My daughter started piano lessons at Cinco Ranch Conservatory of Music in 2019 with “***”
She was very good (my wife and I have professional music experience) and our daughter liked her. “***” went on maternity leave and we were placed first with a teacher who was awful in her approach (didn’t want a parent observing the lesson) and then with another teacher who was okay but not as rigorous at teaching a beginning student the fundamentals.
In January of 2020 we received an email from the CR conservatory saying that *** had taken up a “new position as mommy taking up all of her time.” We were disappointed since this was clearly the teacher with the best fit for my daughter. I decided to search for *** and piano on the internet and found contact information to for *** (we were not given her or the other teacher’s last name at the CR conservatory)at another school. We contacted that school and were in the process of arranging this so we ended our relationship with CR Conservatory. We then learned that CR conservatory sent a threatening email to *** threatening her if she taught us claiming she breached her contract. *** never contacted us until she told us she couldn’t teach us because of this. We searched for her (despite CR hiding her last name). CR is infringing on our right as a consumer to purchase the product (piano lessons with ***) we want. We ask that they, in writing, allow us to be students of *** immediately
Mr. and I (***, representing Cinco Ranch Conservatory of Music LLC) have been in prior communication regarding this matter. It is true that *** was the instructor assigned to Mr. daughter initially. After *** went on maternity leave, we did place her with other piano instructors. In December 2019, *** contacted us via email to indicate she was terminating her relationship with the conservatory, partly due to her becoming a new mother. In response to her email, we simply reminded her of her contractual commitments. Of particular note are her "Agreement For Services of Independent Music Instructor" and a "Non-Solicitation Agreement." *** was never threatened. We reminded her of the ramifications should she be found in breach of her contracts with us, to which she is still bound. It is our belief that Mrs., along with Mr., became upset when they found out that *** was unable to teach their daughter when they formally withdrew from The Conservatory. During the withdrawal process, Mrs. was informed that *** had agreed, in writing, to not teach any current or former student of The Conservatory, for a period of one year from the date she terminated her contract with us. We are being asked to waive the contractual commitment that *** has with The Conservatory. *** was never theatened or forced to agree with our contracts, and had multiple opportunities to indicate her desire to not become an independent contractor with The Conservatory. *** choose to agree to the contracts. These contracts were drafted by competent legal counsel. *** has even indicated, after my communications with Mr., via email to me that she wishes to abide by her contractual commitments to us. Mr. has stated that The Conservatory is infringing on his right as a consumer to have piano lessons with ***. Actually, it is ***, by her agreement to abide by our contracts, that caused any infringement. To maintain the viability of our business, we must enforce these contracts. The Conservatory will not be waiving its contractual rights. Thank you.
