Review: My wife purchased a large palm from this business in April of this year. When it was delivered to our apartment, it was immediately clear that it did not fit or belong. We immediately sought to return the plant for a full refund, but were told that there were no returns allowed. The proprietor did eventually agree to giving us a store credit in the amount of $325 (the purchase price) which we accepted and received in writing when the plant was picked the next day. This afternoon, September *, 2013, my wife and I went to the business to use our store credit. When we arrived, there was only a young woman there who spoke no English (only [redacted]) and could not understand what we wished to do. She called her boss, the proprietor, who then spoke to my wife in a very hostile and abusive manner and refused to cooperate. He said that he would only honor the credit if we returned when he was in the store. I then got on the phone and calmly explained that we held a credit hand written on a store invoice with no mention of having to only deal with him and that we could not easily return. He then remembered us and told the young employee, in [redacted] so she could understand, to help us select a plant or plants and honor the store credit. After a few minutes, with her assistance and that of a delivery man who spoke [redacted] with my wife, we had nearly finished choosing a number of plants whose value was approaching the store credit when the proprietor called back and told the employee to not honor the credit. I spoke to him again and he spoke to me in an extremely hostile manner. He said that "we had fooled him once, but would not fool him again". I responded that I had never fooled him either then or now. He said I could sue him if I wanted to, but he "would not do business with a person like you". He did not make clear what kind of person I was. He accused us of "renting" the palm last April to show off our apartment which was for sale at the time and said we had kept the plant for several days. I replied that we had called to return the plant the very same day and that he had given us a credit which I had in writing. He started yelling at me that I could not tell him how to do business and that he would not give us any plants. I said, ok, then give me my money back. At that suggestion, he became even more irate and said that I could call the police if I wanted to, but he would not give us any plants or any money. I tried to speak to him and call him down, but he would not let me say anything and just kept yelling at me in an incoherent manner. I gave up trying to reason with him and gave the phone back to the employee who was saying she was very sorry. We left the store with no hope of either using the store credit or getting our money back.Desired Settlement: Return of store credit in the form of cash in the amount of $325 instead of the credit due to his extremely hostile and abusive manner which was so bad that my wife (who was to choose the plants) is both afraid and unwilling to return to the store and deal with this man.

The plant store, on this particular clay in September, 2013, an unusual circumstance, was without a permanent working employee intimately familiar with the plants and the retail business op ration on site.

As stated by the customer, [redacted], a young woman, a relative, as helping out at the store in my absence, and was not fully fluent in English, with no intimate knowledge of the plants or what a “credit'' represented. It Is a small store in the Floral District on [redacted] , and she was there in my absence, and I asked that the [redacted] come back to the store when I would be there to see the paper they were referring to... and address the issue of a so-called "credit'' as we never give store

"credits" .I did not know what the "credit" was about, or recall who the customers were,and what the circumstances of the "credit" referred to. l asked that they return when I was there to see the "credit" paper in their possession.

All invoices state no refunds on plants, bold on the invoice, as they are easily damaged when taken from the store and hence no refunds/no returns. Since we never give "store credit'' and have no system for recording and tracking "store credits", I was not sure on the phone, what the young woman was talking about "credit" and her translating the so-called "credit" from the customers claim to her in English, and then to me in [redacted]... Her main language. Hence the confusion. I again tried to communicate with her to have them come back at another time so I could see the paper that said "store credit, to understand what it represented but, they refused to do so.

After confusion back and forth on the phone, and the refusal of the [redacted] to return to the store when I was there to know what the "credit'' was for, I realized who the customer was and re-called the "credit'' was to be used for the same palm tree that the [redacted] had originally picked out back about six CG) months before in April, and we had previously delivered to their home in April for free, and the palm was then picked up again for free after going out to their home my elf to observe the plant In it's space, when they wanted to return the palm, originally claiming the palm was too tall and too big for their apartment, and they wanted a "shorter/not so full" version of the same palm which is what they had originally claimed they wanted when I agreed to pick up the palm and get them the "shorter/not so full version" even though the palm fit perfectly In the space. It did not make sense at the time.

I subsequently was told they were trying to market their apartment and they had gotten the plant for a"staginq" of the apartment for a prospective renter/purchaser (note : [redacted] sates in his complaint... "to show off our apartment which was for sale at the time”, and felt we had been tricked going back and forth when there was nothing wrong with the "size of the palm. Plant staging is not an unusual occurrence for owners/realtors to do to market their properties. But, we cannot send plants out, and in this case deliver for free, and pick up again for free, when the apartment does not sell or the plant does not "feel right" to the customer "staging it" in the space after he purchased it, knowing "no refunds", or, in this case was bought: with the intention of staging he home to market the property and then they changed their mind, or successfully rented the apartment, or sold.That is a different business entirely.

The commotion in the store created by this "credit" caused not only the [redacted], the young woman, myself and the customers who came into the store at this time, to be upset and all regret the incident as well as having agreed to let the [redacted] change the palm tree to a shorter/smaller version...when they never really wanted the palm to keep to begin with ...only the idea of the palm to "stage" their home for rent and/or sale, and I had multiple monies out already for two deliveries to and returned the

plant from their home, under the guise of' the plant "not fitting properly” according to them.

I will agree to resolve the issue and deliver the original palm back to the [redacted], if in fact they are still living on [redacted], or in the City, and have not sold and moved out of the area, this palm being in the smaller/less full version as they originally requested, and what they greed at the time he so-called "credit" was suppose to be for, with no delivery fee.

The [redacted] do not want to come into the store and we, as well, do not want another confrontation/comrnotion with them in the store. Truly a negative experience for all, when we are in the 'business we love of selling live plants, hopefully going to happy homes where they are really wanted.
