Initial Business Response / [redacted] (1000, 6, 2015/10/30) */ Ms [redacted] contacted me about a year after her roof was replaced and said that her chimney was leakingI responded promptly to her call and inspected the chimneyAfter confirming that the chimney had been flashed properly, I continued to look for the source of the leakI determined that the chimney chase cover was the source of the leakI explained to Ms [redacted] that her chimney chase cover was made in two pieces and should have been fabricated out of one piece of metal so that there was not a seam that could allowing water penetrationI explained to her that this is a custom product that would have to be fabricated by a sheet metal fabricatorI provided her with the name of a local fabricator who could help her and said if she needed any more help with the matter to contact me CIG installed chimney flashing at locations where the chimney penetrated the roofCIG billed State Farm and Ms [redacted] $for chimney flashing, which is the amount agreed upon by State FarmCIG did not bill State Farm or Ms [redacted] for a chimney chase cover because it was not damaged by the hail storm and was not included in the State Farm estimate CIG did install & bill State Farm & Ms [redacted] $for step flashing which is the the flashing that is installed at a vertical roof to wall intersectionThis also was the amount agreed upon by State FarmI am willing to obtain an estimate & help facilitate the replacement of the chase cover for the actual cost, but I am not going to en cure an expense for something that I was never responsible for The gutters were installed in October of 2011, since then I have had two conversations with Ms [redacted] about her chase cover and she has never mentioned that the gutters were not draining properlyIf there is an issue with the gutters I am happy to fix them at no cost to Mrs*** I am attaching the Xactimate line items descriptions for chimney flashing, chimney chase cover & CIG's bill which clearly shows that we did not bill for a chase cover Initial Consumer Rebuttal / [redacted] (3000, 9, 2015/11/11) */ (The consumer indicated he/she DID NOT accept the response from the business.) I am a single mom trying to make ends meet and provide for my familyOne of those provisions is living in a house where the roof does not leakI hired the contractor who specialized in roofing, took his advice and had him complete my roofHe sure sounded like experts when he explained all the things that need to be done and whyNow that he has his money and the roof is leaking, he wants me to be the expert and explain why it leaksThis is not what anyone should expect from a professional licensed contractor / roofing company Anyone would expect the roof not to leakAt the time I had money that I could have fixed this if he saw that this was a problemHe used some of the money to give me gutter and fix a windowHad he communicated the flashing issue, that would have been a priority Lastly he's telling me it's a simple fixIf that's the case why is he not fixing it and upholding good business practices? The public should expect a quick professional response / fix Final Business Response / [redacted] (4000, 11, 2015/11/12) */ The roof replacement provided to Ms [redacted] was performed in and was covered by an insurance claimThe insurance claim loss was due to hail damage In CIG Construction inspected the leak issue called in by Ms [redacted] in a timely matterOur inspection finding was a leak at a wall of the garage, and not water intrusion through the garage ceilingAt that time it was explained to Ms [redacted] that the chimney chase cover was where water intrusion was occurringReplacement of the chimney chase cover was not an item covered by the insurance claim as there was no hail damage to the coverThe chimney chase cover is not part of the roofing system whatsoeverIt is located on top of the chimney stackThe chimney cover was not included in the scope of work provided in the insurance estimateMs [redacted] was informed by CIG Construction that the leak issue is due to a design flaw of the chimney cover, in that it is assembled in two piecesWe advised Ms [redacted] that the flawed chimney chase cover should be replaced with a solid coverWe referred Ms [redacted] to a sheet metal fabricator, a provider of chimney chase covers It has now been three years since our last communication from Ms***In recent correspondence and in this complaint Ms [redacted] states that the chimney flashing was not replacedCIG Construction indeed replaced the chimney flashing in the roof replacement performed in Flashing is required by city code and the roof replacement passed [redacted] In fact, The City of Broomfield, where the home is located, performs mid-roof inspections where the inspector specifically looks for all required flashing to be installed before the roof can pass [redacted] mid-roof inspection and roof completion can commenceA final inspection is also required at upon completion, where the inspection again looks for flashing installation required by city codePictures were provided to Ms [redacted] of where the chimney flashing is located(Also attached to this response)We feel that Ms [redacted] may be confused between the chimney flashing, which was replaced during the roofing process, and the chimney chase cover which is not part of the roofing system and not a part of the scope of work provided by the insurance estimate therefore outside the scope of work at time of hire Within this complaint Ms [redacted] also states an issue with the gutter, there was no mention of any problem with the gutters draining in Ms [redacted] communication with us back in Ms***' last correspondence to us was over years ago and she now brings forward these issues to the Revdex.com in hopes to receive some type of monetary compensationBoth complaint items of the chimney chase cover leaking into the garage wall and gutter drainage issues are perhaps a result of delay in home maintenance We stand firmly in the fact that chimney flashing was replaced as per the insurance claimWe will not be refunding for items that were in fact replacedPassing [redacted] city inspections is evidence of chimney flashing installation Although three years has passed [redacted] Ms***' last correspondence to us regarding the leak issue unrelated to the roofing system installed by CIG Construction, we are willing to assist Ms [redacted] and her family by subsidizing a portion of the replacement of the chimney chase cover replacementThe subsidized amount will be at our discretion as the water intrusion issue is completely unrelated to the roofing system installed by CIG Construction Attachments: photo of the flashing location Ms [redacted] is disputing, location of the chimney cover outside the scope of work, copy of the insurance estimate indicating chimney flashing replacement covered by the insurance claim, note that there is no indication of a chimney cover to be replaced in the insurance paperwork dated 8/15/
