I am rejecting this response because:I am replying to the information provided by Cioffi ConstructionThe information they have shared is not accurateBelow is the accurate accounting of our failed concrete job We did use a power wash company in November to clean the concrete due to falling leaves (not due to a drainage issue)However, this company ( [redacted] ***) was selected because they have a special process they use since our driveway was only about months oldThey used a safe pressure wash and a double fresh water finishThey are happy to provide more information to guarantee that their process was not the cause of the concrete crumbling The first time we used Cioffi was when they were doing work for Columbia GasSince they were already replacing some of our sidewalk, we asked them to do a few more since the city of Bexley only covered ones that were really badThe work they did then was fine, which was why we called them to do our entire driveway a year later I am attaching the quote from Cioffi and the documentation that it was paid in fullAlso attached is the business card from Dustin P [redacted] , who was involved in this entire projectMichael was the one who did the work, but Dustin was involved as well I am also attaching screen shots from email conversations with both Dustin and Joshua C [redacted] , who was supposed to be sent by Cioffi to identify the issue and fix itAs you can see from my texts, he replied but kept saying the rain was stopping him(We had the least amount of rain the past year than in many years.) At no time did Joshua say anything about not working for Cioffi in the wintertimeYou can see the entire conversation I had with himI would have had no way of knowing he was not working there at that time Joshua agreed with me that the work was not done properly and that he would alert his supervisor to ensure it was fixedHe also promised to get in writing that the concrete crumbling occurred way before the one-year warranty had expiredI think you can also see that I was being as patient as possible, given the situation The crumbling of the concrete started within months of when the work was completed, as is verified from my text conversationsThe only work that Cioffi did was cut out a triangle of part of the cracked area (not related to the crumbling issue), and putting a few more cut outs when they came back a second time because more cracks appearedBOTH TIMES, the workers who came out were shown the other areas that were crumblingBOTH TIMES, two different men agreed that the work was “shoddy” and should never have been approvedBOTH TIMES, they said they were going to inform their supervisors about this issue, and would have someone contact meThis never happenedThey BOTH took pictures of the crumbling areas to share with their supervisorsI am attaching those pictures as wellAgain, the cracks and the crumbling are two separate issuesThey did fix one of the cracks by cutting out a piece and re-doing a small triangleThey came a second time to just put a few cut outs in to try and prevent more cracks from appearing since they did not do it right the first time At one point, when my husband finally got ahold of Dustin, he was told that Michael was no longer working thereAT NO TIME was it said that this work was not “authorized” by CioffiYou can see from the quote and payment documents that Cioffi is the company that we approved to do the workWe live in a nice neighborhood and assumed that if Columbia Gas vetted this company to do work, that we could trust them as well Cioffi never contacted us directly for proof of the quote and work doneIf they had, we would have given them the same documents I am attaching today All we are asking is that Cioffi stand by their work, and come out and fix the areas that are crumblingWe don’t think this is too much to request, considering the hassle of dealing with this problem for over one year

After reviewing the documents submitted by the homeowner we stand by the fact that this work was performed by a former employee as a private deal between homeowners and himselfThe contract and receipt were hand written on what appears to be scrap paper and list Mike V***’s personal cell phone number on both documentsFurthermore neither of these documents were issued on our company’s letterhead as all quotes and contracts are required to be per our company policy. Attached are pictures of the driveway as we found it when we sent a representative to investigate the homeowners concernsAs you can see there are no areas “crumbling” as previously statedAs for the pictures provided by the homeowners, it is our belief that these were taken before we sent out a second employee to fill the cracks and chips with a concrete sealantThe large chip as shown in one of the photographs appears to be damage caused by some form of impact most likely caused by a snowplowIt is our determination that we have made good faith efforts to assist the homeowners with their concerns and have made multiple trips down the their residence in attempts to mend the situation at the direct cost of our companyWe do not feel it is the responsibility of our company nor justified to replace the entire driveway

I am rejecting this response because:The information that Cioffi is reporting is incorrect.1) We are not asking for an entirely new driveway. All we want is for them to patch the crumbling areas so they don't continue to disintegrate.2) The pictures I sent were taken before any snowfall, so there is no way a snow plow caused the damage. Plus, snow plows on the main street are not anywhere near where the damage is.3) The pictures he sent back are not all the ones that were taken. It was already crumbling when his representative came to look at it.In fact, his rep was the one that said the job was not done right, and he was the one that said that we should a full replacement. We are not asking for that, only that they fix the crumbling areas.4) Their suggestions that that the pictures taken were done after their rep left are totally false. Their rep not only received the pics from us last year, he took pics himself of the crumbling areas.5) This company is not being honest about their role in this project. The fact that they sent people to "try and fix it" shows that they are responsible for the lousy workmanship done on this project. Their employee Dustin P[redacted] gave us his business card in person and said they would "make it right." How else would we have his business card if he was not here in person? 6) All we are asking is for Cioffi to fix the crumbling areas. Their warranty said one year for faulty work--they need to stand by that since the crumbling happened way before the one year end. It's time they honored their warranty and their faulty workmanship and fix this.7) We should not have to go through this stress any longer.

