On Monday June 10, 2019 I was notified that my rent for the month of June was not received. In disbelief, I left my job and visited the office so I could get a full understanding of what was told to me over the phone.
I walked into the office and was greeted in an unprofessional manner by the office manager, *** Johnson who told me that," I could resolve the issue by just paying my rent!" I replied to *** and stated that I paid my rent for the month of June on May 26th and it was processed on May 28th.
*** then stated that I needed proof of my payment. I provided *** with proof of my on time payment by the rent track system that the company utilizes. After providing the proof to *** , she then stated that "She" still may make you pay, but she would never provide me with who "She" was, nor a number for corporate.
I visited the office three times that day and constantly asked why would I still have to pay if I have already provided proof of my rent for June being payed on time and in full. I was still given no concrete answer from *** or a response from whomever she was communicating with from corporate.
I received a text message on the following day, and was told that the payment has been found and will be credited to my account. No apology was given nor a reason for the confusion.
Then on July 10, 2019, I received a text message that read," Could you please call the office." I immediately called the office and was told that they just searched the system and noticed that they could not locate my rent payment for March, and again asked for proof. I emailed the office the receipt immediately after the call ended.
I heard no follow-up response from the office until July 15th when I contacted them concerning a different matter. *** stated that I needed to send them a copy of my bank statement that proved my March payment was not rejected or sent back. I printed a copy of my bank statement and blacked out my confidential information that had nothing to do with this matter and emailed it to ***'s work email address. She stated that she could not open the attachment, so I tried again and she stated that she could not see the document. I faxed the document twice to the office. Upon *** receiving the fax, she wanted me to send just my bank statement with nothing blacked out.
At that point I felt that my privacy was being invaded, so I verbally contacted the office and inquired about why she needed to see my full bank statement. That is when *** stated that she was going to type up an eviction notice for none payment from March. I questioned the motion and asked why haven't I received any late fees or notices of non-payments for March until now. She then reiterated that she was going to give me an eviction notice. I replied by saying that I was going to contact the local police department because I felt that I was being wrongfully handled. *** then proceeded to hang up the phone while saying to her co-worker, "She said she's going to call the police."
I reached my home around 7:10pm. There wasn't a note nor letter attached to my front door. Once I came into my home and turned to lock my door, I noticed an eviction notice on the door that stated that I need to evacuate my home by July 18th, 2019 for non-payment from March.

we have researched your account and to our findings we do not see where your March 2019 rent was paid in full. To correct this issue I will need for you to release to me your full monthly March 2019 bank statement, without this information we cannot proceed with correcting the issue at hand. You did make a charge on 3/1/19. However on 3/4/19 it was returned back to Rent Track and the bank on 3/04/19. Rent Track did not record it as a return. So to this date you are still outstanding in rent for March 2019. We are still waiting on your March 2019 full monthly bank statement to rectify this issue. If you have any questions please feel free to call me or my assistant Mon-Fri 8:30 to 5:30 pm at ***. We are so sorry that this is a problem but we are willing to correct the issue and keep our residents happy.

I am rejecting this response because:

I've provided *** with proof of payment, as stated before. I emailed a bank statement to her on July 15th with that shows the payment being withdrawn out of my account on, March 1st for the full amount of the rent cost. As stated in *** message the payment was returned to my account on March 4th, and according to my bank statement, there were no return payments. I received another email stating that I have to provide the full month of March, and according to her statement if the money was returned it would have reflected on the first statement that was sent to the office. A second statement was sent over on the same day and *** stated she didn't receive it, however, she replied to the email. The unprofessionalism that's being displayed by the office manager is unbelievable. I found the corporate office number and called with my concerns and *** contacted me, due to me reaching out to corporate. I now feel like I'm being harassed and this matter is not being handled in the way it should be. My bank statements prove that I paid my rent and no refund was made.

