service, a copy of which is attached
Under those Terms and Conditions, the customer was permitted to cancel his services at any time prior to deliveryWeed Man reserves the right to charge an administrative fee of $if a customer cancels, and to charge the difference between program pricing and single service pricing (approximately a 15% different) if a program customer cancels their services
In addition, the Terms and Conditions clearly state that the services may be delivered "taking into account weather, agronomic/growing conditions, pest life cycles, and scheduling of delivery of Services" for the area the customer resides in
The customer did contact our office once prior to receiving his weed control service, on May 27, to inquire when his weed control would be doneAt that time, he was informed that Weed Man did have some issues with equipment (which were resolved within a day, and had no material impact on service delivery)However, the office did make clear to the customer that due to the harsh winter and late Spring, weed controls had just startedWeed Man records all calls for quality assurance purposes and in that call the customer clearly indicated that Weed Man was to proceed with the weed control serviceWeed Man completed the weed control service as per its contract on June
It was only after the weed control service was done that the customer called back on June and advised he did not want to pay for the service as he believed it was too late and he had to do work himself to get rid of his weedsOur customer service representative, *** *** spoke with the customer on June Mr*** advised the customer that since he had received the service and not cancelled it beforehand, Weed Man expected to be paid for its workAt that time the customer cancelled the balance of his services with Weed ManA day later, on June 18, Weed Man received payment from the customer for the weed control service
To date Weed Man has not sought payment of its administrative cancellation fee or the pricing differential above from the customer, as it is permitted to do under its contract
Weed Man's position has not changed - it will not issue a refund as the work was done in accordance with the terms of the contract and which the customer did not cancel beforehand

*** I worked in good faith with this company for many years and when there failure to provide the work when needed failed, I am at faultI am sure that if you look at the call of April 2015, that I stated that I was unsure of what I was going to do in regards to weed control ***Your representative stated that to ensure I was on the list, then I would be added to the list and I could cancel at any timeHow about confirming this from your recordsThere was also no mention of a cancellation fee if ***

Resolution for me is to have the money paid to me and I am also sure you do not have a signed contract with me, but we did have a verbal understanding that you have not honoured

Our terms and conditions also state there is no penalty to cancel if you sell or move from the propertyI can confirm that Mr*** did mention in the call on April 7th that ***, however the reason for his cancellation was not due to ***
As mentioned, the equipment issues did not have any impact on servicing the *** areaMr*** called into the office to inquire about his weed control on May 27th and we completed the service exactly business days from that day, despite losing a few days to rain in that time frame
Our position has not changedMr*** did not cancel the service and Weed Man completed the work as orderedWeed Man will not issue a refund

I do not accept there logic that a service was late, I spent about $and removed four large compost containers of weeds from my lawn***
