I am rejecting this response because:Regarding my last statement on 3/18/I want to clarify that there was a miscommunication on my part, and for that I apologizeCurrently, the truck is at your shop and can not be drivenThe truck was driven there, so it should be rebuilt to the condition it was driven when we agreed to have it inspectedAlso, you mentioned the following, "we did not install the engine in the customers vehicle." I understand that, but you did sell me the engineUpon installation the engine was classified as a faulty engineI understand there was only a one year warranty, but we had been within the time frame during our first contact with your businessWe still need a working engine

I am rejecting this response because: The shop that the auto went to does not have xray vision for the engine.it was a front end an tire shop not mechanic shop like they are saying the truck wondered while driving.. I was not offer the extended warrinty like they are saying. the shop did say tie rod ends need to be replaced and the dealer did not fix, that was a cheap repair and so was the power steering that they said they would pay for the parts that I have still not received.so we can go back an forth all we are worth, they are a not a trust worthy dealership, they are fast talkers, an do not care who they screw over...I want a negative mark on the Revdex.com site from me and they can take there Dealership an put it where the sun does not shine. If I could afford a billboard in Sacramento I would put up my complaint on the dealership....So I am not sure where you want to go with this. Maybe you should try to get hold of the party that bought the the car that got mile when the engine failed them an get there opion of them an make you decision then.Thank you for you assitance on this matter*** *

I am rejecting this response because:Regarding my last statement on 3/18/2016 I want to clarify that there was a miscommunication on my part, and for that I apologize. Currently, the truck is at your shop and can not be driven. The truck was driven there, so it should be rebuilt to the condition it was driven when we agreed to have it inspected. Also, you mentioned the following, "we did not install the engine in the customers vehicle." I understand that, but you did sell me the engine. Upon installation the engine was classified as a faulty engine. I understand there was only a one year warranty, but we had been within the time frame during our first contact with your business. I am sorry I did not get your message before this, the only thing that was looked at on the truck was the steering,we fixed it also, the power steering pump went out in less than 3 days, they where to pay for the parts and never did.So you believe what you want to believe but they are a shady company,

Review: My complaint is that the truck that I bought has many mechanical problems. I paid $10,992 and costs to repair it are very expensive. To do a diagnosis on the motor it will be $600.00 dollars just for the diagnosis. Because it is also required to get it done since there is something wrong with the motor and I am not planning on spending more money on this truck.Desired Settlement: I would like that if it is possible I could get help in getting my money back.

Review: Engine light continues to come on and they knew it before they sold it and cant do a diagnostic test because they do not have the equiptment.

Engine light continues to come on I have taken it back since I bought the car, they changed the spark plugs and said that would fix it and it didnt and I have continued to call and go back and they say there is nothing they can or will do at this point. I asked for a basic diagnostic and they said they did not have a machine that could do that. I took it to Midas got a diagnotic test and it showed the 8th cynlender was not firing and the engine would need to be taken out to replace it and it would cost about $3000. Contacted Choice again and they refuse! to let me speak to the manager to get this issue resolved since per the certified mechanics at Midas they knew it was an issue before they sold it. I have just contiued to ask for them to fix the car and make it right. Nothing more. As of today I am still waiting to speak with the Manager.Desired Settlement: I am just asking for the car to be repaired properly! and provide a accurate diagnotic test. If it can not do that then to trade it out and at worst refund my money

In response, this customer purchased this vehicle three months ago and has put five thousand miles on it. His own mechanic diagnosed the problem as "possibly hitting something in the road" to incur this damage. We recommended to have the customer use a trusted mechanic we use to help minimize his cost for the repair, but he declined our offer. We have been in communication and have tried to help.

Review: Car bought has had multiple issues that should have been disclosed before the sale or not even sold in the first place.

The car was purchased on February 8, 2013 within a week the car would not start and was having idling issues when it did start, later I found out the battery was no good choice auto and truck claimed they put new batteries in all their cars. While figuring out that the battery was no good the mechanic also found there was a leak of some sort coming from the head gasket or somewhere else this was not disclosed before the sale and is a serious repair when I took the car back to choice auto and truck they had their mechanic look for the leak and claimed it was something minor and changed out some part. This did not correct the issue. A Few weeks later when I was getting my oil changed the mechanic said I had a transmission leak. Now the car wont start again and has continued to have idling issues and a leak of some sort. I believe all these were existing issues with the car before I bought it. The salesman even mentioned that the "burning smell would go away after the car was driven for a while since it had been sitting" but the burning smell is from an active leak that I believe Choice Auto and Truck knew about before they sold me the car. In addition I did ask for a car fax but they did not show me the whole report just the service records which only included oil changes. One of the mechanics I took the car to said he thought it may have been in an accident because some of the front end parts were newer than others. If it was in an accident I was not told that information either. I believe Choice Auto and Truck withholds pertinent information in order to get a sale.Desired Settlement: I would like Choice Auto and Truck to take the car back and settle the loan for the purchase price of the vehicle as well as refund my down payment of $2300.