May 4 I received keys to my town home and upon receiving them I did a walk through to an overabundant amount of repairs being needed as well as the presence of black mold. I filled out the necessary paper work per leasing agent and it wasn't until I notified the city of my concerns that a few things were done here and there including fire alarms not working, stair well handles loose and again black mold everywhere and it was May 20th as well as receiving calls from management screaming with retaliation. I have not to date moved into my apartment because the repairs were not done in a timely manner in which the city of ft worth was notified and complex was cited for not fixing the leak in the unit casing one bathroom to have black mold.. The black mold to date is still present (under sinks around pipes on the ceiling, on the walls and I am sure in the air ducts)and the management I feel have breached their own contract by not fixing the issue at hand. I have asked to be released from my contract and again was told they walked the unit and black mold is not present. I am pregnant, have respiratory issue and have a young child and I have contacted everyone to have this issued resolved to no avail they are unwilling to replace anything with black mold. I have contacted renters rights, state department, city and now you, in hopes that you may be able to keep this company from harming my family and others who want to move into this unhealthy environment. I have paid my rent and I have done everything to get this resolved as well as ask to be let out of this lease due to their breach of contract and again they are unwilling to let me out. I have not slept in this unit since I received the keys on May 4 and will not sleep there because black mold is a major health concern for me and my family. The management is unwilling to contact me via email in regards to my request which I have sent several times and I finally received an email that they are not releasing from my contract. I have tried to contact corporate management but can not get a number so the only people whom I can speak to are the women in the office who are extremely rude and unprofessional. I will continue to try to get this resolved however I want out of my lease for varies reasons but most important is that I can not live in an environment that is unhealthy and toxic to me, my unborn child and my young son.
Please take a moment to visit this location and look at the model home versus the units they are renting-It is false advertisement and an environmental hazard to live in this location.

I am so sorry that you are unhappy with your home. When you moved into your home you were asked to put all items that needed to be repaired on the Inventory and Condition Form no where on your move in condition form does it state that your home has black mold you moved in on May 3 you returned the form on May 8th. On your move in date you called into the office for some service request that were done on the day you moved in. On May 7th you sent a email to the assistant property manager at 6:30 PM after office hours stating that some work request were still not done. On May 15th we emailed you to say that the property manager and the maintenance staff was going into your home to walk your unit also on May 15th Code Compliance came out to your home regarding a call you made stating that mold was present in your home. The only repairs that Code found was a small leak coming from under your bathroom sink they did not find any presence of mold in your home. Code came back out on 05/172019 to find no other compliance issues in your home. On May 15th when the maintenance staff and myself walked your home all your personal effects where moved into the home upon re-inspection of your home on May 31st you had moved all your personal effects from the unit and it is now sitting vacant. On May 31st 2019 no presence of mold or mildew was found. At this time Chisholm Trail will not be releasing you from the lease contract we are more than willing to work out whatever other matters that you may have. We are so sorry that you feel like we have be unprofessional to you but we always strive to make every resident happy with living here at Chisholm Trail Townhomes.

I am rejecting this response because: although they have completed certain repairs they did not do it in a timely manner. Yes my move in date was the 3rd, but nothing was done including smoke detectors, cleaning, the railway, the floor( which still isn't done) and all other adjustments until May 15th. This is an unreasonable amount of time for especially a brand new tenant who has not even lived in the home for the "repairs" to be done which should have been completed prior to move in not attempting to be rectified once moved in. It took 12 days for anything to be done and it was on the inventory form and I emailed numerous times. Also I had to complain to code compliance for the leak because it still was not resolved by the 15 th. Code compliance had to come out and cite the property for it to be fixed. This took until the 20th of may. 17 days to fix a leak is unacceptable. I should not have had to call code compliance after signing a lease just 2 weeks prior. This is negligence on their part as a complex. Not to mention code compliance does not check for mold. There is a report on what was done in the apartment and that was a valve change in the master bath for the leak. The code compliance officer - *** discussed in depth that only state could handle mold not the code compliance officer. That is not in his scope of practice because you must be licensed to do so. I have been contacting the complex about the mold and no licensed personal has been to the apartment to assure there is no mold as they say. The office manager, assistant manager and maintenance are none of which are certified or licensed to check , test, or report mold. I have received no report from anyone and no response email since asking for some type of proof other than them walking the premise. They had walked it prior to my move in and I have 63 photos of the issues from the first day I received my keys. Yes things have been fixed but it has taken much longer than it should and having to call code, state, renters rights, and extreme amounts of research , time, and diligence on my part to get these things taken care of. I am a mother to a 7 year old and currently 8 months pregnant with a respiratory disorder and can not live in these conditions. I have also explained this to the staff and they still refuse to allow me to release myself from the lease. There has been way to many issues and I have diligently paid my rent on time since I signed this lease. I have not moved my things into the apartment and my bf and mother in law have been with me throughout this entire process. I am unable to move my things in because of the situation at hand. Please help me to follow through on this dispute.

Per company policy all outstanding balances have to paid in full before we can accept any current payments. All monies paid can be tracked on Resident Connect through ***. Any money that *** has paid to the office can be tracked by the residents ledger. *** can request a copy of her ledger by emailing me or calling the office.

