We did respond to this complaint on November 22nd. This was our response. RE: ID [redacted] Vehicle Purchased: 2000 Lexus RX300 - Vin ending in [redacted] Miles at purchase: 140,500 On April 1st 2016 Xxxxx XXXX purchased the stated vehicle. At the time of purchase Ms. XXXX was offered a... extended service contract on the vehicle mentioned above. As a dealership we do in fact offer at no charge a 30 day or 1000 mile warranty on most vehicles we sell. That warranty was expressed on the buyers guide and signed by Ms. XXXX on 04-01-2016. Ms. XXXX was informed of all of her options of extended service contracts and was well aware that we were not expressing or implying any other guarantees in regards to the length of time or mileage which the purchased motor vehicle will operate or travel after the date of contract or purchase. Ms. XXXX also signed a form or forms stating these facts. Under state law RCW 62A.2-314, every used car sold by a dealer in Washington for a customer’s personal use has an "implied warranty of merchantability.” This means that the dealer promises the used car will be fit for ordinary driving purposes, reasonably safe, without major defects, and of the average quality of similar cars available for sale in the same price range. A car can only be sold without the implied warranty if the customer knowingly agreed to waive the warranty and was provided with a statement of the particular characteristics or parts of the car that aren’t covered. On or around August 10th Ms. XXXX contacted Choice Auto Group in regards to having transmission problems. We at that time asked her if she had purchased the extended service contract. Ms. XXXX had declined the service contract and her Warranty had expired. We did in fact offer to trade her out of the vehicle and Ms. XXXX was not satisfied with the vehicles we had to offer at the time. In closing Ms. XXXX herself states she knew that vehicles could in the future have problems and the vehicle was a fair price. She also states to other people that buying the service contract is a must. Ms. XXXX is slandering our dealership and has been to our dealership many times and has done damage to our reputation. She is falsifying dates and not realizing her duties as a vehicle owner. In one statement she states "it matches up to blue book" and in the other she says she bought for " considerably more than it was worth" .The vehicle was purchased over five(5) months before the initial complaint not three (3) as stated by Ms. XXXX. We have attempted to make this right but the responsibility in this case rest on the customer. If Ms. Leander continues this slander we will seek legal council. These are Ms. XXXX's public comments about the situation. Google- [redacted] a month ago- Used cars, buyer beware. If you shop at Choice Auto, or any used car dealership, do your homework, take a level head with you and purchase an extended warranty then, hope for the best. Do not trust used car salesmen. I did and 3 months later I'm paying another $4,400.00 to replace the transmission in a Lexus that I bought for considerably more than it was worth. My bad for trusting that I was buying a reliable car just because it is a upgraded Toyota. As a matter of fact, I was shown the door when I asked them to please help me. The manager was angry because I wrote this negative review. I am glad consumers have a way to let other consumers know they should purchase with caution.August 10, just about 3.5 months after purchasing a 2000 Lexus RX300 at Choice Auto Group my car's transmission left... me and Lexus sitting on the shoulder going nowhere. A tow to my mechanic, $4500 to fix the tranny in a car I bought for $7400.00. Too bad I didn't buy the extended warranty (I was told by Choice, being helpful). If I had researched, a little, (carcomplaints.com/Lexus/ ) I would have known, this year and model of Lexus RX300 are notorious for transmissions failure. Also found that engines had a sludge problem, that Lexus never owned up to. I brought that up and it was glossed over in a used car way. My bad. People continue to ask me "Will the dealer do anything for you, you have only had it about 3 months"...The help I was offered:their precious time to find two quotes that I could and would have gotten myself, plus sympathy. I didn't need either..I should have walked out, NOT listen to the pitch, went home and researched online. It didn't take much: Lexus RX300 and transmission problems...there are a lot of posts of people's transmissions breaking down at 90,000 miles and up. Second, buy used cars...extended warranties are a must. So there's my update. One star for friendly and much sympathy, (didn't need either, I feel sorry enough for myself) And .005 star, because it's not their fault that I believed they sold cars I could trust, I believed they were different, duh. Because of my experience, I would not recommend Choice Auto Group. Do not do what I did! Read my first (3 stars when I first posted in April 2015) review below...I didn't give Choice Auto Group a 5-star rating because I've only had my new, to me, Lexus RX 300 for a few days...I'll update after a month. I have to admit, this 2000 Lexus was love at first sight, but because of my online research, endless car shopping and past used car buying experience I was ready to walk out if the car or the price wasn't t. Pedro was a pleasure to work with. He was knowledgeable and didn't pressure me into a purchase I didn't want. I'm saying this knowing that it is a used car, and with 140k miles, things could go wrong, but it is a Lexus with a clean Car Fax, matches up to blue book value, has service records, and a new timing belt and it's beautiful. To finalize my purchase, my Lexus had to be approved by my mechanic, and adult children (I was busy texting back and forth with them while at the dealership). So, at this point, I am a very happy car buyer, I got a fair price and I love my car. Now, I would recommend Choice Auto Group to a friend or family looking for a used car...I'll let you know in a month if I'm still loving it. Why one month? Because Choice Auto Group offers a 30 day or a 1000 mile limited warranty with a car purchase, if you're shopping for a used car you've seen the stickers on cars "AS IS".....it's assurance that Choice Auto Group has confidence in the cars they sell. _____________________________________________ Thank you, General Manager Choice Auto Group.