Business' Initial Response

After carefully considering the demand to rescind, please be informed that our customer unilateral attempt to rescind is not acceptable. Choice Auto conducts all its business transactions in a proper and lawful manner. The complete satisfaction of our customers is of the utmost importance to our business. However, when purchasing an automobile, the legal and regulatory complexities are designed to protect both the seller and the buyer. As made aware to our customer by conspicuous signs posted in the dealership and wording on the contract she signed, notice was given to her that there is "NO-COOLING OFF PERIOD". Specifically, the notice states:

"California law does not provide for a "cooling off" or other cancellation period for vehicle sales. Therefore, you cannot later cancel this contract simply because you change your mind, decide the vehicle cost too much, or wish you had acquired a different vehicle. After you sign below, you may only cancel this contract with the agreement of the seller or for legal cause such as fraud."

Furthermore because Choice Auto is in the business of selling only used vehicles; it has no way of knowing the complete past history of each and every used car it purchases and resale's. This is why Choice Auto sells most of its cars, as in this case, on an "As Is-No Warranty" basis. Our customer had the opportunity to have the vehicle inspected by a third party mechanic or repair shop at her own expense if she so elected prior to its purchase, as noticed by signs conspicuously posted at the dealership.

Choice Auto through its employees made no representations other than those that comply with appropriate and professional business standards. Choice Auto, its employees and agents made no representations other than the vehicle was road worthy in compliance with California law by virtue of it being smog certified and safe for operation on California highways.

With respect to the alleged defects and without meaning to be contentious, Ms. [redacted] purchased an 10 year old used vehicle with over 117,000 miles registered on its odometer. As I previously mentioned, she had every opportunity to have the vehicle inspected by an independent third party or by herself to ascertain its condition prior to its purchase.

Choice Auto has always been ready and willing to help our customer minimize any reconditioning expense she might incur in improving the quality of her vehicle

Should you have any questions regarding our customer position in this matter, please do not hesitate to contact me.

Sincerely yours, W. [redacted]

Response:

I am sorry I did not get your message before this,

Review: I purchased a used 2007 Ford F150 crew cab 4x4 from Choice Auto & Truck @ 2237 Fulton Ave., Sacramento, after seeing an add on line. The add described the truck as, "Superb Condition," and "Very well taken care of!" Choice Auto described themselves as, "Your trusted choice." The staff was friendly and upon delivery of my truck [redacted], the owner of the dealer, told me if there was anything wrong with the truck he would take care of it for me. Within a few days, I noticed the brakes surging and the 4x4 system wasn't operating(I had put the truck in 4x4 mode and did determine the transfer case was operating, but I never checked the front wheel drive since I was on dry pavement and this is bad for a 4x4 system). I notified [redacted] of this on 2/14/2014 after my first visit to a Ford Dealership. [redacted] wanted me to return to his lot for discounted repairs, but since it is two plus hours away from my home he agreed to have a local shop check it out. Once this happened he said to call him back directly to, "work it out." Razzari Ford and C&S Motors both checked the 4x4. Razzari found leaking vacuum lines, but didn't re-check if the front wheels were driving in 4x4 mode. C&S found additional vacuum leaks and front hub actuators/gears that were broken. Additionally, Razzari found the brakes to be worn out. Front pads at 5mm and rotors not serviceable, replaced back pads. Back rotors are no longer serviceable. Pads were at 2mm. A high pressure power steering hose was also replaced as it was leaking. Total cost for repairs so far(rotors and front pads not replaced, actuators and vacuum lines replaced, hose replaced) is at $1,888.84. I feel this truck was misrepresented to me as to it's condition(advertised as a 4x4, but 4x4 didn't work and brakes were dangerously worn). [redacted] will quote the CA law "AS IS-No Warranty" however, he sold me a dangerous and defective vehicle. Further calls to [redacted] went un-returned by him.Desired Settlement: Either return and re-fund the purchase price of the vehicle PLUS completed repairs, or send payment for the repairs of $1,888.84 completed so far, and $500 additional for a complete four wheel and rotor brake job. Repairs at [redacted]'s shop are not a viable option for me as I live two plus hours away.I have all documentation pertaining to the advertising, purchase and repairs of this vehicle.
