Revdex.com:
I have reviewed the response made by the business in reference to my concern, and find that this resolution is satisfactory to me.

The Chico Sports Club disagrees with the characterization of the Club and it's staff. Chico Sports Club is willing to contact the collections company and stop the collections process. We here at the Sports Club are willing to waive all the club dues and charges in an effort to continue to provide...

the excellent customer service we have been known for in the community.

Thank you for sending us a billing showing your new address out of state. We will be waiving your 30 day notice to cancel and refund you for Sept and Octobers dues totaling $98.00.

Review: I joined the sports club and signed a contract for my family of 5 with a corporate rate of 65 per month. Continued to pay on time every month until I was asked to prepay to make it easier. I did prepay in two payments per my agreement in 5/2012 & 6/2012 totaling $814.00 for the period of 5/2012 to 5/2013. I added a relative for additional 10 per month for three months in 6/2012 I called and cancelled [redacted] Added [redacted] per phone call to [redacted] at 10 per month 1/2013. Made another prepayment 4/2013 $300 which would have put us in credit balance. In 8/2013 my children tried to work out and where refused. I called spoke to front desk she said maybe owed money and since I was at work and unable to check I pait an additional 300.00 on account put us into credit balance additionally. Called over the next month trying to work out problem finally spoke to [redacted] and asked for GM to call me. she said she would have [redacted] call me back called 7x over the month and he would not call me back. Finally just asked for my membership to be cancelled and my money refunded. they had a check waiting in the amount of $283.74 and back charged me for membership dues and late payments even though I was in credit balance. I am so disappointed in this establishment owned ([redacted]) in there customer service and there dishonesty!!! They still owe me $130.26.Desired Settlement: DesiredSettlementID: Refund

I would like an appology from GM [redacted] and my money returned $130.26.

Initial Business Response

Member was out of contract. Our membership department had called to renew [redacted]'s contract and they tried to explain to [redacted] that with 6 adults on the account, the membership price would be $149 per month and not $69 which was what she was somehow paying previously. Needless to say, [redacted] was not happy that the amount had gone up and she wanted a refund on the account which we did. Member was charged for usage on the account.

Final Consumer Response

(The consumer indicated he/she DID NOT accept the response from the business.)

I have my original contract which is the only one ever asked to sign no attempt was ever made to contact me regarding a new contract, the only contact was made by me to your business to find out why we were being turned away and no representative from CSC ever called back. CSC has the original contract. If they had not extended the contract (as they had for years)they should not have cashed the checks and held the money the money should have been returned and it was not. By cashing and holding the checks and no attempt to contact us this means you where paid for services as had been the case for years. You set the corporate price and I paid it, if you changed your mind you should have returned the money. You know you are in the wrong here and you need to return my money.

Final Business Response

We do not show that [redacted] has or had a current signed contract. Just because she sent money in does not mean that she extended her previous contract. Our membership department called her to come in and sign a new contract. If [redacted] would like to provide us with a copy of the contract she has showing that she was only supposed to pay $69 per month for 6 adults this would be helpful. We do not know of any gym that only charges $11.50 per adult per month and that is most definitely not our pricing currently as our membership department tried to explain the [redacted].

Review: I strongly feel as though Chico Sports Club failed to provide the services they agreed to in the contract we had. The mens locker room was completely disgusting every time I went in to it. The hot tub in the mens locker room had black mold around the perimeter!! There was a broken glass tile with the serrated piece inside of the area it had broke where a child could easily pick it up or where if someone tripped and fell there it would be really bad. The steam room was down for 2 months at one point! The sauna was actually programmed at 135 by the time I had enough. On top of all of this I caught a really weird vibe from the staff after I had a conversation with the G.M about a personal situation of mine that seemed to get out to the staff. Also the head personal trainer went out of his way to literally turn his head away from me, so as to make it really obvious, every time I would walk by him. I'm am not the most outgoing person, but am always polite to people and tend to mirror the energy I am given and so I lost my enthusiasm for working out in disgusting place where the equipment is frequently down for long periods of time and the staff goes out of their way to make me feel uncomfortable.Desired Settlement: I strongly feel as though I should be cleared of this matter. I shouldn't have been turned into collections, and I actually will look into whether or not I am entitled to anything due to the amount of stress this has put on me in a few different ways. I don't feel as though the G.M. or "[redacted]" acted at all professionally with me. The equipment, sanitation issues, and my personal experience with the heads of the staff justify my being cleared of this matter entirely. I hope you feel the same.

