My complaint is that Cincero Investment Properties is not willing to divide our property lines after making me move my fence back in order for them to build a home that they laid their slab too close to my home so I'm order for them to build I had to pay $1000 to rebuild my fence and now they are saying that they aren't building a fence for their property they are gonna use mine because a fence is a fence if that was the case I could of let my fence stay where it was 5 inches of my property line is on the outside of my fence I feel as if they should build their own property privacy fence because they will be using my property line and that was their complaint towards me the fact that I was 6 inches over the property line also they damaged my yard and Nathan Wall the senior Partner refused to fix he was very rude and unprofessional I have photos to prove my complaints

Desired Outcome

Finish the job To be fair I would like for them to build their own property fence on their property line and not take it upon themselves to utilize my fence and property that's on the other side of my fence I left 5 inches just so they would have enough room to build their fence not to give them my property they refused to go half with me on gettin my fence moved so no it's not ok that they use my fence as their closure because it's 5 inches or more across my property line

In January of 2020, I was hired to build a house at 5620 Libbey Ave in Fort Worth. Ms. lives at 5616 Libbey ave. She has never hired me or Cincero to do any work for her.

In January, I set forms and had a survey company come out and locate property pins on behalf of the property owner at 5620 Libbey. Ms. fence was 2 ft 4 inches over the property line. I have visual evidence to support this claim.

Ms. acknowledged she was in the wrong and asked to split the cost of removing that portion of fence. The home owner I work for said no as Ms. was at fault for hiring a company that put the fence too far over the property line. Neither me or anyone else from Cincero told Ms. no on splitting the cost of the fence as it is not within our rights as hired workers by the owner of 5620 Libbey ave.

As for her assertion that I laid the foundation of the home too close to the property line, and therefore she had to move her fence, this is a complete lie and frankly par for the course during my entire building experience in dealing with her while building at 5620 Libbey.

The set-back requirements per Fort Worth code are 5 ft from the property line. Fort Worth inspectors and the surveying company verified I am within the required setbacks for building, passed my inspections, and signed the required paperwork. Furthermore, her fence was over the property line. Be it the 2 ft 4 inches it actually was over the property line, or the 5 inches she claimed it was, it wouldn't matter.

Ms. asked the owner of 5620 Libbey if he would be willing to split the cost of constructing a new fence along the property line once she paid to have hers removed, and the owner agreed and asked Ms. to coordinate with me. I told Ms. in February that the new fence would not go in until the end of the project as the land would need to be graded first to allow for appropriate drainage. I told her this would not be until the end of April, which was true. She said her kids would be playing in the back yard and wanted a fence. At her own cost and discretion, she paid someone to move her current fence over the appropriate distance.

Ms. new fence is now right on top of the property line. I have photo evidence showing her fence is directly over the property pin. Ms. and her brother, who have repeatedly harassed me at all hours of the night, are upset that the property owner will not be building a new fence that leans up against their fence. Not only would doing so be redundant and completely unusual given how the majority of fences work, but it would also be ceding land to Ms., which the property owner is unwilling to do.

Ms. and her brother have repeatedly shown themselves to be unreasonable, belligerent, and petty. Cincero has nothing to do with the decisions made by the owner we work for, or the fact that Ms. had to pay $1000 to move a fence that was erected in the wrong location by a contractor she hired.

I ask that this complaint be stricken from the record as Cincero has never been anything but upstanding and courteous to our clients and those who own properties around the houses we build.
