of Work Provided The agreed upon and contracted work fulfilled by Christian Kazimir Construction was not substandard by any meansIn fact, when the home was completed to the Client's liking, the Client requested Christian Kazimir Construction to assist with another project in January of Unfortunately, we could not schedule our construction crew to accommodate them with building a new homeFoundation of Property Addressed & Resolved by both Parties The foundation of the house is situated as agreed per the contractAs the Owner lives out of country and could not visit the site in person, pictures of the foundation forms were sent to the Owner prior to pouringThe Owner expressed no concerns that were noted at the time of photosThe foundation was poured as scheduled and agreed uponWhen the Owner returned to the United States and arrived at the construction site, the Owner took issue with the home being sited in line with the street and the other homes on the roadThe Property Owner insisted that the home be was supposed to be built crooked/at an angle to the streetChristian Kazimir Construction advised Client that this was proper siting per the approved site planHowever, in order to provide exemplary service, offered to tear out the foundation and re-pour at an angleThe Client declined the offer and instead requested a $credit, which was approved in writing by the Client expressing their satisfactionWork Completed with *** & Owner Delays The house was completed in Christian Kazimir Construction performed the shell, electrical, plumbing and drywall, which was satisfactory, as contractually agreed upon and promisedThe Owner completed interior of the homeDue to the Owner coordinating various aspects of the final construction, the plumber could not complete his workThe plumber was waiting on cabinets and countertops to be installed (which the Owner was handling at the time)The Owner requested that Christian Kazimir Construction complete plumbing and electrical finish prior to the rest of the interior installThis was agreed upon with a written Change Order stating that the carry over plumbing items would be the responsibility of the OwnerThe electrician could not complete the finish "on time" because of the Owner's management of related duties or incomplete items hindering completionAfter making multiple attempts to get the original electrician out to the property to finish, Christian Kazimir Construction hired a new electrician to complete the punch list items at no cost to the CustomerNon-Existent Leakage Issue There was never an issue of leakage through the building envelopeThere was a faulty seal on an exterior door, which was addressed with the manufacturer's representative in late As a result, additional weather-stripping was added, and no further concerns were noted, nor were we contacted regarding any concerns with the homeCommunication with Owner & Resolution The Owner did not attempt to work with Christian Kazimir Construction at any point regarding the recent complaints the Owner feels are unresolvedAccording to Customer's own assertions, the water damage occurred in their home late February The Owner did not contact their home Owner's insurance until mid-March, at which time they filed a claim for storm damage, which was subsequently deniedFollowing the denial by their insurance company, with no attempt to reach Christian Kazimir Construction, they contacted our General Liability insurance in April Our insurance carrier informed them that they needed to contact us to address the issue(The dates of damage have changed multiple times depending upon whom they are contacting and for what purpose.) In April, when the Client finally contacted us, we immediately respondedUpon arrival at the house we became aware that they had already performed demolition, hindering the ability to determine the exact cause of water intrusionWe performed water tests and could not find any water intrusion through the building envelope via high-pressure water tests at that timeHowever, under high pressure, we could force water through the doorThis type of damage can happen from anything like long-term vacancy, improperly locked door, improper maintenance of caulking and paint, defective doorsWe communicated with the property Owners and advised them to contact the door manufacturer regarding its warrantyWe also contacted the door manufacturer on their behalfWe have made every good faith effort to assist the Property Owner and it is through no fault of our own that any damage to the property occurredWhen built, we advised the Owners to install a sliding glass door to best maintain the integrity of the home in a coastal climate and against weather damageThey declined our advice until their recent renovation, further preserving the fact that we did not over promise or underserve our Clientele and this unfortunate event could not have been prevented nor caused by Christian Kazimir ConstructionIn recent investigation we believe we are victim of fraudulent claims by the Owner as they have targeted other firms within the United States scamming small business Owners out of product, money or damaging their reputation to serve their own purposesWe can faithfully assert this in the states of Washington and Texas and are continuing our investigation to prevent further destruction to establishments that should be protected by the laws and statutes of the United States not exploited by the fraudulent activity of those of moral turpitude
