To Whom It May Concern: We were sorry to see a complaint by a valued customerThe complaint centers around the condition of the watch she boughtAt the time of listing, we stated that the watch was checked to see that it was in running orderWe also maintain that the watch was rechecked at
the time of shipment by us as well as by her chosen shipperThe shipper signed off that the watch was working at time of pick upOur responsibility and liability end when the item is picked up by our client or her agentPrior to participation in the auction, the customer read and agreed to the terms below: Our terms and conditions Before the Sale states: “All lots are sold and without recourse and neither HEA nor its consignor(s) makes any warranties or representations, express or implied with respect to such lotsNeither HEA nor its consignor(s) makes any express or implied warranty or representation of any kind or nature with respect to merchantability, fitness for purpose, correctness of the catalogue or other description of the physical condition, size, quality, rarity, importance, medium, material, genuineness, attribution, provenance, period, culture, source, origin, exhibitions, literature or historical significance of any lot soldThe absence of any reference to the condition of a lot does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of agingNo statement, whether written or oral, and whether made in the catalogue, or in supplements to the catalogue, an advertisement, a bill of sale, a salesroom posting or announcement, or otherwise, shall be deemed to create any warranty, representation or assumption of liability.” Also stated in each item Description, “Watches are guaranteed to be in running order, if described as such, at the time of listing onlyWatches have not been tested for features functionality, unless otherwise stated in description.” It is important to the integrity of our business that we are transparent, clear and reliable about the requirements of participation in our auctionOn several occasions, we have explained that our responsibility ended where hers began, at the time of pick upLive Auctioneers, the platform through which she made her bid, has also stated to her that she has no recourseWe are saddened whenever a customer is unhappy but can do nothing about this instance

They mentioned integrity and reliability These words in NO way describe this company If they were reliable or had integrity, they would accept the return of a flawed item and refund my money.Here is the email *** Auction sent to me after I was approved to bid:Thank you for your interest in bidding in our auctionPlease note that payment must be received within days after the auction - by check, money order or bank wire transfer. We do not accept credit cards or ***Also, winning bidders are responsible for making shipping arrangements,we do not offer in house shippingRecommended shipping stores will be listed on the invoice each winning bidder will receive after the auction. What legitimate business does not accept credit cards or ***? Also, if they do not accept returns, don’t you think that that should be written in large letters?When I asked to send the watch back for a refund I received the following response: We operatein "buy or beware" format.That isn’t even an English term - it’s ‘buyer beware’, but again if I am a valued customer, they could just accept the return of the watch and give me my money back.That’s all I want: To return the broken item and receive a full refund The watch is still in the original packaging that it was in when it came to me & I’m happy to send it back in the condition that it was in when it arrived.Thank you,***