pressure wash and a double fresh water finish. They are happy to provide more
information to guarantee that their process was not the cause of the concrete
crumbling.
2.  The first time we
used Cioffi was when they were doing work for Columbia Gas. Since they were
already replacing some of our sidewalk, we asked them to do a few more since the

work. We live in a nice neighborhood and assumed that if Columbia Gas vetted
this company to do work, that we could trust them as well.
6. Cioffi never contacted us directly for proof of the quote
and work done. If they had, we would have given them the same documents I am
attaching today.
7. All we are asking is that Cioffi stand by their work, and
come out and fix the areas that are crumbling. We don’t think this is too much
to request, considering the hassle of dealing with this problem for over one year.

(See file for original document.)While working on a project for Columbia Gas in the City of Bexley, Michael V[redacted] had discussions with the [redacted]'s and quoted them a price to perform repairs at their home. Michael V[redacted] was a Laborer for our company and was occasionally placed in charge of a...

concrete crew. His responsibilities were to perform the work as instructed by our superintendents and oversee day-to-day operations pertaining to a specific job. At no time was he ever authorized to speak for our company or provide quotes to customers in any manner. Our Superintendents and Estimators strictly provide quotes. Michael V[redacted] spoke with the [redacted]'s on his own accord, unbeknownst to our company and performed the work on his own. Once this was brought to our attention he was reprimanded and shortly thereafter, on 5/9/16, terminated from employment for another altercation. Unfortunately he has since deceased and therefore cannot shed any further light on this situation.After this issue had been brought to our attention by the [redacted]'s, in a good faith effort Cioffi Construction dispatched an employee to assess their concerns over what they claimed to be stains to the concrete. Upon arriving, our employee determined that due to the [redacted]'s downspout draining directly onto the driveway, a mixture of leaves and debris drained onto the driveway causing stains where their vehicles drove over the debris and ground it into the surface of the concrete. The [redacted]s then had their driveway pressure washed, by another company, to remove the discoloration. Cioffi is unaware of the methods nor the means they used to do this. After a short period of time, the [redacted] a contacted us with further concerns of cracking in a small area of their driveway and as we were still working in the area, we once again sent employees over to cut out and removed the section of the driveway that had cracked, after it was pressure washed. Once again this was done as a courtesy and we performed a small repair to try to satisfy their concerns. This repair took place approximately around 11/16. This process was explained to the [redacted]'s and verbally agreed to over the phone while talking with our superintendent. Josh C[redacted] was our employee who performed these repairs. Josh is a foreman for our company, who once again is only authorized to perform work strictly approved by our Superintendents. It was at this time Josh also took several pictures of the driveway showing no other areas of concern. The [redacted]'s then began to contact Josh directly who had then moved on to another project in another part of the state. As December arrived, we were finishing up projects we were committed to completing. Then as we do every winter, our employees were laid off until spring arrived and ground temperatures return to acceptable levels to pour concrete. It was during this time when the [redacted]'s continually contacted Josh and he explained to them once spring arrived and he returned to work he would make an attempt to return and once more try to address their concerns. When spring arrived we again, for the third time, sent an employee down to perform further saw cuts where the [redacted]'s had wished in an effort to reduce the likelihood of future cracks from forming. This was once again discussed and agreed upon ahead of time between the [redacted]'s and our superintendent. As a company, we do sympathize with the [redacted]'s but as they cannot produce any contract between themselves and our company and we have no records of this repair , it is our determination that Michael V[redacted] did this work on his volition and without authorization in anyway of our company. We have made efforts to assist the [redacted]'s with their concerns simply because in their mind, our company name is tied to this work and we work very hard and are very proud of the integrity we have built as a company. It appears as though our efforts have been in vein, as anytime we satisfy one concern they call with a new one. As a company we feel we have gone above and beyond given these unordinary circumstances in an effort to appease a customer of separate private individual. Also, we like to bring to lite that we have no idea who nor how the driveway was pressure washed.
