I am rejecting this response because:*** *** ***’s response to this complaint is indicative of her unprofessional behavior in trying to resolve this disputeWhen I questioned the validity of her keeping a portion of my security deposit, her position has been the same as she has shown via this complaint, “move on” or “proceed with legal action”Even when presented with evidence, she refuses to admit she was wrongShe has now lowered the bar and has resorted to lying about the situationI was never hostile towards her and have the email chain to prove itAlso, how can you claim that I never contacted about items needing repair and then claiming that you did repair one of the items on the list of items I pointed out needing repairThankfully tenants have rights under Texas Property CodeUnder Section I am entitled to $in payment for security deposit withheld without valid cause.

I am responding to the complaint filed by *** *** *** *** was a prior tenant who is upset that $was retained from his security deposit for damages/repairsI sent a security deposit disbursement letter to the tenants within the days allowed with a description and copy of the
invoice for work performed*** *** contacted me after he received the letter and stated he did not agreeI sent pictures and more details to him via emailAt that time he then stated he had to live with "live wires and mold buildup"He never contacted us prior to this about any of these issuesThere were no live wires exposed*** *** is referring to low voltage landscape lighting wires that had been unearthedI am not aware of any mold prior or currently at the property.*** *** has been very hostile to meI have tried to discuss the issue with him, but he does not think he should be charged for damage he created while living thereIt is unfortunate that this situation has arisen, but at this point, it is time to move on*** *** is aware he may proceed legally if he so desires, but it is inappropriate for him to try and slander my name and business.Thank you for your time,*** ***

I am rejecting this response because:I disagree with [redacted]’s response since her statement is inaccurate. She is the one that has refused at any point to try and resolve this issue with me. She did send me a letter informing me that she was deducting funds from my security deposit due to “work performed”. I replied via email disputing all 3 charges with photo evidence disputing two charges and text from Texas Property Code indicating one of the charges falls under “Normal wear and tear”. The tone in her email response was simply indicating her decision is final and has no desire to work with me to resolve the issue. I have email chain that can be provided if requested indicating there was no hostility towards [redacted] at any point. The email simply challenges each charge with facts. It provides photographic evidence and reference to Texas Property Code to dispute her charges. I suppose [redacted] views any renter voicing their concerns as “hostile”. Email chain from 25 Aug 2016 can be provided, if requested, showing I presented problems with home safety and health issues at that time. Photo evidence was included showing where water was coming in the home (through the attic vent and sun room), stagnating in back yard without runoff and creating unsafe mold buildup. This was one month after moving-in to rental property. Unsafe wiring in the yard was referenced in the move-in checklist. This includes the low voltage garden wires that [redacted] mentioned, and also unburied cable wire and exposed 120 volt wiring. I pointed all this issues to the PM assistant [redacted] and the maintenance person that came out to view the issues at the house. I was told that it was going to get handled, but no action was ever taken. I can provide photo evidence showing the unsafe exposed 120 volt wire that runs from the front yard along the left side of the home, to the back.It is unfortunate that my action of disputing bogus charges by presenting facts supported by email chain, photographic evidence and reference to Texas Property Code was seen as hostile, but my intent is to resolve the security deposit dispute in a timely and fair manner.
