Full down payment not refunded after contract cancelled and NO work ever started.On 7/6/2015 we signed a contract with Chimney Works, Inc for repair work to be done on our chimney. The total estimated cost was 1900.00 at which time we payed 900.00 in cash as a down payment.On or about 7/23 we informed Chimney Works that we would be cancelling the contract due to no work being performed to date and no notice of work being scheduled going forward. at that time we requested our 900.00 down payment bereturned. We were informed by Chimney Works that the down payment would be issued at the start of the following business month (August 2015). We received a certified letter the first week of August form Chimney Works with a money order for 400.00.Upon receipt of the certified letter I immediately contacted Chimney Works owner [redacted] to inquire about the missing 500.00 of the down payment.Mr [redacted] informed that the 500.00 was payment for his "time." Granted, zero actual repair work was done on our chimney, we had only the initial meeting with Mr [redacted] on the day we signed the contract and all inquires concerning the possibility of work being performed the following two and a half weeks were generated by us.We feel the 500.00 kept by Chimney Works is excessive and would like an additional 400.00 dollars of the down payment returned to us.Desired SettlementAn additional $400.00 of the down payment money returned to us.Business Response Chimney WorkP.O Box [redacted]XXX-XXX-XXXXContract date was on 7-6-15 to repair chimney.I told them it would be about 1 and 1/2 weeks before I could start the job. But we do have to consider the weather in doing this type of work. Because I could not take a chance of getting their house wet on the inside. I contacted them on or about Wed. 7/15/15 to start work on Thursday 7/16/15 or Friday. They told me the were going out of town and they would contact me when they got back. They called me the next week about 7/21/15 and told me they were back. I told them I would check the weather an get with them. They told me if I could not guarantee them that I could do it Saturday 7/2/15 that they had someone else they could do it. I told them I would watch the weather and get back with them. At that time they told em they wanted to cancel. I told them to email that to me. They did on July 22, 2015 (attached), so I could refunded the (no refundable) deposit less the time and prep that went into the job.Sincerely,Chimney Works