Review: Had a year membership with this gym and decided to move back to my hometown in North Carolina. I called them to cancel my membership because in the beginning they told me I could cancel the membership if I moved more than 25 miles away from their location and could prove it. Below here is additional proof when I had someone else to recently ask the same question at the beginning of this year to them the same question....again, look what their option 3 says! I do believe Chico Sports Club that North Carolina would be 25 miles away from you????? Yet.....they would not let me out of my membership and refused to stop taking it out of my bank account. They caused my account to overdraw several times. I eventually had to close my bank account in NC and gave up trying to get them to cancel my membership...which clearly they state...they will do if a person moves more they 25 miles away? They turned this money I owed them into the credit bureau also which of course made my credit score go down.

Hi !

Yes! There are options out there for people who are unfortunately unable to keep the full year commitment. I will list all options for you, and let us know if you would still be interested in becoming a member of CSC.

Option 1 - You may break your year long contract at any time, but there will be a $150.00 early termination fee associated with that.

Option 2 - You can find someone to take over your contract in the event you are no longer able to come. This is called a Change of Primary, and is very easy to complete.

Option 3 - If you happen to move residences over 25 miles away from Chico Sports Club, we can let you out of your contract with no fee to you. This has to be proven to Billing though, and we have to be able to see on "google maps" that it is in fact more than 25 miles

I am hoping I have helped in some way, and please feel free to contact membership with any other questions! [redacted]Desired Settlement: FIX MY CREDIT REPORT, PAYMENTS BACK YOU KEPT PROCESSING AND BANK FEES YOU CAUSED ME TO HAVE!!

I am rejecting your offer:You have lied to me and everyone else for that matter. As far as me never getting in contact with you (CSC) to try and cancel my membership, that's a lie. I called (CSC) the day I was leaving in August 2014 to try and set up an appointment at (CSC) to show proof that I was moving back to NC (which is more than 25 miles away) so I could bring you (CSC) a copy of a water bill that was issued to me at my new address in NC. I was told on the phone call, the day I wanted to cancel, that I could not cancel my membership unless I paid the $150 cancelation fee. Shock to me because when I came to sign up, before I signed the document stating that I would have to pay to cancel, I was verbally told by a CSC membership rep that as long as I moved 25 miles away and could prove it I would not have to pay any type of cancelation fee, Just as stated in the email I used in the first message. The ONLY reason I agreed to that contract was because of what your membership rep told me. When I spoke to (CSC) in October 2015 about me being delinquent on my payment (my girlfriend emailed them to see if they would tell her the same thing and sure enough CSC told her in the email that if she moved 25miles away she could cancel) when I told CSC that I had this email they said, and I quote "we (CSC) have never had our contracts say that you can cancel without penalty if you move 25 miles away". They laughed and asked me to prove it. Now that I proved it they are saying that they just introduced this feature in 2015. Now all of a sudden im hearing that they (CSC) DO in fact have this as part of their agreement. Which one is it? You didn't in October 2015 but you did in 2015 sometime? Confusing to say the least. Now your reviews online show that I am one of MANY who have had a almost impossible time trying to cancel because of lies that you tell people just to get them to sign up. And I have recently spoke to more than one person about how they were told the EXACT same thing as me but when it comes time for them to move they are stuck with a cancelation fee. Honestly It makes me sick inside the way that you lie to people and not even feel guilty about it. I will not be paying the $118.00 that you offered to pull me out of collections. I will be excited to hear what you have to say back to this, just because I don't see you (CSC) caring about righting your wrongs. Do me a favor.