I am rejecting this response because:

I have attempted to pay my rent and it has been rejected. The holidays are approaching and I don't want my family to be homeless due to the unprofessionalism of the office manager. Paying online also adds additional fees and I have been told that my rent will not be accepted. Please contact me personally if someone other than the office manager can assist me with this issue.

No attempt has been made to pay rent and all outstanding balances and current balances must be paid in full to satisfy your account you can call the office and speak with the office manager regarding your account and bringng it to a zero balance.

I am rejecting this response because:You all dont care about the residents do you. Let me tell you the customer is always right. Meaning you should at least hear me out. The office manager is the problem. I have a video if her talking about my kids to my face. There are complaints about her all over the internet. She has been in the news fo God sake. I have attempted to pay my rent on serveral occasions she band me from the office. This is what I mean by unprofessionalism. If you dont care ok then , but I will fight to the end. Do you think if I didn't have the money I would be contacting you. If you care about the so called business you run and finding out the truth my number is ***. If you dont then dont call me I will figure it out with legal.

My lease will be up on june 29th, I renewed for another 12 mo and I had prorated rent for the month of june which would be 899 plus water which was 63.71. I paod the rent and water and they want to charge me 31.67 for the day of the 30th and 2.50 for a month to month lease pay which I have never been on. Went to the office on the first to get an explanation and did not get a direct answer for the 31.67 and was told the 2.50 for month to month would be took off.

We spoke with *** today and she was charged a month to month fee because her other lease holder failed to sign the e sign lease contract when *** signed her part of the lease. The system charges a month to month fee when leases have expired. The $2.50 will be adjusted off the ledger and as of today we finally got the signed lease contract from both residents. The $31.67 was an over charge by the system that will be adjusted off.

I recently moved out and did not sign a lease. I later received the form Intent to vacate. The form states that I owe 3,579.80 in fees. I honestly feels like she is adding extra fees only because I moved out. I asked them om numerous occasions to fix the mold in my bathroom along with others things and that never happened. I have pictures of the holes the maintenance person put in the wash roomed and returned to fix it. I also have pictures of my bathroom ceiling that he came out and scraped but never returned to fix. My walls stayed that way from October to the day I moved out. I called and left her messages and she will not return my call. I understand I have to pay a move out fee for not giving a 60 day notice . I have no issue with that. The rest of the fees I feel as though *** the manager is very rude and does things out of spite. I have never moved out of a place and had to pay a ridiculous amount like this. The most I've paid was around 1,200. I would really be grateful if someone would help me to lower this ridiculous amount she is trying to charge me. I turned in a lease at the end of March but was told by *** it was too late and she could not use that one. She then placed one on my door for April that I still have and never signed. I am not in a lease so I really don't understand why she's doing this. Thank you kindly for taking the time to read this.

This resident did not sign a renewal, but was in a month to month lease contract that requires the resident to give a full 60 day notice to vacate. In addition, there were only two work orders submitted during this lease term and there was not mold in this unit. The charges in dispute are due to the resident skipping out on the lease and are broken down on the resident statement of deposit accounting which as delivered properly to the resident upon move out and described as follows: 60 days rent for failure to give 60 days notice $2100, 85% of 1 months rent for a relet fee when a lease is broken $892.50, laundry equipment left in the unit that had to be removed $35, water/trash and sewer charges not paid at move out $82.81, and $385 for prorated rent in April for the days we were without keys or notice that the tenant vacated. These charges are all clarified within the lease contract between tenant and property. There are no issues to negotiate in regards to this claim and we stand by the charges administered at move out.

My lease was up and I put in a 60 day notice. I have bank statements showing that I paid them directly for my rent for the last three months and now they are trying to charge me for it claiming I did not pay it. I have gone in to the office and call them to resolve this issue but the manager refuses to speak or see me, I paid them directly from my bank account to them on their website and each month showed that I paid them. Now they disabled my account so I can't show them on their website but it still shows all my payments directly from me to them for the last year and payments went through with no issue. The manager has been unprofessional from the beginning and now she is trying to pocket $2440 more.

My air conditioning has not been fixed since we moved in 3 years ago. It continues to leak all over my bathroom floor to wear it makes a swimming pool. We call continuously and all maintenance does is tape a old rusted out pipe and halfway seal my ceiling up. I can't even use that bathroom anymore because the ceiling is so gross. Whenever you sit to use the restroom, the ceiling drips on the top of your head.
