conditions. In this case, Mr. [redacted]'s loan funds were not in. Escrow merely signs loan documents with the Buyer as a courtesy to the lender. The loan documents signed were done so at our office, however we, as escrow, have no control as to when the lender will fund the loan. Signing docs is usually day 1 of a 2-3 day process.
The Buyer's lender did not fund this loan until May 2, therefore without money from the Buyer's lender, escrow cannot close. We are at the mercy of the lender, as are all parties in the transaction. Since such time as this complaint was initiated, the transaction has since funded and recorded.
