The insured and his wife split their auto policy two years ago as part of a personal separation. It appears that Mrs. [redacted] continued to pay by automatic draft for both policies. accounts should now be separated for billing as of 10-1-2014 and gave us evidence of a bank statement showing two automatic drafts for the October and November payments for this policy (correspondence to the carrier attached). She asked that the two payments be reversed and credited to her account. We spoke with Mr. [redacted] and asked if he wished to use automatic draft on his policy or if he wished a paper bill. He said he'd rather have the paper bill. In the process, it was explained to him what had transpired with the billing and he would be receiving a paper bill for the amounts owed. Attached is the transmittal to the Carrier dated 11-13-14 requesting that the change in billing. There was a total loss accident that occurred in occurred on 11-8-2014. The carrier contacted us on 12-18-14 to ask as to the disposition of the vehicle, whether he elected to keep it and continue to drive it or if he had disposed of it. We contacted Mr. [redacted] and asked and he stated that he wasn't sure if he was going to keep the vehicle and for us to contact him after Christmas to verify. We contacted Mr. [redacted] on 12-30-14 and he stated he wanted to cancel the policy. We explained that we needed his signature on a cancellation request form (State Of Virginia Mandate) and would send him one that day. We received the statement signed by Mr. [redacted] on 1-20-15 on 1-23-15 and promptly e-mailed and faxed to the carrier on 1-23-15. ([redacted]). A bill generated and was sent to Mr. [redacted]  on 11-23-15. Another bill and notice of intent to cancel the policy for non-payment was generated and mailed by certified mail on 12-23-14 giving him until 1-11-15 to make payment. (copy of billing screen attached). The policy was canceled for non-payment on 1-11-15.   When the carrier received the request to cancel back to 12-20-14 on 1-23-15, they re-instated the policy on 1-11-15 to cancel back to 12-30-14 when he requested cancellation per the signed statement. The policy was canceled 12-30-14 with an earned premium of $85 because of the lack of payment for both October and November through 12-30-14. This is referred to as "earned premium" as coverage was in force with no premium paid. The contact points that I've outlined are the only ones I see in the file where we actually spoke with Mr. [redacted]. We'd have gladly explained this process again if he didn't understand or was confused by the bills he was receiving. I don't understand the comment at the end where it's asked "how many times does one have to verbally cancel an insurance policy". You can't cancel a policy verbally in Virginia, and that's the reason we sent the statement for his signature. He had a policy which ran from 10-12-14 to 12-30-14 with no payment received by the Carrier. The Carrier expects their payment for the coverage provided. I don't know that I see another option here. Please let me know if there are any other questions or if I can better explain.
